david g*** Jun to me Hello ***, Here is my response to correspondence sent to us concerning a complaint you received from *** *** about her purchase of a *** ** *** from PrimeTime Motors on or about 5/15/2016. We made no claims about
the vehicle's road worthiness or its expected longevityIn fact, we told Ms*** that the car was a trade-in, that we knew it had some problems, that it seemed to be leaking power-steering fluid, that we weren't sure about the nature of any other possible problems, and that we had no plans to fix any of the problemsWe told her the $cost of the car might make it feasible for someone with mechanical skills to obtain a vehicle that might or might not be made to run on the cheapWe made clear that we didn't know what it would take to get the vehicle into running shapeWe told Ms*** she was buying the car "as is," and that she likely would incur repair costs after she left the lot. Also, the salesman suggested that the vehicle might not be a car that suited Ms***. I'm not sure what else we can do in terms of being honest with the customerI might add that we are still getting plenty of inquiries about the vehicle by emailI am fairly confident that Ms*** could turn around and sell the *** for what cost she has in it.David JG***, PartnerPrimeTime Motors LLCBroadwayLorain, OH 44052440-288-

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
The car could not got to the repair shop promptly as they are stating. It was Saturday evening we purchased the car and repair shop was closed. The following day was Sunday and the shop was closed. The salesman pointed all of that out. That is why he agreed I could take the car to work Sunday but to be sure and have it back by early Monday morning. We followed through and did that. I have not heard from them since Wednesday evening when we went into the office and he refused to give a refund. We initially were going to back out before signing the papers because of the tracking device required on the car. The salesman kept calling my husband pigheaded for not wanting to continue the deal at that time because of the device. I did a little investigating and found some loan companies do that now. So we proceeded with the car. We never had the opportunity to even enjoy the car. It is back on the lot for sale now. So the $1000 he got from me for the car he can turn around and get $1000 again from another consumer.
[To assist us in bringing this matter to a close, we would like to know your view on the matter.]

We tried to get them into the vehicle as quickly as we could. We did, in fact, do more than we promised in straightening out some issues with the vehicle, which is probably why a fix took longer than anticipated. That is, we purchased tires for the vehicle and had them installed. We let them know there might be a delay when we talked by phone with [redacted] on Tuesday morning. On Wednesday afternoon, when they came in to demand their down payment back, the vehicle was sitting in our lot and ready to go. The question is, what would a reasonable person do?Seems to me there are a lot of red herrings here. GPS's are normal nowadays for certain buyers and certain lenders. Another red herring is that their purchase of the vehicle, to our understanding, was not contingent on us getting the car fixed immediately after they signed papers. We explained that was impossible. Reasonable people are given to understand that the world doesn't always work on their schedule. Reasonable people often make allowances for the well-meaning efforts of others that don't conform precisely with expectations. And perhaps reasonable people understand when their expectations are inflated and unrealistic.Further, we are within our legal right to keep the down payment without giving any kind of reimbursement, but we are choosing to offer a partial reimbursement that covers our costs in this matter. I don't have anything additional to say.

This business response was received by Revdex.com staff member ** via email and is a copy/paste.Hello [redacted] We received Revdex.com correspondence from you today in regard to a complaint made by [redacted] in regard to the purchase of a 2008 Pontiac G5. Ms. [redacted] and her husband, [redacted],...

signed papers agreeing to purchase the vehicle,   including the FTC document stating that the vehicle was being purchased "as is." A temporary tag was issued at the time of signing. Also at the time of signing, which occurred on Friday, Dec. 2, 2017, we agreed to repair a few minor issues with the vehicle  the [redacted] asked to be fixed. We suggested that the [redacted] should allow us to send the vehicle to a mechanic shop promptly so the shop could make the fixes before final delivery. The [redacted], however, said they needed the vehicle promptly and wanted to leave the lot with it immediately after signing. We agreed and set up an appointment on Monday, Dec. 5, to have the repair issues addressed. Our salesman told the [redacted] the shop would attempt to repair the vehicle that day, although it's a little difficult for us to make promises or projections about what another business might do in terms of making repairs or doing so within a specific time frame. At any rate, the shop accepted the car on Monday morning. The shop owners determined that one of the problems, which we did not anticipate, would require the installation of two new tires. Unfortunately, we did not learn of the diagnosis until the next morning, when we authorized the shop to order the tires for installation. We were trying to do right by the customers by fixing their problems even though the fixing would take longer than we or the [redacted] had hoped. The tires were ordered on Tuesday and, unfortunately, not delivered until Wednesday. The repaired vehicle -- with 2 new tires installed -- was brought to our shop by about 1 p.m. on Wednesday. We attempted to explain to Mr. [redacted] that we had done what we promised, even at greater expense than we anticipated, to fix his vehicle problems at no additional cost to him. We also told Mr. [redacted] that we had little control over what another shop does in terms of process, and that he shouldn't hold the delay against us. We agreed that there was some inconvenience to him, which we regretted, but that he had signed papers to purchased the vehicle making the agreement not rescindable. He has left the vehicle on our lot despite our efforts and desire to hand over the keys to his car as of Wednesday, Dec. 6, the last time we saw him.Lastly, let me say that even if we were of a mind to somehow nullify the purchase to which the [redacted] agreed, we would not  be of a mind to return the entire down payment. Unfortunately, there are expenses related to the license tag, title, labor and documentation that must be accounted for. We did all we were asked to do by the Thomases and more than we were required to do by law. To suggest that we also should pay any additional costs because the [redacted] changed their minds about purchasing the vehicle after signing papers is not part of any equation that I know.Dave G[redacted]PrimeTime Motors LLC2115 BroadwayLorain, OH 44052440-288-0297http://primetimemotorsllc.com/https://www.facebook.com/PrimeTim...
