On September 9th of we entered in a contract with the owners listed in this complaint for construction of a 24x
post building with complete finished and interior and concreteThe owner was acting as their own general contractor hiring the all the mechanical and excavation contractorsThe excavation and water line was done in early December The weather turned for the worse so it was agreed that we would start construction as soon as the weather improvedWe returned in early March to start construction on this post frame buildingDuring the first step of construction the owner had hired an electrician who was there installing the entrance line in the new building and our workers helped them locate the line in the proper placeConstruction continued on the building and the outside shell of the building was completed on or about April 1st At that point the building was ready to have the concrete floor to be installed The owner had hired a plumber to install a floor drain and mop sink and he installed the drain lines We installed the concrete in mid April and then went back and completed the project shortly after that and the owner paid for this building in early MayAs sales manager I did not know there was any problem until weeks after completion I talked with the owner and he explained his problem to meI told him I would discuss with our salesman to see if we could help him resolve the issueThe main concern at the time was that the entrance door would hit this water line at about degrees Even though we did not have anything to do with the location of this line I did offer to change the swing of the door so it would no longer hit the lineThe owner rejected this solution and wanted the line moved After receiving a letter from the owner I decided that it was time that I made a job site visit and I made an appointment with the owner to discuss a solution to his problemI did look at water line and I noticed that someone had installed a drain line against the wall for a sink and hooked the waterline to the sink Whoever installed the drain line for the sink should have moved the water line to the same location I was at the site for 1/hours and the owner did not show upI called twice and left messages but did not get a response About one hour later I received a phone call from the owners wife who told me that her husband got tied up in a meeting I informed them that after I saw the drain line installed they should contact their plumber and ask them why they did not move the line nearer to the drain line They did not like this answer and threated to sue us
The bottom line is that we had no control over their plumbing or electric contractors It was not part of our contract, we did not have any drawings of the plumbing layout, in fact, our company did not know there was a sink or floor drain in the building There was no way that I want our employees to move a water line that our customer had installed with being told to do so by the customer (which is what the owner thought should have happened)We regret this problem occurred and I feel that we have dealt with this problem with fairness However, the customer has threatened me with a lawsuit, and has said will bad mouth us around the area This approach did not set well with me so we have decided to end all contact with this customer

There are some points that Mike ***, of Burns Construction, has made in his response that are inaccurate He indicates that the plumber was to be responsible for relocating the water line when he installed the drain and mop sink and then they installed the concrete First of all, the sink could not possibly be installed prior to the concrete floor While the plumber did install the drain, our representative from Burns Construction, Dave Simpson, said he, and his team, would make sure the water line was moved to the wall prior to the concrete being poured He took responsibility, he did not tell me to have the plumber do it, HE TOOK RESPONSIBILITY by giving me his word! When Mr*** states "Even though we did not have anything to do with the location of the line", that is a boldface lie based on what I was told by MrSimpson! When Mr*** states that "our company did not know there was a sink and floor drain in the building" that is also Both items were discussed with Mr*** who in fact asked us if we would be installing a drain Mike says in his letter that "Whoever installed the sink should have moved the water line to the same location" he has admitted guilt because the sink was not installed until after the concrete floor at which point the water line had been encased in concrete foot away from the wall The first response to my complaint was that they could reverse the door hinge or relocate the waterline I chose relocation of the water line because reversing the door still leaves a pipe sticking up three feet from the wall and in a location that could easily be tripped over when entering the buildingAlso, Mike has misrepresented the truth when he states that I said I would "bad mouth us (***) around the area" That is not true I did say that I would tell about my experience with Burns Construction, if he interprets that as "bad mouthing", then that is his interpretation based on what he knows of the situationHe also states that I have threatened to sue them, and I would like to point out that I said I would pursue this in small claims court but that was only done after waiting patiently on them for months to respond on how they planned to "resolve the issue" And finally, the minute wait that Mr*** complains about when they came to visit was really only a minute wait because our location is in the Central Time zone and they arrived an hour early due to confusion over the time difference I work at a bank and did get tied up in a meeting but had my wife call Mr*** to let him know that as soon as I couldI see that Mr*** time is much more valuable than mine because a minute wait caused by me is a big issue but several weeks/months wait for him to respond should not be an issue to me The bottom line is whether they intend to live up to their promises as made by their representative, Mr*** As customers, we do not have the experience to know exactly how everything should be done but as a business in this profession, they should I followed MrSimpson's directions by having the water line placed far enough into the site so that when the walls were built it would be inside the building(At that time the worksite consisted of a built up sand base where the building was to be built with no way of knowing exactly where the walls would be.) MrSimpson gave us his word that he would make sure that the water line would be pulled back to the wall once the wall was completed and before the concrete was poured He did not tell me that this would be up to the plumber, HE SAID HE WOULD TAKE CARE OF IT! In my opinion this is 100% on him and therefore on the company he represents! Therefore I am not willing to accept their response as a solution or even as an accurate statement of the situation
