Complaint: *** In response to Pro Fence Builder:The first thing the complainant had an issue of was that they did not have the “good side of the fence.” I did ask why Chris decided to switch the fence around, as the ‘good side’ (for lack of better terms) was the side we had before and was the side of all the other fences around our yard, as we have NOTHING obstructing any construction on our side. Chris did not provide a reason. I advised that it didn’t really matter, as long as he then switched the other sides as well so they were the same.The reason for working on the weekends and into the later evening was due to the fact the project got set back due to delivery issuesMy crew and I were just simply trying to catch upThis was told to their adjoining neighbors why I was working the days and hours I was, which was fine. I was in touch with our neighbor while we were on vacation. We understood that there was some delay in starting. However, once we returned, Chris wasn’t working evenings or weekends in addition to regular daytime hours, he simply wasn’t working daytime hours. He showed up whenever and he refused to provide any kind of schedule, even when asked multiple times.The fence was “substantially complete” meaning structure was complete and usable, except for a few minor loose ends.” Minor loose ends do not include entire sections that are not stable, that have had to be replaced, because the 2xrails were not attached.I was never afforded the opportunity to correct the minor errors before the customer terminated contract. We did not terminate the contract, our neighbor did, on September 1st, after Chris finally refunded them the money he owed them for a fenceline that was cancelled. But because I hadn't fixed an issue or two immediately upon them pointing it out to me, this was deemed unacceptable to them. It was unacceptable to continue to build without correcting the structural problems.So I made a decision stop for the day and come back the following day. Any time anyone questioned Chris, asked for a timeline, or brought up any issue, he considered it being badgeredSuch as out of posts were not quite plum (straight up and down) so when I was done setting all the posts in that line, I went back and addressed the posts they had pointed out to me that were not plumBecause they had to be plum prior to me putting the fence upWhich they were, which I fixed. These posts were not fixed, they are still not plumb and need to be replaced. This is now complicated, as he continued to build the fence around the crooked posts.There was a section or of fence that was a little longer than feet, I only had 8ft 2x4’s at the time so I put them up and replaced them once the line was finished and I had went to my building materials supplier and purchased a few longer ones to fit the job requirement. There were sections that were NOT longer than ft, where the 2xrails were cut too short and were not sitting in the clips. These sections have since been rebuiltle that that's why the other neighbors had backed out. I have forwarded the business's response to all neighbors, they can follow up directly if they choose. I did not speak for any of them in my complaint, other than to state that neighbors canceled. To Chris's point, out of of the neighbors were unhappy and that isn't a great satisfaction rate.I got out of my vehicle because I did not want my son around that kind behavior around my son and asked him a couple questionsAfter that we parted ways, he walked away and I drove awayThat was the last time I was at the property. My husband walked over to find out what your plan was, since you up and left without providing any information on when you would be returning. He knocked on your vehicle window, at which point you got out and aggressively asked what his problem was, and who did he think he was. And then your wife or girlfriend was yelling and swearing at him from inside the vehicle. None of which is in my complaint.In my defense I was never allowed to finish or be able to do the walk through before the customer terminated our contract. Again, we did not terminate the contract.In reference to the statement “their neighbor asking me to not come back onto his property” was after I took him back his refund, several days after they relieved me of dutyThis neighbor notified us on 9/1, via text, that you had been back, refunded them, and been asked BY THEM not to returnThis was the last time we saw you But I guess not doing it on their timeline was an issue for themIt was ABSOLUTELY an issue that you wouldn’t even provide and/or adhere to a timelineI had explained to them in email the balance and broke it down showing where I had took money off and why. You sent a breakdown (on 10/20) AFTER I entered this complaint (on 10/13). In your email you stated that you personally hand delivered a final bill, however you have not replied to whom you hand delivered this to as we did not receive any bill. My company requested payment different times and provide them with a breakdown of the bill. I received email on 10/demanding payment, and then a breakdown on 10/after I asked for itThey did not reply with an answer to my question for a resolution. I emailed you back on 10/25, and then re-sent that email on 11/once I received notice from the Revdex.com that you stated you did not receive it. I copied the neighbors since you brought them into it. I still have received no response, except for from of the neighborsI do believe the threads emails alone will point out a completely different picture than the one the customer is painting. I have every email sent and received, texts from the neighbor who relieved you, and detailed photos of every section of fence.From: *** Sent: Wednesday, October 25, 11:AMTo: chris m***Subject: Re: FINAL ATTEMPT TO COLLECT OVERDUE PAYMENT Chris, To whom did you hand deliver a final bill? We have not seen you since you left on Friday, September 1st. I emailed you on 8/and afforded you the opportunity to complete this project by 5pm on 9/1. I also equested your detailed plans to rectify the issues that were brought to your attention multiple times. As we (and the ***) voiced on more than one occasion, it is completely unacceptable that you were continuing to build a fence when you were aware of structural issues (crooked posts and rails that were too short). I provided photos. Waiting until the end to ‘walk through’ and address issues was never acceptable and we advised you of that more than once. The last time we saw you was on Friday, September 1st. You did not finish by 5pm, you did not provide a detailed plan to finish as requested, and you never replied to my 9/email. As previously stated, we have lost confidence in your ability to either be here to complete this project or to rectify the issues that have been brought to your attention on multiple occasions. We resigned ourselves to cut our losses. We have already replaced complete sections and partial section. There is more to be done. We feel that the amount that was already paid is more than fair based on the quality of workmanship, incompleteness of work, and time to finish.

couple days agoWe’ve been going through the grieving process with the passing of a close family memberIn response to the complaints filed against my company, I will respond to each complaint the best I can in order as the customer statedThe company I had bought the fencing materials from had not delivered them on the day we agreed uponI waited a day and still no delivery cameUpon contacting this particular company, did have my order placed but had it set up for “will call.” I reminded the company that my order was suppose to be for delivery, they in turn assured me that they would have the materials delivered the following dayThe following day came and still no delivery was thereMeanwhile I was at the jobsite doing some extra work for of the customers (the neighbor of the complainant) moving a bunch of brush and leveling a portion of their yardWhen I went home later that day, the materials were sitting in my drivewaySo the company had got the addresses confused and delivered the product to my home and not the customersThis was days after the agreed upon date to startAnother issue with the timeline was that I had ran into a bit of a snag with extracting some of the concrete from the old fenceIt was much harder than because they were much bigger piecesThat pushed me back a day maybe twoTwo full sections of the fence were completed and the 3rd section in reference to between the complainant's house and an adjoining neighborUltimately I had only worked for days on the project when the complainant had arrived home on the 19th of AugustThe first thing the complainant they were on vacationSo the true start date for this project was the 14th Monday August 14thNonetheless in my contract it states clearly “that the time of start and end completion is ONLY a guesstimateThe project may take longer than the above service ending suggests.” My business was relieved of duty prior to the job being 100% completeCustomer had some issue in the esthetic value of their fenceOnce the structure was built and finishing touches were being added I contacted the customer letting them know that myself or a representative of my company would do a walk through with them and any issues they had at that time would be fixed immediatelyThis is called the “punch list items.” The customer had came to me 2-times on separate occasions about some imperfections in the fenceA few of which I was able to fix prior to being relieved from dutyI assured them that when we did the walk through, any issue they had I would change out right to what they wantedI told them it was there fence, they’re the ones who had to look at it and it should be built the way they wanted it builtThe fence was “substantially complete” meaning structure was complete and usable, except for a few minor loose ends.” At this point most contractors call for final payment with the hold back just for the “punch list items.” I was never afforded the opportunity to correct the minor errors particular section of the fence completed prior to tearing down another section was due to the fact that there was a young man, our son who is 16, working with us that day and he was not seasoned section we could move immediately onto anotherReferring to the complainant's statement “when we advised chris that we were unhappy with the fence quality chris got mad and left” No I didn't get mad, they made me uncomfortable as well as my crew bcuz of their constant badgering and talking to me through the other side of the fence as I have a skill saw in my hand and I'm trying to concentrate and be safeI left because it was about quitting time and I was uncomfortable with the situation and to be quite honest people don't do their best work when they feel like thatSo I made a decision stop for the day and come back the following dayThe statement “that I refused to fix” is falseAll I ever told them was that I would fix it, anything, and any problem they had with the fence at allI would fix it to their standardIt states that I refused to fix issues until I was finishedI did fix issues along the way, just not the moment they spoke of themI wasn't going to stop in middle of what I was within 30mins after our conversation fixed and took care of them allThat never occurred againI completely understand the fact they have small children, and yes I probably should've thought more carefully about where I stored my stuff and where I placed it, and I should of put a little more thought into placing the screws at the bottom of each postIn reference to the statement “their neighbor asking me to not come back onto his property” was after I took him back his refund, several days after they relieved me of dutyThe 1st neighbor that canceled was a neighbor that had done no work for yet and he was ultimately cancelling because he pried into my personal affairs and noticed that my home was going to be going up for foreclosureHe was concerned thatWell you know, quite frankly I'm not too sure why he was concernedHe was meddling into my affairs the 2nd or 3rd day I was thereHe was just a hard fella to please and get along withI was courteous and polite to this gentleman and he brought to light that he had dug into my personal life and he basically just backed outIf he backed out because of the fence being constructed poorly, he certainly did not portray that info to me or anyone on the premises that worked for my companyI never heard that from his mouth, not even in email, he never said itSo that is news to meThe 2nd neighbor who canceled, cancel after the fence was built primarily the same time that the neighbor canceledThey did this in conjunction to one anotherBut that was after the fence was builtThere is another neighbor in question who’s portion of the fence was completed entirelyThey paid me more than what they owed me (I'm assuming a small portion of it was a tip of some manner)They invited me into their home and spoke with me about the fence and they were pleased with the job I didI had brought them up to speed on what their neighbor had done with me as far as relieve my company of dutyThey were a bit surprised by that and did not see any issue with the fence at allThey also told me that the complainant tried to get them to like jump on the bandwagon with them and not pay me because they were unhappySo in a nutshell the complainant tried to convince their neighbors to not pay what they owe when their fence was completed and they were just fine with itI'm on the fence with what to do about thatIt's not right and people shouldn't be treated that way or coerced to do something they don't want to doIt's very possible that that's why the other neighbors had backed outThe last day I was at job site prior to them terminating contract was simply because they were badgering me through the other side of the fence as I was making some cuts up on the finishing line endUltimately was approached by the husband who came to my vehicle aggressively prior to me leaving with raised voice, condescending me, and pushing his head into my vehicle as he was speaking to meI got out of my vehicle because I did not want my son around that kind behavior around my son and asked him a couple questionsAfter that we parted ways, he walked away and I drove awayThat was the last time I was at the propertyIn my defense I was never allowed to finish or be able to do the walk through before the customer terminated our contractI had assured them numerous times on different occasions that I would fix anything at all that was wrongBut I guess not doing it on their timeline was an issue for themI'm only looking for compensation for the time and labor spent on this jobThe fence was substantially complete and I deserve to be paid for my time and effortI have negotiated my fees with my secretary just out of courtesy alone in hopes to be compensated something and we dropped a few hundred dollars off the billAlso in the reference to customer's statement “we don't know what balance he is requesting” again that's falseI had explained to them in email the balance and broke it down showing where I had took money off and whyMy company requested payment different times and provide them with a breakdown of the billI have also tried to find a resolution with them by asking them if they did not agree with the amount due to then email But that was after the fence was built. There is another neighbor in question who’s portion of the fence was completed entirely. They paid me more than what they owed me (I'm assuming a small portion of it was a tip of some manner). They invited me into their home and spoke with me about the fence and they were pleased with the job I did. I had brought them up to speed on what their neighbor had done with me as far as relieve my company of duty. They were a bit surprised by that and did not see any issue with the fence at all. They also told me that the complainant tried to get them to like jump on the bandwagon with them and not pay me because they were unhappy. So in a nutshell the complainant tried to convince their neighbors to not pay what they owe when their fence was completed and they were just fine with it. I'm on the fence with what to do about that. It's not right and people shouldn't be treated that way or coerced to do something they don't want to do. It's very possible that that's why the other 2 neighbors had backed out. The last day I was at job site prior to them terminating contract was simply because they were badgering me through the other side of the fence as I was making some cuts up on the finishing line end. Ultimately was approached by the husband who came to my vehicle aggressively prior to me leaving with raised voice, condescending me, and pushing his head into my vehicle as he was speaking to me. I got out of my vehicle because I did not want my son around that kind behavior around my son and asked him a couple questions. After that we parted ways, he walked away and I drove away. That was the last time I was at the property. In my defense I was never allowed to finish or be able to do the walk through before the customer terminated our contract. I had assured them numerous times on different occasions that I would fix anything at all that was wrong. But I guess not doing it on their timeline was an issue for them. I'm only looking for compensation for the time and labor spent on this job. The fence was substantially complete and I deserve to be paid for my time and effort. I have negotiated my fees with my secretary just out of courtesy alone in hopes to be compensated something and we dropped a few hundred dollars off the bill. Also in the reference to customer's statement “we don't know what balance he is requesting” again that's false. I had explained to them in email the balance and broke it down showing where I had took money off and why. My company requested payment 3 different times and provide them with a breakdown of the bill. I have also tried to find a resolution with them by asking them if they did not agree with the amount due to then email me back with what they thought would be a fair price in their opinion. They did not reply with an answer to my question for a resolution. I do believe the threads emails alone will point out a completely different picture than the one the customer is painting.
