Our
extended warranty was offered to Mr. [redacted] (please see attached) Unfortunately

cosmetic issues such
as the ones stated by Mr. [redacted] We are more than happy to help Mr. Siegel
with his vehicle mechanical issues by giving him wholesale pricing with our mechanics. In
regards to the registration issue: When a customer makes a decision to take it
into their own hands they could run in to problems as Mr. [redacted] has. We
recommend Prime Auto to handle title and registration so customers will not
have to go through troubles as these stated by Mr. [redacted] We are happy to know
that we were able to help with his troubles with the MVD to complete his
registration.

Unfortunately catalytic
converters are not a covered component under the implied warranty law especially
in the case that Mr.[redacted]ehicle did not in fact completely brake down or failed to start up at any time. As much as we would love to take the problem into
our own hands it wouldn’t be fair to the past customers or potential customers,
to favor this situation, when we are told by law what we can and can not handle
(Implied warranty law). As you see the implied warranty is not only for the
customers benefit but also for the used dealerships protection. The state
understands that used vehicles can have a wide variety of issues, therefore
limits the amount of reasons a vehicle falls under the “Dealers responsibility”
category. There is also a Buyers Guide that is included in the sale of all
vehicles stating any and all issues that could occur with a used vehicle. A “covered”
component under Arizona law would have been taking care of immediately but once
again and unfortunately catalytic converters are not a covered component. We are not sure why Mr. [redacted] failed to notice that he was well aware of the extended warranty that he signed to decline. We had attached it on last response but we will gladly attach it once again.

According to MVD records and as you will see attached, the vehicle sold to Mr. [redacted] is in fact not a salvaged title vehicle. As where he has received that information from I'm not quite sure. Our [redacted] interest rate is indeed 24% which is normal for any subprime company as well. As for his...

complaint on the price and interest rate, we are in no way or manner obligating or forcing our customers to agree and sign a contract. As a matter of fact here at Prime Auto Sales we pride ourselves in not having the ''pushy salesman" type of attitude and instead being patient and working well with our customers' needs and wants. In regards to the private information being released, by Prime Auto Dealers; we have a meeting four times a year solely about the importance of our customers private information. Prime Auto Dealers employees,  are required to take the steps to ensure the security and confidentiality of customer data. All of our employees have been with us since day one, four years now. We are strongly doubtful that our employee failed to follow the privacy act. After we had spoken with our employee, he had also stated that the third party buyers were unaware of the lien, and the only way they had found out, was when said buyer went to MVD, and was notified for the first time. The 3rd party buyer had then called us and demanded us to take ourselves off the title as lienholders or to give him his money back that he had given [redacted]. We then told him that unfortunately we are not going to be able to help him in this situation. We then advised him to calf Mr. [redacted] and try to settle it with him, he then stated that he has been unsuccessful reaching him and that he was going to go to his house immediately This also tells us that he already knew where Mr. [redacted] lived. He was extremely disgruntled indeed, of the fact

that he purchased a vehicle that he didn't have rights to, without his acknowledgement. Therefore we cannot grant Mr. [redacted]'s wish of exchanging his vehicle for his money back. Thank you for your time

Sincerely,[redacted]

It is noted that Prime Auto, within its' response, makes no attempt to remedy the situation.
Further, a substantial mechanical/functional defect, such as the emissions system going out, is far from 'cosmetic' - This drastically affects the functionality of the vehicle as well as the ability to register the vehicle as it will not pass emissions.
I registered my complaint regarding this issue, with Prime Auto, well within the warranty period - a fact that Prime Auto does not, according to their response, dispute in the slightest. As such, Prime Auto stipulates that the issue was indeed reported during the time frame as provided under Arizona law, as previously specified.
Further - an extended warranty is for issues reported/discovered beyond the initial warranty period, not for issues that occur during the warranty time frame.
Due to this issue substantially affecting the value and functionality of the vehicle, as well as being reported to Prime Auto during the warranty period, I expect that this issue will be resolved to my satisfaction.
The next step if this issue is not resolved satisfactorily, is to contact the Maricopa County Attorney General to report this as a case of fraud and misrepresentation upon the part of Prime Auto (generally) as well as the owner/sales/office staff (specifically).

I bought an [redacted] from Prime in February 2013. That night, the car broke down... I called the dealership in the morning, and to my surprise, the Owner himself, [redacted], came to my apartment to look at the car. He had it towed for inspection, and took me back to the dealership for a loaner vehicle. Turns out, the transmission died. Though they tried to push me into purchasing another car, they let me keep the loaner for a couple months while they had the transmission replaced. I was never charged anything.
A year and a half later, I lost my job, and couldn't make the $400 payments. they worked with me and accepted whatever I could give them, which was only $100 or $200 here and there. I've also been able to drop the car off to them for minor and major work at low prices, and for extensive work, they've given me a free loaner as well. They also allowed me to make payment plans on the work that was done. I never had to pay up front.
This has been one of my better dealership experiences, and I look forward to future business with them.

Review: I purchased a vehicle from Prime Auto on 03 Oct. I was given a 3 day permit by Luis (salesman), who assured me that he would have the title in hand to me "no later than 06 Oct" - The title did not arrive - I called again on 07 Oct to find out where the title was - I was told that he had 'Had some issues in getting the title, but that he had mailed it that day (07 Oct)" - I received the title on 14 Oct, with a post mark date of 10 Oct. I was blatantly lied to by Luis. I also spoke w/ Luis (on 07 Oct about the check engine light coming on due to a catalytic converter issue - which is a substantial repair, reducing the value of the vehicle as it will not pass emissions in this condition- he stated that there was nothing that Prime Auto would do about it, "we operate on such a tight profit that we can't afford to make those kinds of repairs" and that "the warranty only covers 'no start' issues" - despite this being clearly not the case per ARS 44-1267. I spoke with both Luis and Angie (office manager) regarding this - both of which flatly declined to perform any repairs as "it was not their problem" - Upon receiving the title, I went to MVD to attempt to register the vehicle - there was no emissions certificate included within the paperwork - I called Prime Auto - I called Angie (office manager) on 16 Oct, expressing my concern that the paperwork was not all in place - she told me that she would personally mail the emissions certificate, that day. I managed to print out an emissions certificate and took the vehicle to a 3rd party MVD site to register the vehicle on 17 Oct - there was no odometer disclosure form within the paperwork I received from Prime Auto - I called Prime Auto and spoke with Enrique - he was blatantly rude and angry that I had managed to trouble him - I advised him that I wanted the odometer form mailed to me, with a tracking number - He put every part of the odometer form in the mail, except that which was required by MVD to title the vehicle. he also included the emissions paperwork (mailed on Saturday 17 Oct) that I had been promised was mailed on 16 Oct. I was, again, lied to by Angie - the paperwork finally arrived on 22 Oct - I was unable to get to MVD until 07 Nov - They told me that I did not have the correct piece of the odometer form. I then drove 52 miles (one way) to the office - wherein I was told that there was no manager on duty - they got Angie on the line who flat out refused to do anything even remotely close to resolving the issue - the only thing she would do is tell me "sorry" and refused to provide a temp tag unless I paid the $199 doc fee. She told me, verbatim "You can always walk to the MVD - or have someone take you" - She also intimated that this was my fault, as I did not want to pay them the $199 doc fee to process the title/registration. I received the odometer form and was finally able to register the vehicle, 34 days after purchasing it.Desired Settlement: Now that the vehicle is (34 days later) finally registered, I would like to have the engine codes for the catalytic converter resolved (as reported to Prime Auto on 07 October), either by repairing the oxygen sensors or catalytic converter (as required), along with a 'loaner car' for the duration of the repair.

There was no written disclosure of any material issues with the vehicle, let alone an issue that, unless repaired at great cost to myself, renders the vehicle un-registerable and essentially a paperweight.

I had to replace the battery (not unexpected for a vehicle that has sat for some time) - the check engine light came back on (for the same issue) within 72 hours of replacing the battery. Due to the types of issues reported, along with their general lack of caring/service in other matters, I suspect that Prime Auto had willfully disconnected the battery to clear the computer/idle/emissions data, knowing that it would take apprx 3 days for the codes to re-post, thereby avoiding making what may be an expensive repair.

Review: I was interested in purchasing a 2007 Chevy Tahoe at Prime Auto Sales and did not purchase the vehicle due to the financing that was ultimately offered was beyond my capabilities financially to accept. I left the deposit in good faith with the intention of purchasing a vehicle as long as I could afford the price and the financing was not beyond reasonable. The sales person I spoke to said that the deposit was refundable and that if a loan was found and I could not meet the terms my 100.00 deposit could be returned. Sales Rep was [redacted]. I spoke with [redacted] and he told me I could come in and pick up the check for $100 on Friday 10/11/2013 than later received a text message stating his manager said no. I called [redacted] back and informed him that was not the agreement we had and he voiced he understood and that I would need to talk with his manager. I received a voicemail from [redacted] which I assume is the manager on 10/11/13 I was unable to call him back until 10/15/13 and left him a message to call me back and as of today 10/22/13 no return call.Desired Settlement: $100 refundable deposit as stated from [redacted] Sales Rep at Prime Auto Sales.

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

The statement provided from Prime Auto Sales is not true! The sales Rep [redacted] stated my deposit would be refunded if Bank of America didn't approve my application and also wrote that on the receipt I have from Prime Auto. [redacted] also stated I could come in and pick up a check once I told him I couldn't afford what they offered me thru there financial company because Bank of America denied me for insufficient credit. [redacted] later sent me a text message which I still have stating his boss said no. This was not the agreement that I had with [redacted]/Prime Auto Sales and they are just taking advantage of the situation at hand. They should honor what THEIR employees are telling there customers.

All deposits are non refundable. Customer can use deposit as credit towards any vehicle in our inventory within twelve months of deposit date

Business

Response:

All our holding deposits are non refundable but in this ocassion we told our customer that we will refund her money if we are unable to finance her. In which in this case we were able to finance her and even decided to work with her on her down payment. After all the customer did not want to do the deal. Therefore the holding deposit was non-refundable as we were able to finance her.

Review: I purchased a car that I was told was in working order and after taking the off the lot and home found that there where things wrong I requested them to be repaired and they did some and said I had to do the rest - they hide some of the things wrong which made me concerned but I believed them when they said the CD was working which is contected to the GPS system and FM/AM system I requested my funds back - they stated that there was nothing wrong with the car and also hide the things that where wrong from me, I told the lender and they refused to do the loan because of the things not working on the car , I signed something that staed that there was NOTHING wrong with the car and THEN signed a non- refundable form thinking that everything was okayDesired Settlement: The return of my $2000.00 in full

Ms. [redacted] test drove the vehicle and had no complains. After a couple of [redacted] she had stated that her door handle was not working well. Although it was a cosmetic issue (which we do not cover) we were more than happy to help her out and fix it for her. Not to mention after [redacted] of negotiation we had agreed to sell her the vehicle at a whole sale price! and it was being financed! Ms. [redacted] decided to undo the deal because we were unable to fix another cosmetic issue which was her radio. Our 15 day or 500 mile warranty does not cover any cosmetic issues! Ms. [redacted] broke the contract resulting in the non-refundable down payment. Ms. [redacted] spoke with a lawyer and also acusing us of other several lies. The Lawyer was unable to help her as she had no proof of such matters and her statements did not add up.

Review: I have purchased a vehicle from Prime auto and have been making payments for several months. I was sold this vehicle under the impression that the vehicle was in good condition. I found out that the vehicle has a salvaged title and that information was not disclosed at the time of purchase. I was sold the vehicle at full retail price with an incredible interest rate (20%) or higher. Recently I have tried to sell the vehicle to a third party whom I found on [redacted]. The amount I was selling the vehicle for was less than what I owed Prime Auto. I informed the buyer that I did not have the title and he stated that as long as he could register the vehicle in his name he would be happy. I planned on using his moneys to apply it to the lien and finish making the payments. Once the individual went to the DMV to register the vehicle he was notified that he could not do so. He then contacted Prime Auto and inquired about the vehicle. Prime Auto then released my private information to an unauthorized individual. They released how much I owed on the vehicle, the amount I was delinquent, and also convinced the individual that what I was trying to do was fraud. This individual now knows where I live and is very disgruntled. I was humiliated and now have to justify what I was doing to a detective and hope that the individual that was trying to purchase my vehicle doesnt try to harm me or my family now that he nows where I live. I work with people's private information and I know that per CFPB what Prime Autos did is not just irresponsible and dangerous, but illegal. They release my non-public information to an unauthorized 3rd party who had no business knowing my current financial situation. They also did not inform me that the vehicle that I was purchasing was abandoned in 2003 and has a salvaged title. If that information was disclosed I would not have purchased the vehicle let alone for above retail price.Desired Settlement: I want to return the vehicle in exchange for the amount that I have already paid for it. I dont know how they can make up for the fact that they leaked my information to a person that I do not know. I have triggered an investigation with the [redacted] because what they did was preditory lending and irresponsible lending practices. I cannot explain the aggrevation I went through dealing with this situation.

I purchased a voltswagen beetle , the day I took it , I could tell it would not go into 4th gear. I took it back and everyone there insisted it was fine. I took it home again, but when I drove it , I could just tell, it would not kick into 4th gear. I went back, the so -called mechanic on site says to me.. see the 1,2,3 in the car on the consol, that means it only has 3 gears. So now I thought I was stupid. But you can drive a car and have it wine trying to get into the next gear.I went back down , now they said they will take it to there other mechanic. A week later , I called, because they never call back. And they say, yes there is something wrong with it. So I can get it fixed ( on them ) or pick out another car, I said fix it. So 2 more weeks and I call , is it ready yet, they then informed me it was going to be too exspensive to fix and my only option they said was I could get a volvo, or a crusier. I said no, just give me my money back then. NOPE that wasnt an option they said. So I ended up going home and making some picket signs and went to there corner and stood out front of there business and picketed. 20 minutes later, here comes [redacted]..." what are you doing " I said, you are not going to make me take a car I don't want. So then she says they have another Volswagen Bettle newer, and I don't have to put any thing else down, although the payments are longer now. But I cant believe they tried to tell me my only options were to take a car I didnt want. I would be careful if I were you and shop somewhere else for a car.

I purchased a truck from this dealership a few weeks ago. This is by far the absolute WORST experience I have ever had. Not only was I there for hours and hours I was never offered anything(bottle of water or anything). The entire time we were there we only looked at that truck. We took it for a test drive and after we got back I smelt antifreeze. I told the Sales Manger who was working the deal with us. (Luis) and he said ok we will look into it and fix it. Well.. finally after a few more hours, while they were fixing my truck I just purchased to be finished I finally asked if we could go get food and come back. Luis said yes and to come back in about an hour and the truck should be ready. We came back in about an hour and 15 minutes and the truck still wasn't done. While we were waiting Luis had stated that they just performed an oil change on it so we shouldn't have to worry about it. Finally another hour and a half we were able to leave. Well that weekend my husband had to change the oil in our other vehicle so he decided to check the oil in the truck we just purchased. While he pulled the dipstick he realized that there was no oil on the dipstick at all. We immediately went to the store to buy the oil and oil filter. He dropped the oil and what oil was left was black as black and sludge. I also informed Luis that the oil was NOT changed and I demand my money back for us having to change the oil ourselves. He stated that he would only be able to give us $30 and that is what his mechanic charges them. I told him that I would not accept it. Why would I accept $30 when I paid $50. So I would be out $50. He agreed to pay me the entire amount to reimburse me.

After we changed the oil we were driving the truck around and my husband stated that the check engine light came on. I immediately called the dealership and informed them of this and they came to pick up the truck. Luis stated that it was the evaporation control canister. He stated that his mechanic fixed it and everything should be good to go. Well. a few days later my husband was picking me up from Big O Tires in the truck and the check engine light came back on. I once again immediately called Luis and informed him that it came back on and he stated that it could be the way my husband was driving the truck. I said no check engine lights do not come on the way you drive it. I proceed to ask him if his mechanic manually shut off the check engine light when he fixed it. He said,"yes they did. You have to when you fix something on the truck." I told him No you don't.. if you fix the issue correctly then the check engine light will shut it off on its own. He proceeded to argue with me and I told him that I would be taking the truck to my mechanic and they will pay to get it fixed. He said, " OK.. we will take care of it." While the truck was at my mechanic my mechanic called and told me what was going on. He informed me that the evaporation control canister needed to be replaced and the radiator antifreeze hose was leaking. (The exact things that Luis said that HIS mechanic fixed) My mechanic stated that all Luis' mechanic did was weld a piece of metal onto the old canister. He told me that it was the original canister. He said that he would contact Luis and get payment from him. My mechanic called his cell phone and the dealership number multiple times and NEVER got a call back.

While the truck was at my mechanic Luis had called me and stated that he needed to meet up with me for me to sign paperwork since I had gotten a new loan holder (previous loan had the extended warranty on it) He picked the location and time for this appointment. He decided to meet at Arizona Mills Mall at 11 am. When we got there I called Luis and he never answered the phone. So I called the office and the lady that answered the phone stated that Luis was still at the office and that he is with a customer. I told her to have Luis call me since he was the one to schedule the appointment and he didn't even bother to call me and tell me that he wasn't going to make it. He called me a few hours later and he stated that he was sorry. But he had forgotten about it. (The day before I was supposed to meet him I called him to confirm this appointment that HE set up and he confirmed it.) While on the phone he asked if I was still at the mall and I told him no. I waited there 2 hours to hopefully he would be there but he never showed up. I said we live far and we took time out of our schedule to come and meet you and you didn't even call to let us know what was going on. He apologized and asked if I could meet him later that night. I told him no that my husband and I had plans. He said what about Monday. I said I work Monday-Friday 8-5. He then proceeded to ask if I could meet him on my lunch hour. I told him no that I couldn't. He asked what about tomorrow (Sunday the next day) I said yes that should be fine. He said that he would meet me at my house since he flaked out on me the day prior to. He said yes and that he would call me tomorrow and let me know what time. I said ok that is fine. Finally at 4 on Sunday he has yet to call me so I called him. I left him a message and an hour later he called me. He asked if I could still meet up and I agreed. I asked him at what time he said in about an hour. That was at 5:45. So I figured that I would give him until 7pm. At 7pm he texted me stating that he was on his way and about 20-30 minutes away. I said ok that is fine. 8 pm Luis finally shows up at my house. I informed him that I wasn't happy of everything that was going on and he apologized. I said all I am asking from you is for you and your company to make it right. Pay the bill to my mechanic. He told me we will take care of. I said fine. The paperwork that my husband and I signed he told me that he was going to contact me the next day to get my fax number. I said ok that is fine. That Monday my truck was ready to pick up. So we went down to my mechanic and my mechanic told me that everything that Luis said they fixed was never fixed. I gave my mechanic their number again to ensure that they have it so they could pay my mechanic. My mechanic also informed me that the alternator was going to be going out soon. I said ok. My mechanic called my husband on Monday of this week 8/24/15 and stated that he has left multiple messages with Prime Auto and with Luis to collect payment and they have yet to call him back. I told my mechanic that I would be contacting Luis to get the bill paid. My mechanic said fine and that I would have to pay by Tuesday. Finally after leaving multiple messages the manager of Prime Auto called me. I told her everything that has happened and that I didn't trust their mechanic to be fixing my truck since everything that I had requested and they said that the things they fixed was never fixed. And I couldn't have that anymore. She understood and said that she would contact the owner of the company and would be in contact with me. The total bill from my mechanic was $353.97. Prime Auto only agreed to pay $114 for the evaporation control canister. She stated that the owner didn't want to pay my mechanic directly. So I had to pay the entire balance and hope and pray that they will pay me back for the $114. The manager also stated that Luis did not put on the extended warranty on my new loan.

I have NEVER been so disgusted with a company as I have ever been with this company.

Also when I was purchasing the truck I need to put a little bit more money down. So they agreed to hold a check and cash it for the date I post dated it. Since my new loan I did not have to put any more money down. So I asked Luis to mail me my check. He said absolutely.. 2 1/2 weeks later I have YET to receive this check.

I will never refer anyone to this dealership since they have poor customer service, and horrible communication skills and will NEVER return your phone calls.
