Complaint: [redacted] I am rejecting this response because:I agree that I did sign stating that Florida sales tax was not included However, Mr [redacted] told me that sales tax was included which should have been Mississippi sales tax This would have nulled and voided the Florida sales tax.In regards to the rail dust, your Auto Butler machine would not have removed any rail dust A process using special chemicals and a clay bar is the only way to remove it.Regards, [redacted]

We only collect Mississippi sales tax only if the vehicle is registered in the State of MsWouldn't make sense to collect MS "AND" FL tax on any customerNobody wants to pay double taxesI'm sorry we missed the rail dust on the truckWe could have polished it again while it was here or shortly thereafter

I am rejecting this response because: I have all documentation and will send to the owner where ** repeatedly told me there were no mechanical issues with the truckOn a legal note, it constitutes as fraud (consumer bureau) when a vehicle is purchased "as-is" but the vehicle has been grossly misrepresented.

The oil change repair order is an internal (Dealership not customer) repairWe did the oil change before we sold the truckThe oil change was not charged to the customerRegarding taking off the battery cables to try to clear any lights this not an uncommon practice; sometimes it works, sometimes it doesn'tThe truck was sold & marketed as being sold as is without a warrantyI will get with ** *** regarding working a deal to trade in

I'm really sorry that I cannot satisfy your situationYou were given the opportunity to review the documents before signing themNo taxes for either state were collectedYou acknowledged & knowingly signed that FL taxes were not included.Regarding the rail dust, again I'm willing to polish the truck.We really appreciate your business & feel that were not fraudulent in any manner. I am rejecting this response because: the paperwork was rushed through to me and not explained. There are protections for consumers  regarding lemon laws. When I brought the vehicle in to be repaired, I did not request or was notified that the oil was changed . As a matter of fact, this is the first I've heard of an oil change. A mechanic did tell me that the battery had been disconnected in an effort to clear the warning lights.. I have all  correspondence saved in the form of text messages regarding why the truck was returned to be repaired. I also have pictures of the lights that were on the truck 2 days after purchase. These pictures were sent to [redacted] via text, and I have saved that. I also saved the diagnostic reports and sent those to brose. I've kept very good records of this vehicle. As this is my first time purchasing a vehicle, I believe this dealership took advantage of me being a single mom and not being knowledgeable of procedures. I even called a manager as recently as last week to see if they would trade the truck in on another vehicle. I was told he would check into it. Never received a call back.

The vehicle is a 2009 Nissan Murano, It was bought as it, however when I bought it on Saturday evening it was late and near closing time at dealership. I told salesman I wanted my dad to look at it really before I purchased it. The sales manager [redacted] told me thta wasn't a problem if I went...

on and bought it, he would give me until 12 PM Monday 02/27/2017 to return it if I wasn't completly satisfied or if there was a problem with it. That was fine, so I paid cash for it and left, dealership. between 20 and 30 miles down the road is when the vehicle started acting up. When you stop and take off it would jerk and jump like frontend was about to come out of it. I finally got it home about 40 miles or so from Corinth. My dad drove it the next day and it was doing same way. So first thing on Monday we took it back and about 1/2 mile before we got there it quit pulling. We had to stop in a parking lot, put it in park and cut engine off, set for a minute and restart, dad had to keep backing up and going foward until it finally went to doing fairly ok again and we got to dealership at 10AM. After talking with Mr. [redacted] for a minute and telling him the story he seem like that wouldn't be any problem getting our money back. He said [redacted] the salesman would be there in a few minutes. When Mr. [redacted] came in you could see the expression of angry on his face and when we told him the issue, he PLAINLY stated it's yours, we talked back and forth for about a minute and he was as rude as anyone had ever talked to us. After a few minutes we spoke with him and [redacted] Stabfill again and at this time they took us in an office where [redacted] had totally changed his mind about a refund and same as called me a liar when I told him he told me I could bring it back by 12 if there was a problem or unsatisfied with it. If only they had acted desent towards us and not so rude and offered to have someone check it to see if they could fix it and if not at least offer a trade of something of equal value or our oney back, but they had their mind set on not doing anything at all. After the obscene jesture from [redacted] during the road test, he could be arrested for sexual harrastment whether he knows that or not. And Brose can be sued for allowing that to happen and not letting a woman go with us on the test drive instead of just me and this man I don't know and it getting dark. After he touched my leg and I moved his hand I believed that stopped him from advancing and I also believe this is the sole reason they are treating me the way they are about returning the vehicle. I've even called back 3 times to speak with Mr. [redacted] and he refuses to talk to me or return my calls. Always an excuse. When Mr [redacted], Mr [redacted], Mr [redacted], and the Brose Autoplex are served with papers and arrest warrants from attorney and police for numerous charges they will wish then they had acted diffrent and tried to work something out and applogized for actions of their employee. [redacted].

find enclosed a copy of the
bill of sale. Located in the center, Mr. [redacted] clearly signed acknowledging
that the “sale does not include any Florida sales tax”. Honestly, I’m not sure
it can be made much clearer than that. Why would a person sign that if they
didn’t agree to that?Concerning the “rail dust”, we performed the Auto Butler
polishing when the truck arrived at our dealership. If Mr. [redacted] wants to
bring the truck to dealership I will gladly run it through the Auto Butler polisher
once again at no charge to him. Our Dealership has been in the new car business since
1977. We are family owned and operated, and on any given day one will most
likely find a member of the Brose family here at our Dealership. We pride

I am rejecting this response because:
I wasn't implying that I should have had to pay double taxes.  [redacted] (the salesperson) told me that tax was included in the deal.  Florida Statute Reads:  Section 212.06(7), F.S., allows a credit to be given on tangible personal property brought into Florida where a like tax has been lawfully imposed and paid in another state. If the amount paid is equal to or greater than the amount imposed by Florida, no additional tax is due.The truck should have never left the lot with the rail dust on it.  Like I said earlier, a simple wax job will not suffice.  It takes special chemicals and a clay bar to remove it.Regards,

apologize for the delayed response as I had recentlychanged my email address. Regarding Mr. [redacted], I spoke to him today via telephone abouthis 2002 Jeep. We finally got the part in and installed it on his Jeep.According to Mr. [redacted], he is happy with the part that was installed on hisJeep. He was however, upset that it took our Dealership quite a while to locatethe part. Sometimes, on older vehicles it may take longer than usual to find asuitable part. We finally did. Again, aside from the length of time to get thepart, Mr. [redacted] confirmed to me that he is happy with the part. After speakingwith Mr. [redacted] today, I consider this complaint resolved. Our Dealership has been in the new car business since1977.
