I have attached a receipt from [redacted] to show how clearly we make it. The attorneys required us to put the return policy right with the signature so there would never be any possible questions regarding this situation. All Sale Final! We have thousands of dresses on layaway and we...

mark down High Schools to eliminate duplicate sales so the girls can feel comfortable with their choice and having only 1 dress per color of that style worn to that event. We do not want to have to go through all the work of taking dresses off layaway, changing school lists etc. We also order replacement dresses for other schools once a certain dress is sold. We cannot afford to the have duplicate dresses on the floor and double our inventory. We would be out of business with that kind of situation. These are specialty items and when Prom is over it is over.  Once in awhile if the situation really warrants it we have tried to help out and truly make an exception. If a girl really has a change of heart and wants another dress in the same price range we have considered to help her with an exchange if it is available, not sold to that school and we have not ordered a replacement. To try and get all legal with Breach of Contract and malicious with the benefit going to Prevue is just so wrong. We tried to help them by making a true exception when really we should just stand by the  All Sale are Final!!   The dress is still here and we will still consider an exchange under the same conditions but time is going by and we must see what dresses have been sold to that school. Nothing has change here so to imply we have caused her not to go to Prom is also wrong. The dress was purchased, she was going to Prom and for what ever reason at home they decided not to let her go is not because of Prevue. Please let us know what they want to do with the dress they bought her as we are trying to help.   If they want to call me at Prevue and discuss this any further I truly do not mind. I do not know the date of [redacted] Prom but to go back and forth through e mails may just take to much time for them. Review: On February 24, 2015 my daughter selected a prom dress valued at $718.95, at this time the sales representative ([redacted]) offered layaway and said if my daughter changed her mind about the dress we could exchange it for a different dress. We put the dress on layaway with a $200.00 deposit.

My daughter and I returned on March 8. My daughter found another dress she liked over the previous dress at half the cost. As [redacted] proceeded to ring up the dress, I provided her with the "Layaway" contract. [redacted] then said the $200 deposited amount could not be used for the new dress, I have forfeited the dress and their policy indicates deposits are non-refundable.

I explained to [redacted], [redacted] had said we could change the dress if we changed our minds, this isn't forfeiting. I'm back for a dress, a sale is complete once the transaction has been completed.

The contract indicates the monies may not be used as store credit, however, they have breached the contract when they're willing to let me use the deposit as long as I spend the full amount of $718.95 for their convenience but are not willing to let me, the consumer use it towards a dress at half the cost. [redacted] said she was "helping me" by letting me exchange it for merchandise inside the store totaling the $718.95 (this isn't helping me, this is robbery).

I believe this practice of trickery is malicious only benefiting Prevue.Desired Settlement: Unfortunately, my daughter will not be going to her senior prom due to Prevues business practice.

I would like my deposit refunded and hope to see Prevue change their practices and committing to what is said verbally.
