Joined gym under false pretenses with vague, ambiguous, grammatically incorrect contract. The contract is at odds with owner's forceful requests.I signed up with Pro Fitness 24/7 in September of 2015, I signed a contract that stated one thing, which the owner confirmed at the time. It appeared to state that if I moved back to Pennsylvania I would be allowed out of the contract. The owner [redacted] knew I may be moving again soon but assured me this was okay as long as I provided some form of documentation. The contract requests "mortgage, lease and utility bill" as being requirements but when questioned about why someone would rent a house that they have a mortgage on he claimed these were optionalone or the other. I was never asked to provide proof of residency in North Carolina (I would not have been able to for much the same reasons as I cannot provide residency in PA). But because he assured me that I would be fine, I signed the contract. Typographic errors in contracts happen, afterall and the oral agreement he described sounded acceptable, but that is not the agreement I am being held to. The contract changes at [redacted]'s whims and after two months of dealing with the coercion, I stopped attending the gym. The contract's vague, often-contradictory statements provide a lot of wiggle-room for [redacted] to tell a customer whatever they want to hear.This cancellation of service coincided with the time I moved back to Pennsylvania. Unable to find work in PA, I travel frequently between PA and NC (where I currently have a job that schedules me in blocks to accommodate my situation). I stay with friends while in North Carolina and I am bunking with family in PA. As I do not own the house nor am I the leaseholder, and I do not pay any bills thanks to the grace of others, I cannot provide this form of documentation. I have asked [redacted] on multiple occasions what other forms of documentation would be acceptable, to which he gives incoherent replies that are inconsistent with the written contract and vary based on his whims.[redacted] has contacted my place of employment on multiple occasions, even when asked not to; even on days that he speaks to me, he will call my place of work to see if I am there. At this point, the frequency of contact is frightening me and the magnitude of the threats are moreso. It has degenerated to belligerent name-calling, incoherent statements, and even threats of small-claims courts. I know I have done nothing wrong here except being misled, but I know that the document I signed is not commensurate with the claims [redacted] is making against me. To treat a customer in this way shows a complete lack of customer service and a penchant towards sadism. Any business owner who treats his customers in this manner does not deserve to own their business.Desired SettlementI had given [redacted] notice on multiple occasions that I would be moving back to Pennsylvania. The first in November, and in December I moved. I have paid for the months that I did use but do not wish to pay for the months that I was misled into contracting for. The contract itself is an ambiguous mess and not at all what was explained to me by [redacted] himself. Any latent errors in a contractual draft are typically found to be the fault of the contract drafter, who is, in this case, [redacted] and I ask that I be held accountable only for the services rendered which have been paid in full. An apology for Mr. [redacted] behavior would be appreciated but not expected.

The following business has made mistakes withdrawing money, acted in an unprofessional manner with customer, a much more. The following company Pro Fitness 24 has made my fiance and I very uneasy for awhile now. First red flag that was brought up was on month when the monthly withdraw was suppose to come out on the 15th of the month, it came out twice. When contacting the owner about the situation he did not seem too worried with the problem and it took weeks to return my money. Secondly, some of the equipment in the facility did not work properly or was damaged. Also the owner was the only employee in the business so when my fiance and I had a question or complaint there was no one there to tell because the owner was only their 3 hours or so of each day. After these signs my fiance wanted to buyout of her contract and go to a different facility. I went in to talk to the owner and he explained to me and I quote, "This is a business and I am not going to take any loss that I do not have to.". After asking him how one would get out if they moved out of town he replied "They would have to pay me $100 to buyout and then show me proof that they moved out of [redacted] county.". So I also offered to pay the same thing for my spouse and he refused. After a heated and confused back and forth conversation, I finally left the building. The owner of this gym did all of this personal business out in the open in front of other members. My fiance and I do not feel comfortable with this man and his business having access to our finances.Desired SettlementI want nothing to do with this business and do not want to contribute any more money to this man. I do not want any contact from them or affiliation.Business Response This is nothing more than a member not wanting to pay their bills and being an adult about the situation. They signed up for a 12 month agreement and contract. A contract is a binding document that the consumer agrees to pay to the company for the term on contract. [redacted] was very aware of the contract and knew there was no by out fee and only way to cancel the agreement was when you hit the term of length agreed up which was 12 months. This is very sad that society will go to this extreme to try to embarrass the company. My attorney is aware of the situation and we are considering filing slander charges in court. Business is business and should never be taking personal which is what happen here. Consumer Response Slander is defined as making FALSE and damaging statements about someone. Everything I stated in my complaint was truthful. I did not make up any information and I am able to provide evidence and have witnesses to support my claims.

Owner used undue pressure to make me sign a contract for services he knew I could not physically or mentally use.July 2013 I had been released from the hospital and tried to resume training with Mr. [redacted]. It was very difficult and my care takers insisted I quit going. Despite this Mr. [redacted] pressured me to sign a six-month contract.I am suffering from [redacted] which has kept me emotionally unable to return to the gym. This type of activity would be detrimental to my health. I am willing to negotiate a settlement. I'm in the relationship business. I enjoy helping people and have a passion to do so! This claim is 120% FALSE! Because of my limited means I am asking Mr. [redacted] to accept a lump sum payment of $1,000.00 and in return he will consider the closedthe contract will be cancelled and all further collection activity will cease.
