Unresolved issues regarding the contractor unwilling to follow/ honor his contract.
Due to damages from Hurricane Irma, my family and I have been out of my home. I contacted the above regarding repairs on my home. They stated that no one could come out to assess the damages until an estimate provided by the insurance company is provided. Upon providing the estimate, the above quickly mentioned that the insurance company was not providing enough funds to correctly repair the home. He then stated that contacting my insurance company regarding the need for more funds was not necessary. They stated that it would be best to repair the necessary work, close the claim and move on. Despite pleas to contact the insurance company for additional funds, this company became frustrated and stated that I was wasting time. The above provided 2 contracts that state different work to be performed. According to the contract forwarded to the insurance company and mortgage company, all work listed on the insurance company's estimate is being performed. But he created an addendum to only perform a portion of the work based on cost. Also, in my insurance company's estimate, dry wall was to be replaced in my master bathroom as well as master bedroom. The replacement is based on water damage and moisture levels recorded by liquid mitigation. The above stated that he just wanted to get my family and I back into our home and suggested repairing the drywall. I was not aware of these moisture levels, but am upset that my family and I can be exposed to mold, mildew and other harmful substances if the drywall and insulation is not replaced. The contractor refuses to replace the drywall/insulation stated by the insurance company. Before work initiated on my home, the contractor stated that the ceiling drywall in the master bathroom needed to be replaced. He stated that the drywall will be replaced. Instead, he instructed his drywall contractor to repair the drywall if possible. The drywall ended up being repaired. The ceiling is sinking with a large noticeable seam. The contractor above stated that he did not see anything wrong with the ceilings' appearance. Though not correct, he stated that the ceiling looked better than before. My home has not repaired to pre storm conditions. He has been back and forth regarding replacing the drywall that he stated needed to be replaced. I've repeatedly asked the above for an itemized list with prices of all work he has performed. He refuses to provide that list. The contractor has called my mortgage company threatening to place a lien against my home, but the 2nd draw funds hadn't been released from my mortgage company. I have not tried to withhold any funds from the contractor. I don't have any funds to withhold. The contractor also will not provide a written estimate for the work to be performed on my home or for work that he has already performed. He stated that he would do this and has not provided any documentation. They also seem to be confused regarding work that has been performed. I was instructed that work in my garage had been performed, but upon further investigation the work hadn't been performed. Contractor is also requesting draw amounts larger than agreed upon amounts. For example, according to a scope, the 2nd draw should be $7782.30. He has requested over $8000. Refuses to change scope in writing and request additional funds from insurance company. Complains that he cannot get into contact with consumers, yet he may have only reached out once or twice. Actually contacts insurance and mortgage companies stating that he cannot get into contact with consumer. Then tells consumer that he cannot get into contact with members of insurance company. I question if he tries to defame character. I'm questioning if some of these practices are fraudulent.

Desired Outcome

I do not want the above to perform any further repair work. I would like to come to a FAIR agreement regarding funds owed to the above for correct/ valid work that they have performed. I would only like to provide funds for work in which another contractor does not have to correct. I would like to end the contract and further communication once the above is achieved.

We were not contacted by Mrs. until November 2017. Her husband? met on site and explained he would be doing a portion of the insurance work himself. We sent a contract to Mrs. on November 16, 2017 for $22,081.68 for the total amount of the insurance estimate which included the portion of work to be done by us and her husband. Mrs. never returned that contract to us signed, making it void. We then agreed on December 11, 2017 to do a portion of the work outlined in her insurance paperwork for the $22,018.68. The portion of that work that WE were to complete was outlined in a detailed scope of work provided to Mrs. and signed by her along w/ a new contract on December 11, 2017. That act also voided the first contract.A copy of the contract and scope of work that Mrs. signed is attached to this case. Since contract signing we have completed 90% of the work outlined in the signed scope. Mrs. now claims additional work is to be performed outside of the signed scope when it is time to pay. We have contacted the insurance company and mortgage company, who both state Mrs. is being deceptive in her attempt to get additional work done outside the scope that was signed. We have sent a copy of the signed scope and contract to both parties.

We were not hired to handle any water or mold mitigation. It is not in our contract, and that would have to have been handled between Mrs., her insurance company, and a water mitigation company right after the damage happened in September. We were not a part of that process.

It is impossible to come to a fair agreement on anything when Mrs. will not communicate w/ our company. We agreed to complete the last 4 things on our scope of work in early January when we met w/ her personally onsite, after she has paid her 2nd draw as outlined. Now, she wants monetary compensation instead of allowing us to complete the items. Then, on January 17th she files a complaint against us with the Revdex.com stating she does not want us to continue. On January 19th we get an email stating she wants us to continue work, including items not listed on the scope of work. At this point we feel as though we have been left holding the bag for expenses for Mrs. home repairs. Our agreement was with Mrs., not her insurance company and mortgage company. We agreed to complete the repairs outlined in the signed scope. At this point we are at a standstill and will have to file a lien on the property as stated in our contract. We will wait to hear from Mrs. arbitration agent as outlined in the contract.

There are a lot of things that are not true in the above statement. We haven't even mitigated the situation and you feel as if you have to place a lien on my home. So I've decided to seek legal counsel. You should be receiving a letter by the end of this week or beginning of next week.
