2/12/2015 10:01am: [redacted] purchased a tire on our website.2/12/2015 12:11pm: we have completed our final inspection of the tire letting him know that it is ready to ship.  As standard procedure, we sent him an email fully disclosing every characteristic of the tire and ask him to...

confirm whether he wants the tire shipped or to cancel the order and be refunded 100%.2/12/2015 9:55pm: (after business hours) He responds that we can ship as long as we can confirm it has 20K miles remaining.2/13/2015 9:46am: we respond back that we cannot confirm the miles available on the tire, only how much tread is remaining on the tire and go into detail again about the tread depth.  We tell him that if he would prefer to cancel the order and get a 100% refund to let us know before 5:00pm as the tire shipped with [redacted] then. 2/13/2015 1:07pm: we have not heard back from him so we prepare the tire for [redacted] and email him a [redacted] tracking number.2/13/2015 5:00pm: [redacted] has possession of this package.2/13/2015 5:34pm:  [redacted] emailed him that his package has been received and is in transit.2/20/2015 10:44am:  [redacted] delivers the package and [redacted] signs for it.2/22/2015 10:34am:  He emails us and says that he wants us to reimburse him 1/2 the shipping and then submit a claim with FexEx for reimbursement for late delivery.  I contact [redacted] and request to be reimbursed for shipping.2/23/2015 5:01pm:  I send him an email letting him know that [redacted] delivered the package 1 day before they had committed it to be delivered.  And, therefore they denied the request.  [redacted] home commits to 5 business days.  Since we did not hear back from [redacted] early on the 12th to confirm shipping the tire, we shipped the tire at the end of the business day on the 12th (Friday).  [redacted] doesn't count Friday because they got the tire so late.  They also do not consider Saturday, Sunday, and Monday business days for ground transportation.  So Tuesday, Wednesday, Thursday, Friday.  He got he package on Friday, and they had until Saturday to deliver it.2/24/2015 12:10pm:  He continues to try to extort money out of calling us crooks and threatening again to dispute his credit card transaction.  He accuses us of only paying $10.00 for shipping and pocketing the rest.2/24/2015 2:24pm: I told him that he could return the tire if he was unhappy with it as specified in the terms and conditions.  to try to put his mind at ease that we really don't mark up our shipping costs, I showed him our shipping cost.  I have attached a picture of our [redacted] invoice below.  We paid more to have his tire shipped than we charged him.  We encouraged him to dispute the charges with his credit card and let an arbitrator determine if we had wronged him.2/25/2015 3:49pm:  He accuses us of overcharging on shipping again calling us thieves.2/25/2015 4:01pm: He says he called [redacted] and they said shipping was alot less, so he continues to call us thieves demanding money threatening to dispute charges.2/25/2015 5:54pm:  We respond to him via email and encourage him to dispute the charges or return the tire for a refund.  We told him, outside off those two scenarios we would not be responding back again to his accusations that we are crooks.  2/26/2015 10:20am:  He continues to try to extort money from us saying now that he is going to file a better business claim wanting us to give him a refund back.The end result is the customer was very satisfied with our product.  From our service point of view, we we shipped our tire out within 2 business days, which is what we state is our goal.  We would have shipped it out faster if we had more timely responses from the customer.  Although there is nothing wrong with marking up shipping, we do not ever do that and we charge exactly what is quoted out.  In this case we paid a little bit more than [redacted] billed us for shipping.  We showed the customer our cost of shipping  and he still says we are thieves.  We remained professional with him at all times and let the threats and libel roll off our backs.From [redacted] service point of new, they provided the customer with an estimated deliver date and beat that date by one day.  That is a feat considering that ** was having horrible storms and one should have expected deliveries to be hindered.  But [redacted] upheld their commitment to him which speaks for their dedication to their commitments. [redacted] says in his letter that we led him to believe that he was paying more for faster shipping.  That is a lie.  We never talked to him about paying more for faster shipping.  He chose [redacted] Ground as a shipping method.  When you choose [redacted] Ground for shipping, you agree to have [redacted] be the carrier and agree to the terms of ground shipping.[redacted] is committing libel with his statement asking to be shown a receipt for shipping.  We volunteered to show him our cost for shipping even though we didn't have to, and we did and he still didn't believe us.    I have attached the emails to support this.[redacted] is committing libel with his statement that I showed him a receipt showing we paid much less for the shipping.  I have attached the emails his statement that we didn't ship his tire with the shipping terms agreed to and shipped it with the 'cheapest alternative available'.  I have attached a copy of the [redacted] invoice showing the cost of the shipping and shipping type.[redacted] quotes from our invoice "ship our product: usually within 2 business days"  our invoice says "Once we complete our final inspection, we will email you a tracking number and ship your product; usually within 2 business days".  We would have shipped it in 1 business day if [redacted] would have responded back to us in the same day, but instead, we shipped within 2 business days.We did not allow [redacted] to extort money from us.Now, as [redacted] knows that his credit card company would settle a dispute in our favor, he is publicly making false statements intended to damage our reputation.  He has committed libel.Libel is the written or broadcast form of defamation, distinguished from slander, which is oral defamation. It is a tort (civil wrong) making the person or entity (like a newspaper, magazine or political organization) open to a lawsuit for damages by the person who can prove the statement about him/her was a lie.Please dismiss and remove this complaint from your web site or we will consider legal actions; against [redacted] for making libelous comments, and against you for knowing publishing them after receiving the facts.Regards,[redacted]
