I have attached the gps data proving the car was towed after 11:pmThis is the second time I have provided the documentation that the car was towed after 11:pm, this is the timestamped info proving our locationThe consumer also has proven they were not in the park which indicates violation another that allows for towing at any time so they were in volation of two rules for parking in that lot

All properties we tow from have signs posted in accordance with the Ohio revised code for private property towingVehicles are towed in accordance with the agreements we have with property owners and managersProperty owners have a responsibility to keep clean and neat propertiesInoperable
vehicles without tags in most cases are against local ordinances which could put the property owner in risk for fines or sanctionsIf a vehicle is in violation with the rules a property owner or manager has set forth it will be towedThis vehicle obviously appeared abandoned and was towed for this reason

I recieved word from the OSU Public Safety office that the video surveillance footage from the night of this incident is now available. I will pick it up middle of next week.I'm told the footage is on a CD. Would it be easier for me to mail/submit the CD to the Revdex.com or sent it to you electronically?  Please let me know the best channel through which to share the footage.

No fees will be refunded, we have a contractual obligation to make sure violators are not parking in the lot. We must clear the lot at the times prescribed in case the maintenance or management staff needs to lock the lot up at night for insured access for crews or special events the following day....

The driver made a courtesy offer to you to take you to an atm which he is not required to do. I have attached the gps logs that shows he hooked your car up at 11:01 pm and was still in the lot exiting at 11:05 pm which contradicts your story, the fact is the parking lot is for park users and closes at 11:00 pm for everyone and had you been in the park and planning to exit by 11:00 pm, you would have been able to do so before you were towed.

Please understand that if you were at the location while the tow truck was there you could have moved the car before he towed but obviously you were not which also means you can not testify to the sign being present when the car was towed.

Are you not reading my complaints at all. I lived in the complex and was there everyday so yes I can testify to the sign being present. I also moved the car to where your driver specifically told me to move it a lil prior to towing it. I don't understand where your confusion is coming from. All I am getting back from you is excuses that I have already made clear wasn't the case with this situation. I moved my vehicle to the front of the complex that had already been paved at the direction of your driver. My apartment was in the back of the complex facing away from parking lot and vehicle could not be seen from my building at all due to paving. It deeply concerns me that your going back to things I have already addressed. The issue at hand is the parking lot was being paved and your driver directed me to park the vehicle where I parked it. Then upon going in my apartment it was towed shortly after. Again I parked where directed by your employee, was never given any warning, there wasn't proper signage in which I have photos and videos with time and date stamp on them which is way better than any testimony and my vehicle was illegally towed because I made a complaint on your drivers hostility and unprofessional. Please stop trying to justify something that was clearly wrong and let's move forward and make this right and close this claim. It's not going to kill your business to rectify one wrong tow out of the 100 tows you did there that day.

I am rejecting this response because:The business response is exactly the type of response I requested the day I spoke to the manager.  I wanted written documentation, but none was provided at that time other than a copy of a GPS location.  None of the times provided now by the business response were given to me at that time, except for 11:42 pm pick-up of my vehicle, according to a copy of the driver's ticket# [redacted].  I believe the manager of this business should research this matter further.  As I stated before, the copy of the GPS I was provided gives a time for the business vehicle, but none regarding my own vehicle.  In addition, the same line highlighted by the business in the print-out under 'GPS valid' is the only one that indicates NO for valid.  I was at the park before 11:07 pm or even 11:04 pm, as indicated in the response, and at that time the entire parking lot was already completely empty.  It does not seem reasonable that the business driver could have picked up my vehicle and others around that location, as mentioned by the business manager before, by the times being provided.

I can assure you that your car was not towed with any wheels on the ground that were under any type of braking such as a parking brake as it is unsafe to do so. We have the equipment on our trucks such as dollies to ensure that no damage is done to the vehicle being towed. Your car was towed because...

it was in violation of the parking rules established by the Department of Parks and Recreation that are clearly stated on the signs at every entrance to the property. Our policy to only accept cash on these types of transactions is to decrease the chances of fraud. Our customer in this instance is the Department of Parks and Recreation and we are providing them with a service to ensure that park users have a place to park on site and that maintenance crews can do their job. Many times the access points from the parking lot to the bike path are blocked so users must find another way in or maintenance crews can not get their machinery through, during an emergency on the trail fire, ems or police may also need to enter the path as well, this would be like someone pulling in your driveway and blocking your car in so you could not move your own car from your driveway. Are you denying that you were not in violation of any of the park rules stated on the signs? If so, I need to have your license plate number so that I can pull the file and explain to you why your vehicle was towed. Photographs are not required under this contract and we are under no obligation to share any internal documents to car owners. Please understand that parking rules at the park are in place to ensure that park users are as safe as possible.

This lot is not posted in accordance with the orc as there is not a sign at the west entrance nor can any sign be seen from there. Also if you read the original complaint I had a confrontation with the driver while asking him where I could move the vehicle because of the paving that was going on. I believe this was a way of attacking me or getting even with me for the complaint I made on him. He was very aware that the vehicle was not abandoned and was going to be picked up at a later time by someone that was purchasing it. The vehicle had not set for a period of time and was towed within an hour of me moving it and making the complaint. There is no local ordinance stating anything about this situation and there was no warning given to correct the problem which would of been the professional thing to do. This tow was unlawful and without the proper signage a private tow away zone has not been established. The driver could of even told me I needed to remove it from the property when asked where I could park it to avoid being towed but instead told me to park it in the spot that he later towed it from. This has caused me a major inconvenience and should have never happened. Please return my vehicle so we can end it at this step and not be forced to take it any further or make a big deal out of it. I do have both pictures and videos of the west entrance not having signage and recording of the phone call where I made the complaint before my vehicle was towed where I was promised my vehicle would not be messed with. This driver was in the wrong clearly and not someone I would want to represent my company.

I do apologize for your car being towed but you must understand that we have a contractual obligation to tow cars that do not have a visible valid  expiration sticker. Usually people remove old stickers or place new ones over the old ones in the lower right hand corner. The driver did make a...

mistake and was written up for the issue. You must also understand that almost no one who encounters towing companies is in a good mood whether it is a voluntary tow or not which requires employees to be stern. I believe we can both agree that both parties in this case could have done more to avoid the situation.  I can assure you that this will not happen again and I suggest you remove all old registration stickers and place the new one in the lower right hand corner to avoid any confusion.

I have attached screenshots from the gps data from the truck that towed this vehicle proving that before 11:00 pm the truck was on the west side of Columbus, he was exiting 315 nb to go east on lane towards the park at 11:00:27 pm, he stopped at the park at 11:04:44 pm, he exited the park at...

11:08:44 PM heading towards our yard and reported the car as towed to CPD at 11:42 PM. The gps data proves that this car was not towed prior to 11:00 PM and we will not be providing any refund for the services. Thanks,Jimmy
