I had a contract with Primo to repair my roof. The total was $10,615.08. The contract specifically states “3,700 to be paid by H/O”—we paid the $3700 timely, gave Primo an insurance check for $5380.09, and the salesman guaranteed that the remainder would be covered by a depreciation check from the insurance company. I made it clear that I did not want to pay more than $3700, which is why I made sure my liability was capped at that amount in the contract. The depreciation check was $1,242.46 less than Primo expected, and they are now demanding that I pay that amount, and threatening me with attorneys fees and interest. The contract clearly states that I was to pay $3700.

Primo went forward with the contract and the work knowing that was all I was going to pay. I understand the Primo did not receive the amount it expected to from the insurance company, but at the time Primo wrote the contract, they knew that the initial insurance check was for $5380.09—and agreed to cap our liability at $3700. By limiting our responsibility to $3700, Primo assumed the risk of a lesser than expected depreciation check. That assessment was based on Primo’s knowledge and understanding of the job and the industry—not on any promise or suggestion we made about the depreciation check, as we didn’t even know about such a thing before Primo told us about it. This being Primo’s business, they are certainly in a better position than we are to make that assessment.

The contract unequivocally states that $3700 is to be paid by the homeowner--I have paid that amount, and I paid it timely. Under the clear terms of the contract, I do not owe Primo any more money.

Please don't give them money upfront.
