Dear *** ***:l, *** *** am writing in response to complaint ID *** against my business Premium Motor Car and Truck SalesAs part of my business as a licensed Used Car Dealer all deposits are non-refundable for all customersAny customer that verbally, or in writing commits to
purchasing a vehicle from my car lot, and willingly gives my Sales Manager, or myself cash, or check deposit is not entitled to a refund.The customer identified in complaint ID *** in this particular situation has sent text messages to my Sales Manager over the past months demanding his $deposit backThis customer linked to ID *** led my Sales Manager to believe he was going to purchase the *** Quad Cab truck in fullThe Customer and my Sales Manager had multiple conversations over the phone due to the fact the customer lived hours away in another part of PennsylvaniaThese conversations took place from 11/21/15-12/10/15.Throughout this day time frame, the Customer ID *** changed his mind on purchasing the vehicle in full due to a disagreement with his brotherHence the fact that the customer used a family partnership check, exhibit "B" for the deposit, he wanted a refund because his brother no longer wanted to purchase the truck for their businessThroughout these days the Customer also mailed out his deposit later than he verbally agreed toWe have texts from Customer indicating he "forgot" to mail the checkWe gave him the benefit of the doubt though, relied on his word and did finally receive his deposit in the mail.With the check we received from the Customer ID *** he included a handwritten letter, exhibit "A" the Customer indicated he wanted my business to fraudulently write him two separate bills of sale so "he" could avoid paying a higher amount of sales taxThis was very upsetting to me, because l, nor my Sales Manager conduct business in this mannerAs a result, the customer was told by my Sales Manager that two bills of sales could not be writtenIn my eyes, this showed that the Customer was truly the dishonest person in this complaint.Overall, I am not willing to return the Customer in question ID *** a $depositI have also included exhibit "C" from the Revdex.com website which is an "Educational Consumer Tip" stating that Car deposits are non-refundableIn addition, I hope my response to complaint ID *** will make the customer see he is not eligible for a refund and that he should no longer send threatening text messages demanding his deposit backAll these text messages have been saved on my Sales Manager's cellphonealso hope this response will let the customer know he should not trespass again on my car lot before, during, or after hours like he did recently taking photos of my property and inventory, or the authorities will be notified.Lastly, because of the length of time it took for the customer to change his mind back and forth regarding the purchase of the vehicle, I had no choice but to take the vehicle back to sale at Auction and was notable to sell it back for the amount needed, so in turn lost $2,on the deal,I appreciate your attention to this matterIf you have any additional questions please feel free to contact me at any time.Thank You,Karen T, Owner

March 20, 2016Dear [redacted]:As stated in complaint ID # [redacted] against Premium Motor Car and Truck Sales, NO indication was posted or discussed regarding the right of this business to keep all of my deposit if the purchase was cancelled. When I asked about the amount of the deposit, I was told by the salesman, Keith, that some customers give only $100 in order to secure a vehicle. I, in order to show my good faith, sent $500. At no point was I ever given a hint of their desire to keep all the deposit money. If I had given a deposit of $5,000, this business would obviously claim the entire amount was rightly theirs. By any measure of business fairness, this practice is quite dishonest and deceptive. My repeated phone calls and texts went unanswered. Only when I was able to reach Keith on a phone call (I assume because he did not recognize my incoming phone number,) was I able to discuss the possibility of “donating” a fair finders fee of $100-200. He said he wanted to discuss this with his wife, the owner, Ms. Karen T[redacted] I presume. He said he would “get back to me.” Again, no reply. I have purchased about 15 used cars in my long life, and twice have I had to cancel the purchase. Both times, the businesses returned my deposit because they were honest business people who were more interested in selling me a car in the future (which they did) and retaining their good reputation, rather than laying claim to deposit money. Ms. T[redacted] chose to display in exhibit “C” an “Educational Consumer Tip” stating that car deposits are non-refundable. She neglected to point out that that this tip also says, “before signing on the dotted line.” As indicated in the initial complaint, “There was no signed contract, no bill of sale, and no posted or verbally disclosed policy regarding their right to retain deposit money.” As shown in her “Exhibit A,” I requested a receipt, but never received one. I received a text from the business indicating that they would send a bill of sale, but never received one. It is obvious that Premium Motor Cars is mainly interested in laying claim to buyer’s deposit money. In response to the business claim that I should stop sending “threatening” text messages: There are no “threats” in any of my texts. I have simply said that I will not give up trying to get my deposit back, including visits to the car lot. The business indicated that they would “notify the authorities” regarding my “trespassing.” I would be happy to discuss their deceptive business practices with the police on my next visit few visits. As stated, I want my deposit money returned in full. Sincerely,
