My apologies for the unopened e-mails. Not sure where you sent them, but I am the President of the company and I am the one who has dealt with Mr***. Below are the facts in this instance
Mr*** contracted with One Step on 6/7/2012. I have signed agreements for applications of lawn care at $per visit plus tax, and visits of our tree care, visits @ $ per visit plus tax and visit at $ plus tax.
We performed the lawn visits on 6/11/12, 7/11/12, 8/9/12, 9/19/and 10/12/12. All have been paid except the last lawn visit done on 10/12/
We performed the tree visits on 6/18/12, 8/13/12, 10/19/12. All have been paid except the last tree visit done on 10/19/12.
Regarding the Aeration and Overseeding. We have an internal marketing campaign each season to promote the aeration and/or aeration and overseeding services to our existing customers. According to our records, one of our representatives did speak with Mr*** on 10/4/and discussed the aeration and overseeding service and the associated cost of $ plus tax, at which time, according to our records he verbally indicated he did want. We provided this service to him on 10/8/
Mrs*** called our office on 10/10/and wanted to discuss the price of the aeration and overseeding She was sure that he never would have agreed to that if he had known the cost. We checked with our sales person who remembered talking with her husband and confirmed that he indeed and wanted the service
We sent statements for the outstanding balance for the lawn visit, tree visit and aeration and overseeding visit, on 11/8/12, 12/13/12. I also sent statements on 1/18/13, 2/21/along with a hand written note asking them to call me if there were any questions.
Mr*** did call me on 2/22/13. He indicated to me that he thought the original price of $ was way too high and that he was never told that would be the cost. At that time, I did agree to give him a $ credit towards that service. This was acceptable to him. This brought his outstanding balance for all outstanding work down to $ 559.98. I sent him a statement and note at that time showing him the credit I had applied to his account.
On 3/21/I sent a statement again to him with a note asking him for payment as agreed.
On 4/9/I left a voice mail message asking him to give me a call about his account
On 4/23/I sent another statement with a note requesting a call about his account
Hearing nothing back, on 7/11/I sent him to *** Collection Agency, which is the agency we use for our collections
On 3/27/Mr*** called our office and was upset because he had received a collection/subpoena concerning his account. I called him back later that afternoon, and left a voice mail message asking him to call me back. I received a call from Mrs*** on 4/8/who was questioning the balance. I indicated that the attorney who was pursuing this account, was indeed aware of the $credit that I had agreed to with Mr***, and that they needed to contact the attorney directly to work out a payment arrangement
I received a notice from my collection agency on 8/4/indicating that a judgment was awarded to me in the amount of $including interest and fees.
I noticed that in all of our communication and even in the complaint he filed with you, Mr*** has never questioned the work we did or expressed any dissatisfaction with the results. His issue was strictly about the price for one particular serviceA price he felt was excessive. In an effort to maintain a good working relationship with our customers, and allowing for the fact that there may have been some misunderstanding with respect to the cost of the additional aeration and overseeding service, I originally agreed to give him a $credit towards that service. An agreement he was happy with at that time
He indicates that he has paid us over $which is indeed true. This was partial payment for service he agreed to in writing and which we provided to him.
I find it disheartening to say the least that Mr*** has chosen to pursue this matter in this way. In addition I deeply resent his implication that we are trying to take advantage of disabled vets. I have the utmost respect for those men and women who serve and have served our great nation in military service, and fail to see what significance this has in this matter
For over years, One Step has provided superior customer service to the residents in our local community We have grown to be the largest locally owned and operated lawn and tree service company in the area. This has not been by accident. It is due to the dedication of our staff to make sure we operate professionally and ethically each and every day.
