This job was a fiasco from the beginning. I took on this job as a favor to my life long friend, [redacted] [redacted](boyfriend to [redacted] [redacted]). We verbally agreed on the scope of work on January 28, 2016. I emailed a contract agreement and she wrote me a check for $5,000.00. That was a check...

that she stated was from a home equity loan that she had gotten for the repairs to the home. We proceeded to do a complete demolition of all areas that were to be worked on. During the demolition process, we uncovered numerous issues with the construction of the home. Issues ranged from, inadequate framing ( no headers over any door), to electrical shorts and screws through wiring, to multiple layers of sheetrock on almost every surface. All work done was done to uniform code requirements, even though the homeowner opted not to get the necessary permits required to do this project. The base cost of this project was at a dramatically reduced price due to my relationship with her boyfriend, however, at no time did I ever ask for additional money to compensate for all the additional work needed to correct the issues found. After she went to my tile supply store to choose her tile, I informed her of the cost and she once again agreed. I ordered the tile and paid for it in full. The flooring tile was a store stock item, but the backsplash tile was a special order material, and as such, non-returnable. Once the demo was complete, she issued me another check of $13,000.00. Now the rough work is nearly complete and she calls me to tell me that she had an emergency come up, and that she no longer will have the funds to complete the job. She requested to assume responsibility for several aspects of the project from that point. When I asked her about the home equity loan that she had gotten, her response was that it never came through. I continued to work on the project knowing that she would not have the funds to continue. It is my belief that the keys being left in the door was all a plan to try to accuse me of wrongdoing so that she could have an excuse to get out of the contract. Once she claimed that the keys were left in the door, and every light in the house was left on, and the basement door was left open, she confirmed to me that nothing appeared to be missing. I offered to install a lock box for the keys from that point forward. From the day she notified me of the keys being in the door, she would no longer answer her phone to speak to me. She would only communicate by text or an occasional email. I told her that she needed to actually speak with me to resolve this matter in a professional manner, and that the ongoing text messaging had to stop. I said in text that it was time to pick up the phone and discuss this matter like an adult, and her response to me was simply that "she couldn't". By that time, I new the business relationship was not going to be repaired, so I sent her an agreement to dissolve the contract. This was so that she could get her tile materials, and I could get all the tools and equipment that was still in her house(current replacement value of at least $3,500.00). I technically did not owe her the tile since it was purchased for a later portion of the job. After she refused to accept her tile and give me my tools we parted ways. That was on January 30, 2017. We have had zero contact or communication since that day. I returned the tile materials that were purchased for her job, and incurred a restocking fee of 20%, and could not return the backsplash material because it was a special order material. BTW, the reason she had given me for no longer having the money for the job was that she had breast cancer, and needed surgery that would not be covered by her insurance. Now due to her complaint, I see that she had the money all along.

I would like to first say his dates are wrong. Jan 28th 2016 we were not even talking of this job. When my father died in Sept. 2016 I was left with estate money. That was where the checks he was paid came from. He knew this. We had talked of me maybe getting a loan on the house however I never went with it due to having the money in the estate to cover the work. December we spoke and work was started mid December 2016. He was informed that the contract (which I never signed due to not being right) had things listed that were NOT to be done by him. He knew from the start I wanted to save money as much as I could and even said I would do some work to help with keeping the cost down. He never once said he ran into a problem with the home that needed extra money to cover. When the headers problem was addressed he said it was covered in the budget. He should of said it would cost extra money that was HIS choice to make and has nothing to do with the problem of his work being not 100% from the start. That is the problem. His work needed to be fixed almost every single thing he touched needed to be redone. I have photos, videos, and detailed bills explaining the work being done which he said he had already did and sent me a break down of what he "did". After paying the 13,000 I found the keys in my front door with my basement outside entrance open. He knew months before of the breast cancer finding. It was something I spoke to him and his wife about during the summer. I asked him to go over what was left to be done and asked him about stopping at the 13,000 mark and going over the rest to be done due to needing surgery. He agreed which was another VERBAL agreement. He not once would give me an answer however he kept working on the house saying it was okay. I told him I had about 5,000 left to cover whatever was left after the 18,000 he was paid already. He seems to forget that part. I had to split bills with my mother to cover the cost of fixing what he left me with NOT to finish it. My issue is having to fix his work. The work should have been done right from the start and it was not. Since he would not fix his mess nor pay me back for having to have others fix it. I believe court will end up being our only option to truly fix this. As for the tile I refused to accept the tile due to him not wanting to fix the siding me messed up while installing new doors. He then informed me he would be using the tile in his home since I paid for it already. So once he yelled in my face I wanted nothing else to do with him. He refused to fix his work I was forced to get someone else to do so.
