February 26, 2017Dear *** *** ***:Thank you very much for keeping this case open I am sorry for the delay in my response; your email went into my “Spam” folder My wife and I reviewed Mike H***’s reply to the complaint filed with your office As MrH*** noted in his reply, there are different sides to every story however, the facts are the facts I would like to reiterate the facts so that the record is clear:It is a FACT that there was a major problem with the engine in the car on the day we purchased the car This is undisputed The need for a MAJOR ENGINE REPAIR was confirmed by MrH***’s Certified *** Mechanic, Jason G*** MrG*** was sent from Pennsylvania to Connecticut (by MrH***) to conduct a review of the car within a few days after our purchase We did not know there was a major repair needed on the engine at the time of purchase This is undisputedWe had the car inspected and we were NOT informed of this major engine repair that was needed (see below for more details).We did not cause the damage to the engine This is undisputed by all partiesThis was confirmed and verified by two experts including MrH***’s certified *** Mechanic (see below for more details)The estimated cost of the repair that is needed is between $13,and $25, This is undisputed by all parties I have a copy of the estimate from New Country ***, Greenwich, Connecticut which is approximately $25,MrH***’s mechanic offered to perform the repair for $13, After MrH***’s Certified *** Mechanic agreed and confirmed that the car needed a major engine repair, MrH*** offered to help pay for the repairs MrH*** told us he would give us only $3,toward the repair as that represented his “profit” on the sale We agreed to drive to Pennsylvania to pick up a $3,check towards the repairs Then on January 10, he refused to give us the check for the $3, It is unclear if MrH*** is disputing this offerSince our purchase, the car engine has not been repaired and no payment has been made towards the repairs This is undisputed by all partiesIn addition to the facts stated above, listed below is some additional information about our claim/complaint As explained above in number 2, prior to our purchase of car we had the car inspected by Warrington *** of PA Clearly this inspector “MISSED” the fact that the engine needs a major repair We think that the inspector also has some responsibility in this matter I will be asking your office to file a complaint against Warrington *** of PA as well In the meantime, we have already contacted *** North America who is conducting an “Internal Investigation” with Warrington *** of PA to find out how they “MISSED” the major engine problem Warrington *** claims it did a proper inspectionAlso, it is important to note as stated above in number 3, that we did not cause the problem with the engine MrH***’s Certified *** Mechanic MrG*** and Rafael A*** of New Country *** in Greenwich, Connecticut both verified that cylinder scoring has occurred in cylinder #4,#and # #being the worst (we have a picture of the scored #cylinder taken from Greenwich ***) Also, both MrG*** and MrA*** agreed that the problem with the engine has been going on for “Some Time” and that the scoring doesn’t “happen over night” Both mechanics/experts used their *** Certified Diagnostic Equipment and found no “OVER REVS” , no “RED LINES” or any other type of “ABUSE” under our mile drive home from Pennsylvania and the mileage we put on the car bringing back and fourth to dealerships and various mechanics to get estimates for repairs.As we have continued to struggle with the purchase of this car and its repair we have done more background research on the car Our research and review that was discovered first in the *** was one maintenance/service record on 10/07/looked very odd to us At the time of this service the car had 41,milesWe called the mechanic that performed the service, New Country *** of Clifton Park NyWe spoke to Jake the service manager Jake remembered the car vividlyHe remembered the color the model and when it was in for serviceJake was very helpful he offered to check the notes that the mechanic madeThe notes showed that “ONE SINGLE PARK PLUG” was causing a fault which caused a check engine lightThe plug was found to be completely “Fouled”It just so happens that both MrG*** (MrH***s Mechanic) and MrA*** (the *** Mechanic at New Country ***) noted that “ONE SINGLE SPARK PLUG” in the car was “Completely Fouled.” It’s the SPARK PLUG in ”Cylinder #6.” The fouled plug is a result of the cylinder scoring which causes the smoking we noticed our first day of ownershipWe don’t think it’s a coincidence instead this supports that finding that this car had a major engine problem before we purchased itHow does Warrington *** missed this during a thorough and proper PPI?Additionally, we have a video of the car running which we recorded 10/15/a week before our purchase and before the inspection from Warrington *** of PA The “NOISE” although faint is clearly present I sent MrH*** a copy of the video after gathering information to present to your officeWe have never received a “response” from him to discuss the videoWe are happy to provide anyone with any of the emails, videos, pictures or notes we have This further indicates that there was a problem with the engine before we bought itMrH*** in his response to our complaint noted that we “changed our minds” We DID NOT change our minds We purchased the car and wanted the car and we have not retuned the car or asked for a refund However, we have asked and we expect that MrH***, the seller of the car, provide us the car in working condition without the need for a very expensive engine repair needed which was NEVER disclosed to us We asked MrH*** to repair the car to the condition that was promised at purchase This repair is needed AND was confirmed and verified by MrH***’s own expert.In the end we believe that there are workable solutions to our complaint The one solution that was offered in late December by MrH*** ($3,toward the repair) was never paid and thus, we assume it has been withdrawn Nevertheless it does show that MrH*** understands and agrees that the car needs to be repaired Our request is and always has been simple - repair the major condition in the engine This could be done by MrH***’s Certified *** Mechanic MrG*** or this could be done by Rafael A*** of New Country *** in Greenwich Connecticut or another certified *** mechanic Any repair should be paid for by MrH*** In the alternative, we are ready and willing to listen to another FAIR SOLUTION We are very anxious to have the car fixed and to close this matter Finally, MrH*** noted in his reply to our complaint that he “wanted to maintain his outstanding reputation in business.” This can be achieved! MrH*** should resolve this matter fairly and he should pay for the car to be repaired We are ready and willing to resolve this matter We are also willing to listen to another suggested solution We are the consumers and we deserve to be treated fairly That is good business and that is the right thing to do in this and all matters and that will preserve his “reputation in business” Thank you and your office for reviewing the details of this complaintSincerely *** and *** ***

Thank you for your letter dated Jan 11th 2017.As you already know, there are always two sides to a storyThe buyer has conveniently left out several important facts to the complaint.Before addressing the facts, let the record reflect the following, 1- No one at this company has been Stringing the
buyer along as he has stated 2- We have been in constant communication with the buyer to help him reach a resolution(see emails) We even sent our specialist out to confirm said issueNo one pulled a "fast one" on the buyer as he has expressedThere is an issue that arose how, when and why is yet to be determined as the buyer's experts at *** Greenwich and our *** specialist, who is *** factory trained, both agree until the motor is opened up and the internals are looked at, it is impossible to factual say what occurred4- The last conversation with the buyer we were in agreement on working to find a replacement *** and we were going to sell the *** at the auctionWe were then going to bury the losses into *** saleBoth parties thought this would be best outcome on a lousy situationWe also negotiated for buyer a wholesale rate with our Specialist to have the motor rebuiltCost was an estimate of 11k to 13kFacts of the case.1- Buyer agreed to purchase *** from seller in late Oct pending a Pre purchaseinspection from the Franchised dealer *** *** (**) Seller took car to **.2- Upon *** inspection the only issues found were a faulty tire pressure monitor and the carneeded tiresBuyer and seller consummated the sale on 10-22-Buyer never mentioned to anyone there was a motor noise and only complained approx a few weeks later to the Sales person about excessive Smoke coming from the tailpipe (nothing on motor noise)3- if the selling dealer and the factory *** dealer didn't detect any internal motor noise andthe buyer never asked anybody here or at ** about a concern on a motor noise, then the logical conclusion is the issue must have occurred after the sale There was an additional 570plus miles from sale to inspection at buyer's *** dealership in GreenwichWe do have all correspondence from buyer to confirm he never once complained of a motor noiseThere is nothing that we knew or could have known was wrongThere were and are no check engine lights on or any noises that would lead us or the franchised dealer to Suspect an issue of this natureOur specialist's assumption is a piston ring or piston broke but until the internals of the motors are inspected, its all Speculation.4- This is an unfortunate and unforeseeable incident that has occurred after vehicle left hereThe buyer had a Pre purchase inspection done at the Franchised *** dealer and signed an bill of saleWe feel horrible for the client and have worked hard to come up with a workable solution so as not only help out the buyer but also to maintain our outstanding reputation in the business5- The buyer has promised legal action so at this time, we are advised by our legal counsel to ceasecommunication with the buyerWe appreciate your attempt to mediate this complaint however; we offered the buyer two workable solutions that he first agreed to then changed his mind (see#on first paragraph)At this point, we are still willing to offer the buyer the options outlined in #of first paragraphWe are confident that there is nothing we knew or could have known was about to go wrong with this carWe just don't do business that way!!Mike H***ProfA Mike H***www.pro-auto.com
