I purchased a bran new house with Prmier Homes in summer of 2018. The house came with 1 year builder warranty to address any defects within 1 year of purchase.

I followed the step by step instructions and reported the house defects identified by inspection to them. They didn't respond for at least 1-2 months and finally responded stating that they will not be honoring the 1 year warranty contract and breaching the bounded contract. I have a large list of house defects which some of them are urgent and some can be fixed shortly however they are declining to address my house defects and honor the 1 year warranty contract. They send me an email stating to get a lawyer and talk to their lawyer.

here is some feedback for Fran the real estate agent who is part of the Premier Homes:

Frank B has been one of the worst agents I have dealt with in my entire history of purchasing homes.

1) He is not professional and discusses other business opportunities with you and trying to sell other businesses

2) original punch list from walk through of the house didn’t complete per the contract by closing and many of the items identified during walkthrough didn’t get fixed for at least 60 days post closing with sending over 150 emails to address the issues and he kept refusing and pushing back

3) the house has a one year warranty. Any defects I submitted to him since last October are being ignored and keeps saying it will address later

4) completed an inspection and send him all the defects to resolve and not responding to resolve the defects after 5 business days and ignoring calls and being very disrespectful. There are major issues with some defects which could cause fire or water damage and he hasn’t been responding to those issues either

5) the house has one year warranty font all defects and doesn’t seems like he wants to address the house defects according To the contract

6) he has sent over unprofessional and disrespectful contractors to my house which have been rude and didn’t wanna do the repairs as they said frank never paid them

7) I found out the Hydroseed company they hired was about to put a lean on my house as frank never paid them for their work. I had to call frank to tell him pay the Hydroseed company’s invoice which was past due at least 8 months!

8) frank continues to disappear and not respond to the home buyers. Frank and premier homes built 3 houses and ALL the owners have the same problem with frank, his work ethics, lack of response and missing in action. He also tends to change agencies often so the reviews don’t follow him

9) I highly recommend NOT to hire this agent as you will end up with stress and fed with lies by frank and have to deal with his bad business ethics

10) they used wrong parts across all the 3 homes built. Example I found out my dishwasher was leaking then found out frank had taken a piece of my dishwasher and installed it in the neighbors house therefore when I moved in my dishwasher was leaking and almost flooding my house. They also flooded my neighbors house didn’t to lack of hiring good contractors

11) the trees he planted around the house most of them died cause they didn’t plant them or water them for over a month. It took 20 emails and many calls trying to get them replace the dead trees

12) the top soil wasn’t enough on the house hence the grass is not growing correctly and there is no drainage and water stands in the yard after heavy rain and grass is dying and tons of concrete materials under grass

13) They sold the house as premier and a million dollar home but cut every corner to save money which cause the house to have too many defects

14) Franks has no good business ethics and feel a like he is there just to make money and as soon as the transaction is done doesn’t even want to deal with house defects which the house has a one year warranty on it

This list can go on and on. Above are just some of the challenges that me and my other neighbors have encountered with frank and premier homes (builder)

This has been the same case with this agent Forbes the past 7 months. He always has excuses why he didn’t show up to fix the house defects. He tried to sell me an illegal weed business while trying to sell the house to me.

they have a 1 year warranty builder contract with me to address all defects within one year and they sent me a letter that they are breaching the contracts that was part of the title signing and refusing to fix the house defects per the agreed and signed contract.

he is breaking a legally bound document and contract and breaching it. I have over 300 emails from him when he promises to show up and doesn’t and always an excuse like the one he provided Revdex.com. He has made same exact excuse to me.

Dear Mr. ***,

My name is Frank B and I am a partner of Premiere Homes LLC and I am also a real estate broker, licensed in the state of Washington. I was the listing broker for the home that Mr. *** purchased in August of 2018, and Premiere Homes LLC was the general contractor for his home. The address for the property is ***. For clarity, Premiere Homes LLC was the general contractor of the home, but was not the seller of the property. The seller was ***

As the builder of the home, Premiere Homes LLC was a party to the purchase agreement as the builder and is a signor of the purchase contract. I have attached the purchase agreement, which also includes the builder’s addendum for your reference. The terms of the agreed purchase agreement, as prepared and offered by the Buyer’s agent, required landscaping to be completed, a financing contingency and a requirement that any interior paint scuff marks had to be repaired prior to closing. In addition, as offered by the buyer, the Inspection contingency and title contingency were WAIVED and thus were not conditions of the agreement.

As part of the Builders Addendum, Mr. and Premiere Homes performed a walkthrough of the home prior to closing. The builder’s walkthrough as stated and intended is the process where the builder and buyer to do a home orientation, go over warranty, and all pre-closing items are completed or scheduled to be completed. Following the walkthrough, Mr. demanded from Premiere Homes additional items above, beyond and outside of the scope of the original purchase agreement. The walkthrough punchlist is attached for your reference. Among some of the Buyer’s demands were the repair of a cement crack that did not exist during the Buyer’s viewing of the home prior to walkthrough, but which developerd following Buyer’s initial move in of some of the Buyer’s personal belongings. Buyer also demanded that Builder plant rows of evergreen trees along the back and side of the home. These and additional requests that were beyond the terms of the agreement, yet Premiere Homes agreed to complete the work and also complied to pay a settlement of a certain dollar amount with the Buyer for the cracked cement.

Mr. is a very demanding individual and many of his demands are beyond the scope of any agreements between the parties. The Buyer demanded that Premiere Homes plant a row of evergreens in front of the garage and also installed gravel in the front and along the side of his garage. Mr. also demanded that he be the one to select plants and that Premiere Homes landscape the common area located outside of his property. In good faith and in effort to satisfy customer, Premiere Homes relented and completed the work as the Buyer had demanded and incurred thousands of dollars of expenses paid by Premiere Homes.

Following closing, Mr. called me and wanted a bidet toilet to be installed for his master bath toilet room. The bidet required an additional electrical outlet to be installed and he requested that we make an appointment with our electrician, Active Electric. The appointment was made and the electrician installed an outlet in the bathroom. While he was there, the electrician also installed additional outlets in other areas of the home as requested by Mr.. When the invoice came for the work, Mr. refused to pay the bill for the additional work that was performed at his request. His rationale for refusing to pay the invoice, was that the electrician never told him how much the work would cost before doing the work. Without payment and as permitted by law, Active Electric was going to file a mechanics lien against the property. Mr.’s refusal to pay the bill caused difficulties for Premiere Homes because we always want to take care of our homebuyer customer, yet we also want to maintain our relationship with our subcontractors. Knowing this Mr. demanded that we agree to pay ½ of his bill for which he should be 100% responsible for. Again, Premiere Homes agreed to do so in an effort to make Mr. happy.

Mr. requested that Premiere Homes meet with our subcontractors, landscaper, electrician, plumber, painter, cleaner, finish carpenter, flooring company, and *** Hydroseeding. Some of the subcontractors he met prior to closing and some he met following closing. To all of the subcontractors, he was aggressively demanding and requested additional work. He was unhappy with all of their work and requested them to come back for additional work. They all felt threatened by him because he was aggressively loud, and confrontational. He also intimidated them by accusing them of lying and telling them their work was videotaped voice recorded. He Mr. did not have prior permission for any recordings, if indeed they did occur.

Mr. demands to subcontractors were beyond what is normal for a home sale. For example, Premiere had the home cleaned prior to closing. Because there were still some items left in the garage during the cleaning, our cleaner was not able to entirely sweep the garage floor. Mr. requested that we schedule the cleaner to clean the garage. I scheduled the cleaner to come and she indeed did come to clean the garage. She came as requested, rang the doorbell but Mr. was not home therefore she left. When told of this, he called her a liar and said that he had it on videotape that she did not come at the time she stated. I again asked her to come, she came and cleaned as needed. After she left, Mr. said to me that “the Mexican girl did a sy job and that we should fire her.” He demanded that the garage doors be cleaned inside and out and between all the garage door panels. This occurred weeks after closing. Our cleaner had to come back several times to clean the garage door as to satisfy Mr.. Again, Premiere Home paid the cleaner for these additional work and trips.

Premiere Homes as well as the majority of our subcontractors are small independent businesses. Many are just 1, 2, or 3 man business owners. Most of us do not have the PR department to deal with Mr.’s constant demands. He harassed everyone’s business by being loud, rough, and overwhelms everyone with his continuous daily calls, texts, voicemails and emails. In each case, he demanded immediate response and actions of compliance to his requests and needs. He expects that everyone put aside any and all other business and personal demands to meet his expectations at all hours of the day, including weekend and holidays. If we did not comply with his demands, he would then threaten lawsuits, blasting of the business rating and comments on *** and the internet, filing with Revdex.com, and basically give the business owner “hell”. Many of the subcontractors are afraid of and are refusing to work with Mr..

He has done the same with myself. He called me at 7am and requested that I deal with his needs and respond to his inspection demands by 10am or else he would blast over the internet that I sell illegal drugs, have bad business ethics, and that he would ruin me and my company’s reputation, no one would do business with us again, etc. I told him that I would get back with him later that day. At 10:30am, he called me and said that I didn’t do as he had demanded, so it was already too late and he has already pushed the send button. I was upset and didn’t want to speak to him, I therefore ended the conversation. He sent me a text, and I responded with a text stating that I know that no one can stop him doing whatever he wants, but I will not be allowing him to continually give me threats in order to “hold me hostage”. With the “hold me hostage” comment, he has continually accused me of being a racist. Mr. is of Iranian ethnicity and such he implies that I used that fact against him.

It is ironic for Mr. to imply that I am a racist. I am also an ethnic minority for I am from Vietnam and I came to the United States as a refugee in 1975. When I came to city of Everett, WA, there was only three Vietnamese families residing within the city. I recall one Christmas where my family called the police because we had a cross burning in front of our home. There were few ethnic minorities at the time and local people were oftentimes uncomfortable with cultural and language differences. Almost weekly I was ridiculed for my accent. Kids mocked my language when they heard my parents speaking Vietnamese to me. I know what racism is and have lived it throughout most of my life. I have never thought, implied, or even mentioned Mr.’s ethnicity prior to making that “hostage” statement. Given Mr.’s actions and tactics, I firmly believe that he took advantage of a figure of speech to throw the race card against me to instigate fear. For one correctly applied statement that I made, Mr. has demanded a formal apology to him as well as his broker for my so called “racist” comment.

Mr. implies that I sell illegal drugs and that he has me on tape doing as such. During a friendly conversation, Mr. mentioned that he knows some people with money for investments. I told him that I personally know of the person who was an inventor and original producer of the *** omega oil who used enzymes to extract his fish oil. This same inventor now owns property and has contracts with multiple Tier 3 licenses for cannabis growing and processing. This inventor wishes to use his enzyme technology to extract 99.9% pure cannabis oil to sell to the biotech and pharmaceuticals as ingredients with intent for them to develop medicine to cure illnesses and disease. The inventor has had two of his wives die of cancer so it is my belief that his intentions of cannabis processing are strictly for medicine. In my heart, I believe that with this patented processing and enzyme extraction process, a lot of lives can be saved. I told him if he had investors, this may be something to look into. I explained all this to Mr. during that single conversation and he now because of this he accuses me of selling drugs. As things transpire, Mr. fabricates thoughts and presents things as falsified facts.

Mr. has modified his home to the extent to which likely have caused warranties to be voided. He has replaced many electrical fixtures, installed in wall speakers system, installed indoor and outdoor camera system, replaced plumbing fixtures, replaced furnace thermostat, installed new main entrance door, completely repainted the exterior of the home and gutters, and painted some of the interiors. All of this was done on his own and/or with his own hired contractors. His contract painter, who is not a licensed electrician, told me that he changed some light fixtures for Mr. at the home and the contractor refused to replace more fixtures for that was not part of his contracted painting work. Following the light installation, Mr. called our electrician and complained why in some rooms the lights flickered. Upon telephone consultation with Mr., our electrician told him that the neon/fluorescent lights that he installed were not compatible with the ratings of the switches that were originally installed on the house.

Mr.’s actions and tactics are deplorable. He requested that Premiere Homes contract with a landscaper to do additional landscaping work as well as bi-weekly lawn maintenance and Mr. later refused to pay for many of the completed work. The landscaper simply quit and refused to do further work for him. He hired his own painter to repaint the entire exterior of the home following closing. The painter also painted some other parts of the interior and did additional work beyond the contracted work. Mr. refused to pay his painter, for some of that work and when this painter demanded payment, Mr. raised issues and caused trouble with his employer, CertaPro Painters. Because of this the worker lost his employment from this company.

Mr. suggested that he has consulted with his professionals, being his landscapers, that the lawn was inadequately installed without having enough topsoil. The yard of the property was landscaped with hydroseed and subcontracted through *** Hydroseed. As part of our agreement, Premiere Homes paid additional for *** to come out one additional time to re-seed any patches that needed extra seeding. During the initial seeding, *** inspected the topsoil and declared that there was adequate topsoil and condition for hydroseeding. After two visits, Mr. was still not satisfied and required an additional hydroseed layer from ***. Premiere Homes paid for this. Following almost a year of occupancy, Mr. further complained of the condition of the lawn and *** came out and hydroseeded two more times. *** noted in their report that the condition of the lawn was due to a lawn maintenance issue, yet *** was willing to eat the cost of the final two hydroseeding services. This is a total of five services that Mr. did not pay for the work. It is odd that even though *** performed work for free when the issue was the poor lawn maintenance by Mr.. Mr. overran their business with profane calls, emails and texts. I was told that he even filed a complaint against *** with the Revdex.com. It is my understanding that the Revdex.com concurred with *** and the case was later dropped and closed. *** to this day is still dealing to this issue with present and past clients because of the negative internet blast comments from Mr..

After almost a year of residing in the home, Mr. hired an inspector to perform an inspection of the home as though he was doing a new purchase. He emailed to us the complete inspection report requesting repairs. Mr. also demanded that we perform a walkthrough of the home following almost a year of occupancy. He suggested that we are contractually obligated to do the walkthrough. Our purchase agreement and Builders Addendum do not require a one year walkthrough of the home as suggested by Mr..

Mr. has been impossible to work with. His demands are oftentimes outlandish and exaggerated. We have tried to work with him yet his antics and attitude are impossible to work with. He is unprofessional, profane, and has directly called me every “F” name possible. I have never once responded in same fashion. In search of figuring out how to amicably work with Mr., I have reached out in several occasion to his real estate broker to personally discuss ways to figure out how to work together as the process was too emotional for both parties. Premiere Homes thought that it may be better to discuss things through his contracted broker, ***. His broker backed out on every occasion and only instructed that we communicate directly through email with Mr. and include him within the email.

Knowing what we went throughout this entire period with Mr., and what he has put our subcontractors through, we made a business decision that we no longer wished to play his game. It is evident with the history of his actions, that he makes unsubstantiated claims with intent of getting free services in addition to his efforts to extract sizable payoffs from any business person. He has zero compassion and concerns as to the effect of who’s lives and employment he may destroy as a result from his strategy to save a dollar or make a dollar.

His complaint with the Revdex.com should be disregarded.

This is falsified information this agent is providing you.

I have simply painted my house and switched out a few light fixtures. Moment of the issues listed in the defects are related to what frank is causing void of warranty.

they have not even made an arrangement to walkthrough of the house with all the defects ya and blindly they are saying they won’t cover anything.

this agent is full of lies and tricks.

he is falsifying information which I will be taking him to court soon.

I have proof of email that has has breached a one year contract and not even done a walk through of the house and simply denying the warranty.

I have over 400 emails exchanges where it shows lack of response and lies and falsifying information by frank.

many of the items he is calling out they addressed was part of the closing checklist of the house and nothing was done beyond those checklist.

he is lying and falsifying information and I have reported him to real estate commissioner and they are investigating to remove his real estate license due to misconduct

I’m more than happy to provide additional supporting documents to prrood to you that this against is lying and falsifying information.

as notes he tried to get me to invest in an illegal marijuana business which I reduced to support and join and since then he has been misconducting and needs his license revoked.

I have many items in the house which do no not meet the city code and I believe frank and his team falsified information to pass city inspection.

I have full report showing the stairs and many other areas was not built according to city code and not sure how they could have passed city inspection!

The process of building a house is through a building permit and multitude of inspections process. This is a linear and orderly process. Following the completion of each phase of the construction, the responsible governmental officer/inspector would then be scheduled to inspect the completed work. Only when the officer/inspector approves and signs-off on the inspection for that construction process would the builder be allowed to proceed with the next step in the construction process. The inspection process repeats and continues until the completion of the home with all approval and formal sign-offs.

There will be a final inspection of the final and completely finished home; only with the formal inspection approval of the final inspection would the builder be granted a Certificate of Occupancy. Only with the Certificate of Occupancy would the builder be able to sell the home with title insurance, and the Buyer's lender and insurance company be willing to proceed forward with their funding and insurance of the home.

As explained above, there are NO falsified information that can be provided to the governmental bodies who are inspecting the home. There are no materials given by the builder to the governmental bodies. The completed construction work is what it is and they are all inspected and approved by the city.

Inspectors inspect the home, not information that are provided by the builder. There are no information provided, thus claim of Mr. of falsified information makes absolutely no sense whatsoever. Premiere Homes LLC request that the Revdex.com close this case.
