I am in receipt of your SECOND complaint or answer regarding [redacted] Inspection report for [redacted] **Bristol Pa19001I have Contacted Bristol Borough requesting a copy of any ordinance they have adopted that requires a heater certification and the date they formally adopted itWhat is the legal definition of a "heater certification" as it applies to any formally adopted ordinance and what specific requirements a heater certification has for it to passTheir answer was that have not adopted any formal requirements for a heater certification as the property owner has claimedWITH THAT BEING SAID IT IS MY UNDERSTANDING THAT TO QUALIFY FOR A U&O THE HOME MUST HAVE A WORKING HEATER AND CHIMNEY.The property owner has made the claim that is heater was unsafeJC Heating has never said his heater was unsafe Only that in did not meet the current NFPA codes.If the property Owner would have had a obtain a building permit for the Chimney liner installation he performed in and had the building inspector, inspect the installation, the building inspector would have found the heat shield violationApparently no permit was obtain and the building inspector did not make any inspection of the chimney liner installation, making the chimney liner a illegal installation.The property owner has inquired why we did not mention any code Violation in 2012.As per NFPA Section RetroactivityDated - Unless otherwise specified, the provisions of this standard shall not apply to equipment or installation that existed Or were approved for construction or installation prior to the effective date of the standardWE would have no knowledge of what Code Standard was in effect at the time of installation as We have no knowledge when the heater or Chimney Was installed.The property Owner has made claims that his heater was unsafeWe never made any claims that his heater was unsafe and a fire hazard, the fact is after all the years of service his heater never had a heater fire points to the fact that it was safeOur inspection report dated August 23, states (we make no warranty of safety or function and none is implied).Please find enclosed a copy of our contract NoH.11034, Dated 7/31/signed by the property owner for a heater and chimney inspection, (not a Certification) it stated no liner in the chimney - must have linerReport to followAcceptance of work performedThe Property owner by his signature has acknowledge satisfactory completion of the above described work, (heater and chimney inspection).After the property owner installed his own chimney liner a Inspection report Dated August 23, was issued, copy enclosedThe inspection report (not a certification) was found acceptable to both the property owner and Bristol BoroughReporting requirement has change since and our inspection report indicates the current code violations.Again, I spent a lot of time explaining the current code requirements with the property owner and how to make the recommended upgrades, to meet today's Current codesThe following week afterwards he informed me, that he made the repairs and upgrades to correct the current Code violations that We recommended, himself for the Cost Of S100.00.Please Note: JC Heating has not verified if any repairs have been made.Section of the Mechanical Code requires the property owner who desires to install, alter, or repair any mechanical System, shall first make application to the code official and obtain the required permit for the work.Section Inspection and testingThe code official shall make a final inspection upon completion of the alteration or repair.2Mr [redacted] demanded that we change our November 9, report as he claims he cannot sell his houseWe are unwilling to falsify any report On his code Violations or conspire with him to deceive the locale township or any new home buyer.AgainIn Closing:Mr [redacted] has misstated the facts in his complaint to the Revdex.com, stating we certified his heater and chimney in when we did not, as you can see by the enclosed reports, we simply made a visual inspectionJC Heating never made any such statements that we certified the heater or chimney in the reports.Mr [redacted] has misstated the facts in his complaint to the Revdex.com that our reports stated the heater and chimney were up to the NFPA Codes, as you can see by the enclosed reports from 2012, JC Heating never made any such statement in the reports.Mr [redacted] is a Business Man and Landlord, as a Landlord it is his responsibility to do his due diligent and maintain a safe building for his rentersHis complaint is full of statements, is unfair and unjustI understand he is angry and looking to punish someone, JC Heating did nothing wrongHis complaint should be dismissed as without merit.If you have any questions, please feel free to call me anytime.Joseph C [redacted] President JC Heating

6/29/2017On or about March6, [redacted] request a chimney and heater inspections for his two mobile homesBensalem township where his mobile homes were located required a Level Two chimney inspections, in addition a heater inspectionsBoth mobile homes failed the inspectionsOur Service manger and I personally spoke with [redacted] explaining the reasons for the failures and our inspection report with pictures was mailed On March , I do not understand [redacted] complaint that his equipment was in good working order with the leaking - rusted chimneys and the building Code Violations that we found[redacted] claims that he had his heater inspected by Custom Air a locale heating and air conditioning company and they found both systems in good condition and no repairs were needed.I spoke with [redacted] of Bensalem Township, Department of Building and Planning about this matter [redacted] confirms that the inspection reports supplied by Custom Air are defective in that they do not address the chimney Certifications required by Bensalem TownshipI personally spoke to Custom Air service manager and he stated that Custom Air will not perform a chimney inspection as they are not qualified to inspect and certified chimneys.Please find enclosed a copy of a letter that I received from [redacted] Dated June 29, 2017, Stating the required and needed Use and Occupancy permits for the properties' in question has not been issued at this point due to the lack of the proper certifications.In closing JC Heating performed the inspections, (we have video and pictures to verify the inspections) I personally talked to [redacted] regarding our inspections, he was well aware of what we foundIn all due respect [redacted] claims are and his current inspection reports do not meet Bensalem Township requirements.If you have any questions, please feel free to call me any time.Sincerely,Joseph CPresident

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed as Answered] Complaint: [redacted] I am rejecting this response because: In Bristol Borough required a Chimney Certification and A Heating system Certification as the paper work I sent States The Code Violations JC Heating failed the heater and Chimney for in are the same Codes in the NFPA during 2012, when JC Heating passed the heater Again I asked JC Heating why the heater passed in without the Firematic Valve, heat shield, and emergency safety switchJC Heating stated the codes Have changed since The codes pertaining to the aforementioned were in place in Upon my researchJC Heating also stated the inspections were only to make sure the heater worked, If that is the case I was mistaking what Bristol Boro meant by certificationI have completed all necessary safety fixes inspection with other reputable companies who were curious as to why JC Heating Required only the chimney liner to be installed for safety in and not the Firematic valve, Heat shield, And Emergency shut off switchThe lesson I have learned about JC Heating Is priceless compared to the price of the inspectionJC Heating can keep the They charged for inspectionsThank God the home did not burn down between then and now due to the missing code violationsThank you, [redacted]

I am in receipt of your complaint regarding [redacted] Inspection report for [redacted] **Bristol Pa19007Please find enclosed a copy of our inspection report dated July 31, stating the heater and chimney did not passAfter repairs made to the property by the property owner, (he had installed a stainless chimney liner), The property owner was required to obtain a building permit and have the building code Official inspect the installationThe code violation as stated in our report and his complaint for the chimney is the result of his improper chimney liner installation, all it needed was a simple Sheat shield in order to meet codeA second inspection was performed by JC Heating on August 23, JC Heating provide an inspection report for the oil burner chimney and burner and controlsThis was an visual inspection report and not a Chimney Certification and or a Heater Certification or a inspection for code violationsThe oil tank system, oil lines and electrical system was not part of our inspection and are not mention in the reportWe only inspected the oil chimney and burner and controls for working operationAs per the enclosed copies of our inspection reports there is no mention that the Chimney or Heater were up to NFPA CodesBoth the home owner and Bristol Township accepted our reports without question.Please note: JC Heating did not install or make any repairs to the heating system or oil chimneyWhen this heater was installed or the oil chimney relined it was the property owner responsibility to obtain a building permit and have the heating system inspected by the locale authority having jurisdiction(township building inspector) to inspect the new heating system and chimney liner for proper installation and any code violationsJC Heating does not accept responsibility for a heating system or chimney that we did not install or repair or installations and repairs made by others.Locale Township inspection formats have changed (Bristol Townships as others now require notification of code violations) and Building Codes have change since and as of result of all these changes, when we inspected the home on November 9, our inspection report indicated the Code Violations as per NFPA Code Edition See enclosed inspection reportAgain JC Heating does not certify any heating system and or chimney, we only report what we observe in our visible inspectionAs noted in all of our inspection reports, they are not a certification or a certification of fire worthiness or safetyFurther our inspection report States this LETTER IS SUPPLIED ON FACE VALUE is not to be consider a warranty of any type, nor an inducement or recommendation to purchase any property.We performed an inspection was on 11/8/2016, a verbal report was given to the property owner on 11/9/and a written report was mailed to him on 11/9/and he personally pick up a copy of the report in our office on 11/10/as stated in his complaintJC Heating has not delayed the report in any manner as he misstated in the complaintOur report is Clear there are violations and the violations are not Our fault.I spent a lot of time explaining the code requirements with the property owner and how to make the proper repairsThe following week afterwards he informed me, that he made the repairs and upgrades to correct the violations that we recommended, himself for the cost of send a service man to a customer's home to inspect and prepare reportsThe property owner thinks we should provide upgrades and repairs to correct his violations for the installations that were not
