Harassing of unrelated people
This business keeps harassing me about some 3rd party with the same last name. This is ridiculous, as the jetski that they are trying to repossess doesn't belong to me. Their employees keep calling and texting me in their attempt to locate another person with the same last name. Today they have sent a towing track to my address to repossess some jetski. Again, I have the same last name as the other person, but I have no relation to that person. This harassment needs to STOP!

Initial Business Response

We took the customer through our formal claims process and did not find sufficient evidence that the company that towed the vehicle caused damage or took the customer's property.

Upon receiving the vehicle, the customer signed a from stating that they inspected their vehicle and did not notate any damage. This form also confirmed that the customer received all of their personal property. We did a review of the towing company's intake photos and condition report and it did not appear that they caused damage.

Please note, we did let the customer know that they also have the option to work with their insurance company if they wanted another assessment.

Final Consumer Response

(The consumer indicated he/she DID NOT accept the response from the business.)

First, they make you sign the papers to pick up your car, before they even let you see the car. As soon as I saw my car, I saw the dent, and the employee was standing there, as I was [redacted] and going after the tow truck driver that was there, but she claimed that particular guy, was not the guy that picked up my car. We immediately went inside and she notified her supervisor. Her supervisor, the owner of the towing service has this complaint on file. And no, I will not use my insurance company for something they did.

Final Business Response

The company that towed the vehicle, East Texas Recovery, went on record that the

customer was able to inspect the vehicle's condition prior to signing the release

paperwork. The release paperwork specifically states that the person signing was able

to inspect the vehicle. Anyone reading the document would be aware of the terms at the

time of signing.

Once again, we do not have sufficient evidence that East Texas Recovery caused the

damages presented in this claim.

Review: The subcontractor of your subcontractor refuses to give me their address. When they towed vehicle from drive, they went across yard rutting w/damages.

on approximately the 11th or 12th day of Nov. an order was called into the sheriffs dept. notifying them that B&S Recovery was picking up my sons car. The information they left with the department was #1 false and #2 misleading. They gave a number that was no longer in use by Primeritus Financial and a number of the tow truck driver that didn't tow the truck. When I called B&S and told them what the driver of the tow truck had done, and that I was sueing for damages, that I needed an address to where to send papers to. That is when they told me that it was another towing company from coldwater Mississippi called Donald Thomas Towing. I called the telephone number in which B&S gave me and They refused to give me any kind of address, hanging the phone up on me. #1 The Keys to the car were and are still in the side pocket on the drivers side of the door. They knew that. They were told on several occasions to come and pick the car up. He even told them that if they would tell him where to take it, he would gladly take it there and drop it off. He didn't want to see it damaged in any way. They refused and said they couldn't do that. I was there when he told them that. #2 All they had to do was knock on the door and I would have moved the truck out of the way in order for them to just drive the car out of the driveway. There was no need to drive the truck across my yard or drag the car across the yard 61 feet from one corner to the next rutting up my yard. I take pride in keeping my yard level and clean. I've had two open heart surgeries and don't need someone putting ruts in my yard. That makes it extra hard for me to keep my outside work done as I am disabled. Not only Did they give the sheriffs department the wrong information on who was towing the car, but they did not give the proper number as to where he could regain his items from the vehicle. He listed a Chris Humphries as the one that towed the car with telephone number (662)226-0366 when it fact it was Donald Thomas at (662)403-8904 lie #3 he said he was from B&S Recovery when in fact he was outsourced and working on his own. Somehow the key that was in the car that was in the side panel on the drivers door, disappeared between pickup and coldwater Mississippi or between coldwater and Grenada or wherever they last towed it to. What business my son had was betewwen you and him, but you came onto my property and damaged my yard, and now you want to pass the buck to everyone and no one wants to take responsibility for the damages. I had 61 ft of sd destroyed because of an irresponsible tow truck driver that didn't have common sense or the courtesy to come up and knock on my door and ask me if I would move the truck. That's all he had to do in this small town.Someone will definitely get the bill and WILL pay for the repair and or replacement of my yard that he willingly and malisciously destroyed.Desired Settlement: For one, I don't think you should use that person for any further towing jobs. He was rude, crude and hung the phone up on me for no reason. Two, he should have given the sheriffs department the correct information, instead giving them information that was false or no longer a working number for your institution. That tells me and them that someone is trying to hide the truth and deceive either the client, or the Police department. (in which they were notified of the descepencies that were given to them on purpose by your clients.) WHAT I WANT is for your company to reimburse me for the costs that its going to cost me to replace the 61 feet of sod 50 ft wide. I will be getting a quote as to what it is going to cost.Someone will get the bill including court costs if necessary.

Review: Primeritus was hired by my finance company to repossess my vehicle. My vehicle was improperly towed, resulting in engine failure.

My finance company [redacted] hired Primeritus to repossess my 2004 Mercury Mountaineer. Primeritus subcontracted the tow company. The all-wheel drive Mountaineer was towed Aug 1, 2013 with a wheel lift tow truck from the rear. I did surrender the key. He towed the SUV the length of a city block, took it off the lift, lifted the truck from the front, and crawled under the SUV for a significant amount of time before proceeding. I called my finance company & made necessary payments to have the vehicle released. Many phone calls & several hours later, the Mountaineer was DRIVEN back by the tow driver, not towed. I signed the papers after performing a visual inspection of the vehicle. The driver had the wrong paperwork - the papers he had me sign had someone else's name, information, and vehicle. He called his company & was told they could "cut & paste" my signature onto the correct paperwork. I was not given a receipt. Shortly after this, the engine broke. After consulting with my mechanic, we realized it was the manner in which the SUV was towed that caused this unusual damage to a vehicle with such low mileage. I called the finance company and [redacted] deferred our complaint to Primeritus.

I spoke with [redacted] at Primertus. She emailed me instructions on filing the claim; my statement and an estimate from a licensed mechanic were required and provided. Ms. [redacted] said an investigator would go and assess the damage to my vehicle but this was never done. The claim was denied without ever consulting with my mechanic or an inspection of the vehicle. I received no explanation of why the tow truck operator was driving the Mountaineer or why it was towed with the wrong type of tow truck.

Please note my claim number with Primeritus is JXXXXX. And the complaint number with [redacted] is XXXXX. Desired Settlement: I simply want my vehicle repaired. Per my mechanic, the Mountaineer requires a new or re-built engine.

To Whom It May Concern,

We reviewed all of the documents submitted by both the customer and the company

that towed the vehicle.

The company that towed the vehicle went on record that they only drove the vehicle 100

feet back to the customer after unloading it from their truck. The driver did not notice

any engine trouble at that time and the customer did not notice any trouble when they

inspected the vehicle. The customer did sign a release document which stated that they

carefully inspected the vehicle and accepted it back in the current condition. The copy

that we reviewed did not have any indication of being tampered with as stated.

We denied the claim on the basis that the damaged described was not noted by anyone

when the vehicle was received by the customer. We did let the customer know that we

are not an insurance company and that they also have the option of having their

insurance company look into the matter for them.
