site visit, I provided a cost estimate of a rental house for Ms*** *** and her husbandI informed Ms. *** that I would apply plastic primer to the front and right side of the house before painting because of its weathered sidingsI suggested she hire another company to install mesh filters on top of all the gutters to minimize thefrequency of gutter clogging in the future because this house is surrounded by many trees. I did not offer to install the mesh myselfShe is one of my repeat customers; therefore, I provided a suggestion to her to prevent potential damage to the downspoutAs we talked, she asked that I do touch up work and mentioned about a few minor marks on the interior wall of the houseI then offered her to touch up those marks as a favor with the understanding that she had some left over paint from the previous paintingSo, the $3,cost estimate for painting the exterior of Ms***’s rental house includes: power washing, plastic primer for the front and right sides of the rental house, spot primer on all the bare woods, and one coat of paint for all sidings of the houseThe few touch-ups for the interior wall were, again, to be done as a favor After power washing, the sidings of the house revealed their weathered and torn conditionsThe damage was not apparent during the initial estimate, or I would have included the second coat in the initial estimateI called Ms*** and informed her that it would be beneficial for the house if all the sidings would be painted an additional coat, as this will provide a better coverage and protection to the sidings and would also last longerShe asked of the added cost, and I told her that it would be $1,and she could decide whichever way she wanted to proceedShe was under no obligation to have a second coat applied.Because Ms*** did not tell me to proceed with a second coat for the house, I completed the painting work for her rental house on August 25, 2015, by applying plastic primer on the front and right side of the house, spot primer on all the bare woods, and painting one coat accordance to the cost proposalBefore the touch up work, I color-tested a spot on the interior wall, but the color of the provided paint did not matchDuring my touch up work, the tenant’s son, who is a college student, informed me that he previously workedfor a painting companyBefore I went to the paint store to purchase for a matching paint color, he also told me that no one would be home by the time I got back with the paint. I then offered the college student to do the minor (less than an hour) touch up work for $and he agreed Because I promised Ms*** that I would do the touch up work for her, I purchased a matching paint color without charging herWhen I returned, I left the paint at the front of the house and left. Later in the day, I informed Ms*** of this happening. She was upset and complained that she wanted me to do the work instead. Because I promised her that I would do the touch up work, I agreed to return back to Ms***’s rental house to finish up the touch up workHowever, I needed the tenant’s phone number in order to set up a date and time when they are home. But, Ms*** refused to provide their phone number to me for reasons that I do not knowTherefore, I could not complete the touch up work, which was a favor for Ms*** in the first place.Resolution: 1) I need a date and time that fits in both the tenant’s schedule and my work schedule so that I can access the interior of Ms. ***’s rental house to finish the touch up work 2) Because I suggested Ms*** to hire a specialist company to install the mesh filters on all the gutters, I am willing to clean the gutters for free. 3) Since I finished applying plastic primer to the front and right side of the rental house, spot primer on all the bare woods, and painted one coat to the entire house, according to the original cost proposal, I request Ms*** to fulfill her payment of $3,

Complaint: ***I am rejecting this response because:There are quite a few discrepancies in Ky’s response:1. Site visit was July 11, at 8pm and not August 2015. Ky gave me the verbal estimate in person and said he would send me the proposal after he went home and had dinner with his wife that evening I didn’t hear back from Ky again until almost a month later when he called me on 8/wanting to power wash the house within the next hourI continued to ask for the estimate but did not receive this estimate until 8/24/emaildated 10:14pm (see attachment with the proposal date Ky included for the estimate) after he had finished painting the house. Neither my husband nor I have even signed the proposal yet since these were not the terms we agreed upon.2. I never asked for the interior touchups to be done as a “favor”In fact I continued to ask Ky for a separate estimate for the interior touchups since there were quite a few in all of the rooms and my tenant that moved out was willing to pay for it. He insisted on doing it at no cost. He was the one that I had hired to do the interior painting years ago and he asked to see the paint to make sure that it was still good to use. He checked and said it would be fine. Later on he said it wasn’t the correct shade.3. Ky said he was including the mesh to cover the gutters and said that he doesn’t do it himself, but has a contractor that wouldbe doing that part. I hired a professional roof/gutter cleaner on 7/23/in preparation for Ky’s contractors to install the gutter covering.4. I was appalled when my tenant contacted me to let me know that Ky approached his teenage son when they were not at home andoffered $to do the interior painting She thought it was very inappropriate and unprofessional and wanted me to know. I called Ky to express mydisapproval and he confessed to hiring the minor to do the work for him. I asked him when it would be done and if he would be inspecting the work and Ky asked me for his phone numberI told Ky I don’t know the son so wouldn’t have his number. Ky said he would contact the son himself since he only lives a fewminutes away from the house.5. Please also note the Pro Painters Incproposal (attachment in Ky’s response) even has a section termed “Additional Coat: There is a possibility an additional coat will be needed to ensure proper coverage to the entire house” This was never discussed as a possibility during the estimate and is left blank in the proposal. Ky called me after he started the job and said “you are going to think I am scamming you, but I think your whole house needs coats of paint or you will end up having to repaint again in a couple of years and end up paying more” There are also no “questionable areas” as indicated on the proposal.Problems:1. Providing an estimate verbal and not giving a written proposal until AFTER the paint job was completed2. Hiring a teenager with undocumented experience without consulting customer and parents of the minor 3. Giving an inaccurate estimate of what the final cost would be given the condition of the house 4. Not providing mesh gutter covering that was added into the cost of initial estimateResolutionGive a credit of $for not completing the mesh cover for the gutters and the interior touchups as promised bringing down the total cost to $2,900.Sincerely,*** ***

Complaint: ***I am rejecting this response because:Verbal estimate given on 7/11/and written one wasn't presented until after the job was finished on 8/24/ If this was given at the proper time, there wouldn't be any confusion of what the job expectations arePer any other professional company, an estimate is given prior to when the job is started and possibility of additional coat is given prior to power washing as that is the whole point of having an estimateThe specialist that Ky was going to get in touch with me was for someone that specialized in chimney work and I have yet to get that recommendation.I appreciate the credit of $plus tax but that would not be sufficient to cover the interior painting/mesh gutter covering (estimated at $500) I am willing to bring down my request for a deduction from $to $plus tax.Sincerely,*** ***
