On June 28, my family and I went to the Super motel in San Benito, Texas to have pictures taken of my ten month old son. This was the location that "Priceless Memories", a kiosk at the *** *** ***, informed us we needed to be for the pictures to be taken. We had already paid ten dollars in advance for the pictures and needed only to pay ten more for the "sit down fee". We had paid for a 10xa 5xand a few wallet size photos. The "coupon" given to us at the mall was for the first "pose" picture. When we were called to have the photos taken, we were asked to pick the backdrop we wanted. After testing a few out we found one we thought would look good. We had already told the photographer that we wanted him to be either sitting down or sitting on the rocking horse. My wife was getting my son ready for the picture and attempting to sit him down. He did not want to sit though; he was preventing his legs from bending. While my wife was trying to get him to sit, (maybe three seconds in) the photographer started to take pictures of him. Since the photographer hadn't asked us if we were ready, or even had made an attempt to help my son smile, I figured that maybe he was testing out the lighting (since that is what photographer do)Because the photographer didn’t stop we let him continue, until he said "let’s sit him on the rocking chair". So now I thought he was ready to start taking the real pictures. It was not until that point that he wanted my son to smile and positioned properly. When we were done with taking the pictures we went to look at them. The first one shown to us was of my son standing, not smiling, and pointing at the camera. The picture when none of us were ready. The man showing us the pictuures said this picture is the one we paid $dollars for. When I saw this I realized that we were scammed. The photographer intentionally took the picture when he knew my son and us were not ready so that we would not choose that picture and instead upgrade to the pictures where he was smiling and posed. They told us that the coupon states the money we had paid was for the first pose and that him standing and pointing at the camera was indeed the first pose. By definition "pose" means to assume or hold a particular position or posture, as in sitting for a portraitHe was not posing, he was standing and moving as a baby would do
