On September 24, 2017 subject came upon the private property of Edwards Theater located at E4th Street, Ontario, California. Upon arrival she exited the vehicle she was driving and got into a light color sedan which immediately left the property and went southbound on
Interstate 15.We were contacted by Capitol Protection which provides security services for the property and building. A request to impound said vehicle under 22658(a) CVC was made and the elapsed time per the code had been metPM on September 24, the owner of the vehicle returned to the area where she last left her vehicle unattended. The vehicle had been towed. she calls to find out information regarding the status of her vehicle609pm *** is wearing a blue shirt going through the Edwards theaters trash cans- foyer areaShe finds a receipt and gift card moves to the east side of the foyer then proceeds to guest services to talk with a Edwards cashier. 6:pm *** calls the tow company claiming she was at the movies and movie jumped but can understand why her car was towed. Requests to get her car releasedShe is advised it is after office hours and an additional fee of will be charged to send someone down to release the car. 730pm *** and a female friend show up at the tow yardreceipt and gift card in hand. Subsequently *** attempt to use fear and intimidation on our employee. *** didn't get her way so she calls the policeThe police arrived and she continued to make claims.*** is a trash picker who violated the parking rules at Edwards theater, she conspired with her female friend, made statements to activate 9-1-1, made statements to responding officers and is not the person who purchased the tickets that created the receipt in her hand. In addition the gift card she presented is not the same gift card used in the transaction. She has contacted NBC and several others. ***'s vehicle was impounded under 22658a CVC - No Commuter Parking For Priority One*** *** **

Our answer stands *** Found the receipt in the trashShe didn’t make that purchase She use that receipt as trickery are as fraud. We continued reserve the right to sue for tort damages punitive damages .California vehicle code a CVC was followed in the subjects vehicle was towed as to her name being incorrect I think we all know who were talking about

Priority One Towing & Recovery Inc.  915 Brooks Street Ontario, CA 91762       I have reviewed the filed documents in the above case and respond as follows:     1. We received a Call for Impound by Capitol Protection/Edwards Theaters for a vehicle that had...

parked on their parking lot and the occupants in the vehicle loaded up into another vehicle and left     the property.  The vehicle had been on the property for over 1 hr and the occupants had not returned.   2. Prior to being towed we verified all Perimeter signs were posted and accounted for.  All signs are compliant with 22658(a) CVC.    3. Vehicle was subsequently impounded and towed to a approved storage facility.  Priority One is a part of the state of California Tow Service Agreement, and therefore our rates are approved by the CHP.    3. Attached is a portion of 22658(a) that discusses rates:   (h) A towing company may impose a charge of not more than one-half of the regular towing charge for the towing of a vehicle at the request of the owner, the owner’s agent, or the person in lawful possession of the private property pursuant to this section if the owner of the vehicle or the vehicle owner’s agent returns to the vehicle after the vehicle is coupled to the tow truck by means of a regular hitch, coupling device, drawbar, portable dolly, or is lifted off the ground by means of a conventional trailer, and before it is removed from the private property. The regular towing charge may only be imposed after the vehicle has been removed from the property and is in transit. (i) (1) (A) A charge for towing or storage, or both, of a vehicle under this section is excessive if the charge exceeds the greater of the following: (i) That which would have been charged for that towing or storage, or both, made at the request of a law enforcement agency under an agreement between a towing company and the law enforcement agency that exercises primary jurisdiction in the city in which is located the private property from which the vehicle was, or was attempted to be, removed, or if the private property is not located within a city, then the law enforcement agency that exercises primary jurisdiction in the county in which the private property is located. (ii) That which would have been charged for that towing or storage, or both, under the rate approved for that towing operator by the Department of the California HighwayPatrol for the jurisdiction in which the private property is located and from which the vehicle was, or was attempted to be, removed. (B) A towing operator shall make available for inspection and copying his or her rate approved by the Department of the California Highway Patrol, if any, within 24 hours of a request without a warrant to law enforcement, the Attorney General, district attorney, or city attorney. (2) If a vehicle is released within 24 hours from the time the vehicle is brought into the storage facility, regardless of the calendar date, the storage charge shall be for only one day. Not more than one day’s storage charge may be required for a vehicle released the same day that it is stored. (3) If a request to release a vehicle is made and the appropriate fees are tendered and documentation establishing that the person requesting release is entitled to possession of the vehicle, or is the owner’s insurance representative, is presented within the initial 24 hours of storage, and the storage facility fails to comply with the request to release the vehicle or is not open for business during normal business hours, then only one day’s storage charge may be required to be paid until after the first business day. A business day is any day in which the lienholder is open for business to the public for at least eight hours. If a request is made more than 24 hours after the vehicle is placed in storage, charges may be imposed on a full calendar day basis for each day, or part thereof, that the vehicle is in storage.   4. Our company does have a Hardship application for registered owners, but in this case the registered owner allowed her car to be borrowed, the person who violated the law is not the registered owner, and the registered owner is not the person who paid the impound fees   Vehicle was impounded for Violation 22658(a) CVC in violation of NO Commuter Parking. I am rejecting this response because: I was not given notice not to park in the area and when greeted by the parking attendants, no one told me I was in a no parking zone or that I couldn't park where I was parked. The statements along with documentation sent to my credit card company shows the contradictions between the documentation, what [redacted] and [redacted] stated. They came up with this other information after I presented my evidence. when I spoke to [redacted], asking him with law, regulation, or code did he use to authorize the tow, he stated he didn't know but he should learn it. Mr. [redacted] also told me that he wasn't allowed to answer any questions and that he was to refer all questions to Priority One Towing and the attorney. Priority One's documentation had an incorrect address, incorrect time, and they withheld other information from me at the time of the towing that I was entitled to by law. This is the first time I have ever disputed a charge, and it has been extremely difficult and stressful, especially with receiving threatening calls from [redacted] on my personal cell phone. I reported the incident to the Ontario Police Dept last week and my credit card company. I was advised that [redacted] should not be calling me being that this case has been settled and I have documentation supporting that; and, that if the calls continue to make it a civil matter. I am a veteran and belief in democracy and fairness, even for the little guy..and I am proud of myself for standing up to a company that I felt and found took advantage of me and others. There should truly be an investigation into Capital Protection and Priority One Towing, because there are other reviews of the same thing happening at the Edwards Cinema in Ontario involving the same tow company. I hope the others follow through on their complaints and not get discouraged or bullied out of unfair and immoral business practices. I never demanded my car, [redacted] offered me a cheaper rate to come back the next day to pick my car up, as well as others that I am sure would be more than happy to tell their story. The letter from Priority One is full of untruths and aggressive in it's tone. I had my 4 young daughters with me with no where to go and no way to get there or home, I felt completely helpless and at the mercy of the tow company, not to mention afraid and belittled. My credit card company made a decision based on information from me and Priority One Towing and found my claim to be legitimate. Please give this serious consideration and reach out to some of the others from that night. I am thankful that I made notes of people and times that I talked to them as well as what I was told and researched the code and these companies for myself, and remained truthful throughtout...If Priority One will write such an inflammatory letter degrading me, imagine how I was treated in person and over the phone with no one to witness the encounter...WORSE!!! I can and will provide proof of the final say for my dispute if need be. I am afraid of this man, [redacted] and do not take his threats or calls lightly. It does not give [redacted] the right to continue to call me, because he is not happy or agree with the decision of my credit card company...there was an investigation and the evidence spoke for itself.
