Re: Case # [redacted]
I am writing in response to the complaint filed against my company in November 2017.
In October 2016 we performed the work listed in Invoice #168 that is attached. The work completed included, Removing existing yard by running a Harley rake through entire yard to take up existing grass. Scraped off grassy vegetation and hauled away. Pulverized entire yard with tractor. Leveled ground as needed. Laid new seed, applied fertilizer, and then laid straw. The customer paid $6,000 total for the work that was performed.
We had some heavy rain storms in the fall after the work was done, which caused some erosion and washed away some of the new seed that was laid. In the spring of 2017 we returned to the customer's home and over seeded the entire yard and rolled entire yard, at no charge, which would have been $175. Then we added 4-5 tons of top soil in the problem areas where the rain and washed it away. Then laid seed, fertilizer and laid straw over entire yard, also at no charge, which would have been $350.
Again we started fertilizer in April 2017, and have done this 4 times at $200 per treatment, which customer did pay for.
I have spoken with the homeowner 2-3 times throughout this process. I have explained to him that this is a work in progress and he cannot expect a full, thick, established yard in just one years' time. I have also explained to the customer that he should continue to over seed and fertilize any areas needed to achieve the yard he wants. I have been by the home to see for myself and the entire yard does have grass, and there is defiantly more than 25% of grass growing. I am not sure what I can do next to resolve this issue, as the customer does not want me to continue treatments as I suggested. I am willing to work with him to resolve this matter, I am just unsure what he wants me to do. I have explained this to him, and we were not able to come up with a solution, as it will take more time to establish a yard that meets his expectations.
Please contact me at any time so that we can come up with a plan that is going to satisfy my customer. I am able and willing to work with him to resolve this matter.
Thank you,

Initial Consumer Rebuttal /* (3000, 7, 2017/12/21) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Lets start with the rolling of the yard. He was told he needed to roll the yard because the first application he applied he put ruts in the yard because it was to wet to be on it.
The yard does have grass on 95% but most of that is the old type of grass not the new style which I stated as being 25% of my yard which is what I paid for when the the yard was first worked on.
He had made comments that he had a couple of lawns that were issues for him this past year- but no comments how he was going to take care of them.
I never said he couldn't do the treatments next year but will certainly not let him now.
The enclosed letter was sent with the last check to try to find out what his next move would be and I got no response execpt the cancelled check so thats why I sent a noticed to the Revdex.com.
I chose to start with the Revdex.com before contacting my attorney to see what issuses woudl arise if I put a sign in my yard stating the how shoty [redacted]'s workmanship is.

Final Business Response /* (4000, 11, 2018/01/03) */
I am responding to the complaint against me by [redacted]. I have explained the work that we have done, and I have offered to meet with the customer to discuss his expectations and to come up with a resolution. He has made it clear that he does not want me to work on his lawn any further. In regards to the cancelled check Mr. [redacted] is speaking about, If there was ever a cancelled check sent to him, it was because he cancelled it and the bank would have sent it back to him. I was not aware of that until he pointed it out in the last response to the Revdex.com. I will be contacting my bank in the morning to determine which check he in fact cancelled. I have offered my services and gave him options to proceed with the process to establish his lawn. I have provided free services to him, as he was dissatisfied throughout the process, even though I explained multiple time that establishing a thick, full lawn is a work in progress and will not happen as quickly as he expects, by any company. I am willing to negotiate some what of a refund to Mr. [redacted], after I talk to my bank regarding the cancelled check. I would like to know what he thinks is fair for a refund, keeping in mind the cancelled check and the services I have already provided for free. If we can come to an agreement on an amount I am willing to resolve this matter with a fair refund. Please let me know Mr. [redacted]'s response. Thank You, [redacted]

If he wants to refund half of the original payment for replacing my lawn I would accept that resolution.
The fertilizer and weed killing applications we paid in full and don't want any refund for that service.
