I have reached out to *** via voicemail, text and email. He has not responded regarding our refund request on the kit we have not used. We want a full refund immediately and to return the kit. It is fraudulent to sell this device to licensed estheticians in the state of Texas. Pls see my email below in further detail.I have posted on ProCells Facebook page to get in contact with the correct resource to resolve. Interestingly enough, my post was deleted within 15 minutes.Hello - I have been trying to reach *** who works as a Procell market trainer and sales rep. He sold me the ProCell kit last year. I am a licensed esthetician and day spa owner in Texas. We have not used the device as yet. I informed him that we want a full refund as per the State of Tx Medical Board, we are not able to legally use this device unless the actual person using it has a MD or NP license. I informed *** of this and have yet to get a response from him on giving us a full refund. We are prepared to send back the unused box kit right away. I have sent email, text, left vm. We will move forward towards a legal lawsuit if we do not get our refund and our attorney will seek a class action law suit for fraud and endangerment. They really need to provide refunds to estheticians in the state of Texas as they are knowingly and illegally selling a device to unlicensed users. Not to mention the endangerment to potential clients in unlicensed hands. We are not going to play games and chase people. We do know how to get their attention for scamming us. I will keep everyone posted. Look for our post on Revdex.com as well and with the Texas Medical Board.
Just heard back from my atty after I told him about our phone call. We will not be involved in reselling the Procell device in order to get a refund. We want no parts in a deceptive act. We tried to reasonably request a refund. We are going to simply move forward wconsumer fraud, deceptive practices and seek restitution for damages b/c we relied on false deceptive informa

ProCell Therapies has reached out twice to the Texas Department of Licencing and Registration since this complaint and gotten the same answer both times: As regulations differ by state and are continuously changing, it is the responsibility of the practitioner to know their regulations in their area and not offer procedures that are not within their scope of practice. In this case this sale happened a trade show outside the state of Texas. We provide a 90-day money back guarantee so that practitioners can make sure that they are able to effectively market and see the results of the treatments as well. We have never had a situation like this arise before as this client didn't contact us with this concern until almost a full year after the purchase date of March 31st, 2019, and additionally the client specially requested longer lengths tip attachments while every other kit sold at the show contained only 0.25mm lengths, which is our standard.

Regardless, to resolve the situation ProCell honored this client's request for a refund. Attached are screenshots of the email correspondence with the client and of the original sale,as well as a copy of the transaction receipt of the $1,003.72 refund check to the client.

I am rejecting this response because: *** and I have traded emails, as well as *** and ***. We do have a plan in place to resolve this matter. The ball is in their court to fulfill their promise of a refund. As soon as I have received the refund and the check has cleared, then I will fulfill my final act regarding the plan we have in place. I do want to correct a couple of things in their response - 1. Their salesperson, ***, sold me the kit and suggested the 1mm and 1.5mm needles. I knew nothing about what the device they were selling would do except for the pics they have on the website showing the results they posted. The sale was made when they were doing a trade show in Vegas. I am located in Texas. *** reached out to me to purchase the kit right away to take advantage of the show promotion and to close out as many sales as he is required to do. He had spoken with us a couple of times and we were in the process of evaluating the device, etc.. He understood we were a 'results oriented' day spa with our treatments and promise to our clients. He convinced us that if we moved forward with the sale and get the longer needles, we most definitely would achieve the immediate results we are known for, from the ProCell device.

2. Any company, its' board members and founders/owners, has an obligation to inform potential clients of any risk and laws surrounding the purchase of their products. This is their responsibility. Companies and their representatives are trusted by consumers to be honest, transparent and not put any of their customers at risk - directly nor indirectly. ProCell sells via two sales channels - Physicians and Non-Physicians. This tells anyone that they understand to some degree their is a difference in the type of tools that should be sold to either channel audience.

Fortunately, we did not use the device, was never trained on the use of the device and took the time to do our investigation and homework to be properly insured and in compliant with the Texas Medical Board regulatory policies.

I will update this posting as soon as the refund has been followed through. The latest email from them states I should receive the check by March 16, 2020. I will keep you posted and then complete my action response based on the plan for resolution that we currently have in place.
