I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
The response is indicative to the gist of my frustration with Prestige Sealcoating First of all, I am not a disgruntled customer I am an injured party to an action by Prestige that was neither asked for or wanted What Prestige did is no different than if someone came onto my property and painted my car or house without permission And, because there was actual damage, this may constitute criminal mischief.Prestige Sealcoating is a small, local business that is not too large for the owner to talk to me face to face Instead, they have ***, who informed me that she is just the secretary, handle all communication and she refused to have the owner or manager contact me.On Aug6, 2015, Prestige trespassed, which is a term Prestige used on their social media site to explain their mistake, and provided a service that I did not want I expected someone from Prestige to see me face to face *** from Prestige left a phone message saying that there was a mistake and it was my neighbor's fault In essence, Prestige did not accept responsibility.On Aug7, 2015, Prestige falsely advertised my house on their social media site with the words, "Perfection, from top to bottom and edge to edge." What nerve, given that they knew my house was improperly, if not illegally, seal coated I did not give prestige permission to advertise my house.On Aug8, 2015, my wife left a call on Prestige voicemail asking them to call immediately on her cell phone They did not return our call.On Aug10, 2015, my wife left two more urgent messages on Prestige's voicemail for them to give her a call on her cell phone No calls were returned.On Aug10, 2015, I asked Prestige on their social media site to remove the posting, they replied back that they would not pull their posting unless I responded back to them again What is surprising is that Prestige responded to a social media posting in minutes but not to an urgent phone call after two days. On Aug11, 2015, ***, from Prestige, left a voice message on my home phone even though we had asked Prestige to use our cell phone In the phone message left by ***, Prestige accused my neighbor for the error.On Aug12, 2015, I left another voicemail to which ***, Prestige's secretary, called me back *** was extremely argumentative saying this issue is not Prestige's fault and that my neighbor is who should talk to me face to face because he gave her the wrong address for his house that needed a driveway seal coated I asked *** if Prestige did not go out to my neighbor's house to do an estimate, because if they did then they had my neighbor's correct address *** became angry and said that they did not visit my neighbor's house and that if my neighbor said that they did then he would be a liar.I talked to my neighbor, the one who *** called a liar, and he said that Prestige did come out and talk to him face to face for the estimate He said he would be crazy to have a company seal coat his driveway without an estimate By the way, my neighbor is a career New York *** *** *** who said would provide a written statement, if needed.I then asked *** to allow me to state my issues with her without an angry rebutted before I could finish my point, especially given that she refused to let me talk to the owner or a manager My first issue is that I did not ask for this service and that I am very concerned that their product is not of the same quality as what I have been using for many years*** said that Prestige uses the best quality material in the business and talked at length about all the jobs the do Which led me to my second point...I have always used one company to install my driveway and to do my seal coating.*** wanted to know what company I used I told her it did no matter because they are not the injured party *** again became very argumentative and demanded to know which company I use I gave her the name of the company that I always use, to which she said she had never heard of the company and demanded their address and phone number Again, I explained to *** that the issue is not with my preferred company and that she needed to quit arguing me at every point.By the way, in a recent conversation with my preferred company, they do use a different seal coating process that they believe is of better quality than what Prestige uses In fact, my preferred company said that Prestige uses a process that was deemed illegal to use in ***.At this point, talking to *** was going nowhere because she truly believes that they have done no wrong Evidently, the owner of this small business believes so, too, otherwise he would have talked to me by now to hear about all of my issues, such as having overspray on my newly power washed house, and what actions he needs to take to resolve this issue

8/6/15 -Please refer to my original statement stating dated 8/17/15. When I repeated the address to Mr. [redacted] he never corrected me that I had the wrong house number. I left a message on Mr. [redacted]'s answering machine apologizing and that there would be no charge.Also, a note was left in his mailbox. Mr. [redacted] stated he would explain to the neighbors what had happened when they got home.A summary regarding phone messages left/made-refer to original statement 8/17/15.8/8/15 Mrs. [redacted] left a message -office closed.8/10/15 Message left after 5:00 - office closed.8/11/15 I returned call again stating what had happened. However, I never accused Mr. [redacted] for the error, I explained how the mistake happened.8/12/15 Received a call from Mr. [redacted] which I returned - never once did I say "the issue is not Prestige's' fault and that my neighbor is who should talk to me face to face because he gave her the wrong address for his house that needed a driveway seal coated," -not my words. I also explained to Mr. [redacted] how estimates were done, again please refer to the original statement dated 8/17/15. However, I never stated that" Mr. [redacted] would be a liar." Once again-not my words.Please note Prestige never mentioned billing Mr. [redacted] (160.00) for seal coating his driveway. The product Prestige uses is manufactured by [redacted] a recognized leader in the field. Regarding Mr. [redacted]'s comment "the process we used is deemed illegal to use in [redacted]"NY DOT has no specifications for asphalt sealer regardless of the type of stone used in the mix (binder type 5, type 6, and type 7). Our sealer meets federal specification RT-143, meaning it's good for application to be used on airport runways, streets, driveways, parking lots, shopping malls, or anywhere else sealer may be needed. The application of our product in no way prohibits any additional seal coat or crack filler Mr. [redacted] wishes to apply.Mr. [redacted]'s comment of "overspray on my newly power washed house".Fact: It was noted that there was old sealer on the house from a previous job. Prestige does check for those things before we begin a job. This was never mentioned in his first complaint to you. This is the first time hearing about it. Prestige vehemently denies the above statement. We have professional cleaning supplies on our truck in the event any sealer (which is brushed on not sprayed) gets on a house or sidewalk. We would never leave a job site in such a state.Per our Attorney's advice- no further action was taken.

8/6/15 PRESTIGE SEAL COATING WAS NOTIFIED BY MR. [redacted] THAT WE HAD SEALCOATED #[redacted] BUT NOT HIS DRIVEWAY AT #*.(THIS WAS FOLLOWING A DISCUSION PROIR TO THE SEALING AND MR. [redacted] NEVER CORRECTED THE ADDRESS WHEN I REPEATED IT BACK TO HIM). AS SOON AS I WAS NOTIFIED...

OF THE MISTAKE I CALLED AND LEFT A MESSAGE ON MR. [redacted]'S ANSWERING MACHINE. I APOLOGIZED AND SAID THERE WOULD BE NO CHARGE. I STATED THAT MR. [redacted] (WHO'S DRIVEWAY WE WERE SUPPOSED TO DO WOULD CONFIRM THE MISTAKE AND TELL MR. [redacted] WHEN HE SAW HIM). IN ADDITION, [redacted] WHO SEALED THE DRIVEWAY LEFT. A NOTE IN MR. [redacted]'S MAILBOX EXPLAINING THE MISTAKE AND THAT THERE WOULD BE NO CHARGE.8/11/15 THE [redacted]'S POSTED ON PRESTIGE'S [redacted] PAGE-HOW "PRESTIGE SEALED THEIR DRIVEWAY WITHOUT PERMISSION, USING A POOR QUALITY PRODUCT, SEVERAL CALLS MADE- NO ONE HAS RETURNED ANY CALLS, I WOULD NOT RECOMMEND THIS COMPANY". PRESTIGE POSTED A PICTURE ON THEIR WEBSITE SHOWING JUST THE DRIVEWAY (NO MAILBOX#, HOUSE# NO PICTURE OF THE HOUSE) JUST THE DRIVEWAY TO SHOW HOW IT LOOKED AND DEFEND OUR NAME AS TO THE QUALITY AND SEALER THAT WE USE. WE EXPLAINED OUR MISTAKE AND THAT THE CUSTOMER WAS NOT CHARGED.IN DEFENSE I LEFT A MESSAGE ON MR. [redacted]'S ANSWERING MACHINE EXPLAINING OUR MISTAKE & OFFERED AN APOLOGY ON 8/6/15. ON SATURDAY 8/8/15 (OFFICE CLOSED) WE RECEIVED ONE CALL FROM [redacted] ON MONDAY WHEN I RETURNED TO WORK KNOWING I HAD LEFT A MESSAGE FOR THE [redacted]'S ON 8/6/15, I FELT THE ISSUE WAS RESOLVED. ON MONDAY 8/10/15@ 5:05 (OFFICE CLOSED) PRESTIGE RECEIVED ANOTHER CALL FROM THE [redacted].I RETURNED THE CALL THE NEXT DAY AND LEFT ANOTHER MESSAGE STATING MY PREVIOUS MESSAGE EXPLAINING WHAT HAPPEND & MR. [redacted] WAS GOING TO SPEAK TO THEM.8/13/15 MR [redacted] CALLED PRESTIGE REQUESTING THAT I CONTACT HIM WHICH I DID ON THAT DATE. I ASKED HIM IF HE GOT THE PREVIOUS MESSAGES I LEFT ON HIS ANSWERING MACHINE-HE STATED YES.Mr. [redacted] STATED HE IS GOING TO BRING A LAWSUIT- FOR THE FOLLOWING REASONS:1-WE CHANGED HIS PROPERTY,2- ENTERED ON PROPERTY W/OUT PERMISSION,3-HE WANTED IT HOT CRACKFILLED BEFORE HE SEALED IT AND NOW HE CAN'T DO IT.- I TOLD HIM THAT'S NOT CORRECT YOU CAN STILL HOTCRACKFILL AND THEN RESEAL OVER IT.HE EXPLAINED THAT HE ONLY USES A CERTAIN COMPANY. I ASKED HIM WHAT COMPANY HE USES? [redacted] SAID- [redacted]. WHEN I ASKED WHERE THEY'RE LOCATED HE SAID LOOK IT UP!!!MR [redacted] WANTED TO KNOW WHAT MY POSITION WAS IN THE OFFICE- ARE YOU A SECRETARY?? AND WHY WAS I SPEAKING TO HIM AND NOT THE OWNER? I STATED I BOOK APPOINTMENTS, AND HANDLE ALL CUSTOMER CALLS. I ALSO EXPLAINED THAT [redacted] IS ON THE ROAD SEALING DRIVEWAYS.MR [redacted] KEPT REPEATING THE QUESTION "DID SOMEONE PHYSICALLY GO AND LOOK AT MY PROPERTY-IF SO THEN YOU KNEW THE CORRECT HOUSE NUMBER." I EXPLAINED TO MR [redacted], WE DO ESTIMATES VIA DRIVE-BY, LEAVING POST CARDS - STATING THE PRICE TO SEAL THEIR DRIVEWAY IN THEIR MAILBOX. IF INTERESTED THE CUSTOMER CONTACTS US WITH THEIR ADDRESS AND PRICE- THAT'S HOW WE GET OUR INFORMATION.THREE MORE TIMES MR. [redacted] ASKED ME THE SAME QUESTION DID SOMEONE PHYSICALLY GO ON MY PROPERTY!!? I REPEATED HOW THE PROCESS WORKS, STATING I DON'T KNOW ANY INFORMATION UNTIL A CUSTOMER CALLS. HE WAS GETIING VERY ANGRY WITH ME, AND WANTED [redacted] TO CALL HIM, OR THREATENED A LAWSUIT AND HUNG-UP!! PER OUR ATTONEY'S ADVICE-NO FURTHER ACTION WAS TAKEN.
