I purchased a DEAL from [redacted]'s List in September of 2014. The deal was a bathroom remodel from Tub Guru for $5999.They were very deceptive .The company was not honest regarding the cost. It morethan doubled. The bathtub I ordered was not installed.Instead, a inferior brand was substituted. The price forInstallation of a fan was quoted as $3200. The tile on the floor and surrounding the tub was to be included in the original price($5999). The bathroom is very small (6 ft 6 inches X 5 ft).I wanted to have the bottom of two walls tiled at my expense. The small area was quoted at an additional $1800. I feel this quote may have been for the entire bathroom . If this is the case, they would be charging twice for the same job. They were unable to obtain permits, so the remodel has been stalled for months. [redacted], the owner, came to my home to sign a contract. He asked me to signed with my finger on several lines on a phone. I could not review the contract and he did not have a copy of the contract. It was not until several days later that I saw the contract on line. I originally thought it was [redacted]'s List contract. When I reviewed this contract, there was an additional $900. added to the contract, and I would not be reimbursed for the items I purchased. The contract I purchased from A.L. stated that $1000. of the purchase price was for tub, sink, tiles faucet, etc. I bought all the items for the remodel except for the the tub (this tub is sitting on my deck as I had this one removed and the tub I originally ordered installed by a different contractor). I called Tub Guru and informed them that I did not want to continue with the remodel. They also stated at one point that they did not want to continue either. I offered $1000.00 plus I would pay for theTub and asked them to return the remaining amount to me. I was under the impression that [redacted]'s List gave them $1000 up front and the remainder would not be paid until the job was completed. The arbitrator at A. L. informed me that Tub Guru has already received full payment. As it stands now, Tub Guru has offered to come back and complete the job. I dot not want to accept this resolution as I have lost all confidence. According to A.L., because the company did start the job, they are entitled to full payment regardless of dishonesty, quality of work or apparently any reason. They have decided to label the complaint as unresolved and Tub Guru apparently gets to keep the entire amount. [redacted]'s List is not very helpful. They stated that they do not decide right or wrong and are not liable as they only advertise on their web site. They took my money and gave it to Tub Guru so I feel they should hold some responsibility. I have also requested copies of all e-mails and the exact day full payment was made to Tub Guru. They have not replied yet. I feel taken by both companies.Desired SettlementI entered the deal with Tub Guru with full confidence they would complete the remodel as stated on [redacted]'s List. From the beginning, problems started to arise from permits, wrong bathtub installation, cost climbing to almost double, not being honest with me and endless delays. At this point, I would like to pay Tub Guru for the work they did (partial demolition of bath-room, installation of wrong tub and plumbing to tub.The remaining money should be returned to me. I have offered $1000 for work done, I would pay $175. for the wrong tub and $125. for the installation of a faucet which was doneseparately. I thought this was fair as I am the injured party. I have never had dealings with a contractor before and I think my inexperience came through. This whole experiencehas been a lesson to not be so trusting.Business Response We are familiar with this customer's concerns. We have been through extensive attempts to work with this customer to no avail. We were engaged in this project fully. The customer pulled the permits to save money and her township refused to deal with her. Additionally, she was told she didn't need a permit for the project only for the plumbing inspector, whom we pulled a plumbing permit with, demand that the project be re-permitted. We went through all the changes, including custom glass installation beyond the original scope as well as the new code requirements the township demanded. After she agreed to the changes and the costs she stopped work on the job stating to us and [redacted]'s List (where we were just listed the recipients of the 2015 Super Service Award) that she had no real son to not have us come back, she just stated that she wanted to renege on the contract and offered us 1/4 of what we had spent on the job in return. We ademently refused to stop work as she couldn't provide us with a single reason why we were not returning. This homeowner doesn't wants what she wants but thinks it should be free. We invested thousands of dollars in meetings, estimates, contracts, changes, phone calls and labor only to have this customer turn around and decide that her responsibilities in the contract are negotiable while she defames us online and lectures us about responsibility. During the project it became clear that a retired neighbor in the trades started to be an influence on her and caused this customer to lose faith in us. We are a full service company. We provide more than just the labor. We handle scheduling, ordering, delivers, added insurances and expert input and advice. We still have an offer to return and complete the work as per our legally binding contract and she has refused. [redacted]'s List also found that she was not entitled to a refund. We are not pursuing damages on our end because the amounts we received from this customer barely covered our costs to dateConsumer Response (The consumer indicated he/she DID NOT accept the response from the business.)I do not want to do any business with Tub Guru. They are aware of my position but continued to offer to return knowing fully that I have found another company that I can fully trust. It is all a sham. There are so many reasons for dismissing them:(1) Tub guru altered the contract from [redacted]'s List by adding on $900.00 for plumbing. I have no idea why this amount was added. (2). [redacted]'s List contract stated that $1000. was for fixtures, tub, toilet, faucets, etc. I purchased these items my-self. Tub Guru decided that I would not be reimbursed for any items. The total so far is $6000 for A.L. Contract plus the $1900. he added without my knowledge. (3) The way he had me sign his contract. He asked me to sign blank lines on his cell phone with my finger. I originally thought it was [redacted]'s List contract. I was unable to view the contract until several days later on the computer. If he were a reputable businessman, he would have brought a written copy and explained it to me line by line. I still don't see the reason for two contracts. (4) Two months had passed and minimal work had been done on the project. (5) I did not suggest that I would go to the building inspector to get the permits. I have no knowledge of plumbing and electricity and would be completely out of my element. He asked me personally to pick them up. They were pleasant but insisted the Christohper come to the office himself and gave me building requests for him to sign. I don't think he ever went to the office as all of his dealings were conducted on the phone. (6). [redacted] has stated that the township of Waltham refuses to deal with me any more. This is an outrageous statement. They have always been courteous and respectful to me. They have offered to assist me with my complaint against Tub Guru. I believe if there is any animosity felt, it is strictly between [redacted] and the inspectors. (7) I requested to have an additional area tiled. The bathroom is very small and the extra area is 4 ft X 4 ft and another section measuring 2ft X 4ft. [redacted] stated that it would cost $1800. to have this small area tiled. The reason for such a high price was that the border was special glass and difficult to install. This border and tile can be bought at any Home Depot and does not require an "expert". I feel the price I was quoted is for tiling the whole bathroom. Under [redacted]'s. List contract, the floor and tub surround were to be installed by Tub Guru.If that is the case, T. G. Is being paid twice for the same job. Also, a fan needed to be installed in the ceiling. Tub guru quoted me a price of $3200. I had the fan installed recently with all permits by licensed worker for $600. Quite a difference in price! Also, there was a statement made by [redacted], ("This homeowner doesn't want what she wants but thinks it should be free). I really don't know what to say. All I wanted was honesty and not to feel that I "taken" advantage of by this company.Tub Guru has stated that [redacted]'s List found that I was not entitled to a refund. As of today, we are still in arbitration. They do not give refunds for "Deals". Their policy is very one sided. All they can do is try to arbitrate. Tub Guru has received my money from A. L. and feels they are entitled to the whole sum ($6000.00). T. G. has stated "They spent thousands of dollars in meetings, estimates, contracts, changes, phone calls and labor". This is so totally outrageous. They were at my home one and a half days andInstalled the wrong bathtub. I had this tub removed as it was inferior and had the right one installed by another company. The other tub is on my deck if Tub Guru wants it back. They seemed to have inflated their expenses 1000 percent. This is exactly the way they did business with me.If you need any thing to validate my complaint against Tub Guru, please let me know. Thanks for your help,[redacted].Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)Tub Guru did not go through the contract line by line with me.He did not have a copy of the contract with him. All he had was his cell phone and asked me to sign on blank lines with my finger. The extra $900. for plumbing has never been explained to me. Also, the entire amount for purchase of the toilet, tub, sink, faucets, etc was eliminated. I purchased all the items except the original tub. The Deal with [redacted]'s Liststated that $1000. was to be reimbursed to me. He gutted A.L. Contract and added $1900 to his price with no explanation to me. He did inform me of the additional charge of $1800 for a small area in the bathroom I wanted to tile. This charge was for installation only. The tiled area was for a smallBorder of glass with white tile underneath. The area was extremely small and not complex. The other area that he explained to me was the fan.. His estimate was as follows:Demolish the ceiling - $650Labor for electrical work - $850Labor for vent - $560CSL - $559Permit fees - $244Moisture sensitive fan and light - $425Total - $3288.00Tub Guru is now stating that the $3200. is for rewiring my entire bathroom. This is the first time I heard of rewiring. The city inspector and the electrician I hired to install the fan at$600. not $3200 never mentioned any rewiring. He is probably trying to cover himself for such a high estimate.I hope he has a good memory because he seems to be making a lot of allegations that can easily be proven as false. The list of charges for the fan above does not mention any rewiring. He states that my ignorance and unwillingness hindered his ability to complete the job. It does show my "ignorance" asI did as I was requested by [redacted]. I would never voluntarily inject myself into any phase of remodeling the bathroom. I followed his request to pick up a permit. The only reason they did not want to deal with me was that they wanted [redacted] to personally come into the Building deptHe never did. He was at my home on several occasions and he could have easily stopped by the office. He seems to want to blame me for somehow interfering with his "navigating the system and performing his duties". What is the big deal? I was in and out of the Building Dept in less than five minutes. The Inspectors have offered assistance to me in dealing with Tub Guru because I might need help in verifying what I have stated regarding the permits. They have no liability and are just trying to be helpful. He also stated that remodeling a bathroom in his area is $20,000 and I am looking for a "Craig's List price. He was the one who offered $6,000 for a remodel.Did he plan to charge me more once I signed the contract with A.L. They have a name for this type of business dealing.I did not walk away from the contract without notice. I spoke with the office manager (Scott) several times and expressed my concerns. [redacted] never called me to discuss the dismissal. As far as his allegations that I have turned to the Internet to slander and defame him, I have not written anything negative on the internet. My only communications have been with A.L.Arbitration Dept. I have not written my official complaint that would be seen by everyone on AL. I decided to communicate with Revdex.com because A.L. does not do refunds on the "Deals".Apparently, they gave my money to T.G. and have a policyof not letting the customer know anything regarding when he was actually paid in full. [redacted] seems to think I am a sad lady who is ignorant and does not know any better. He called my statements frivolous and hearsay. Demeaning me does not work. His interpertation on my "frivolous complaints" are not frivolous to me. He doesn't seem to realize the seriousness of the complaints. Once you lose your reputation for not being honest, it is serious.Tub Guru only worked 1 1/2 days on the project. I entered the contract with T. G. In Sept. of 2014 and by November nothing had been started. I did not interfere with any part of the remodeling . What could I have possibly done to make himInsinuate that I was a hindrance to his navigation of the system.I am not a sad ignorant lady who is trying to feign "victim" as [redacted] as stated. I feel that am a honest person and not easily intimidated. The facts are as I have stated. He also mentioned a bribe that was requested. This incident happened over 30 years ago. I was eligible for a low cost remodeling loan from HUD. We were next in line and some obstacles were suddenly put in the way. The secretary said that she would be willing to help us move forward. She stated that people were giving her gifts for helping them. I felt immediately uncomfortable and did not want to do business under those conditions. We dropped the loan. This was a long time ago and those employees were eventually dismissed. This has no reflection on the present employees of the Building Dept.Final Business Response We categorically deny the claims [redacted] is making. We went over the contract for more than 45 minutes at her kitchen table and she signed on a tablet, not a cell phone. The document was emailed to her and we confirmed she received it while I was there. It was then uploaded to her acct on Builder Trend. For a person as sharp as Ms. [redacted], does it make sense that she would sign a 9 page contract with initials in all the right places without reading it or reviewing it? There is even a section right above and below her signature attesting that she has read the contract in full in bold, large type. We also comply with consumer fraud laws that explain the right for a person to rescind their decision within three days in the same bold, large type.We explained the $900 plumbing upcharge in detail and explained that it would take the place of that amount from the allowance. Thereby, we owed her $100 against her final bill if the monies were not consumed in materials covered by the allowance at the end. She is lying about her calls to the office "to express her concerns" we keep a daily log on acts inside our company and our logs reflect the work we were doing to comply with the township and their permit requests as they became obstructive to us. The reason the town placed a stop work order was because our licensed plumber pulled and paid for a permit in compliance with the laws of the commonwealth. We received a call the last day of work expressing that she did not want us returning. There was no opportunity to address the issues. In fact, the last time I spoke with her a week previous she told me "I know how much leg work your office is doing to try and deal with the township, thank you. I don't think many people would put this much effort in." Unless that was a lie or Ms. [redacted] is going to say I am lying again. I resent being called a liar. I have an formal education in Ethics and have a top rated company. This customer's story has changed over time to reflect new issues. The documents from AL will prove her inconsistencies and unwillingness to let us return. We have followed the law regarding fraud and exceeded it requirements at every turn. Ms. [redacted] didn't want to pay the bill and decided to create a story to back out of a contract she is obligated to execute.Even the AL intervention team stated that "she could not provide a concern or a reason for dismissing you other than saying that she was not willing to let you return". This is a breach of our contract and at every stage we have done nothing but try to complete the contract she agreed to. We even offered her a $500 discount and it wasn't enough.Ms. [redacted] did defame our company on AL and then left an "F" rating on our profile. She later removed her comments but the rating remains. She is also lying about the pricing. As per her last comment we proposed removing the ceiling, running the vent fan combo with an automated fan and wiring it to code. Not all of those components are included in her $650 electrical bill.Additionally, her allegations only prove our claims about her interference and attempts to intercede. She is trying to challenge the legitimacy of our work by trying to show she could do it cheaper, that is the very definition of interceding, in case that isn't obvious. She shows that she doesn't understand that we are contracting service that coordinates and organizes; our services are above and beyond the direct cost of labor. Her entire claim is that "she got it cheaper". This shouldn't be a surprise. If you reduce the scope, reduce the quality and then act as the general contractor, yes it will inherently be less expensive. We spend $10,000 a week to have a fully functioning professional team of administrators, coordinators and tradesmen. For Ms. [redacted] to assume that our services can be reduced to the "11/2 days of work" is just another illustration of incapability or unwillingness to acknowledge that she hired a SERVICE company. We face real costs to operate our computer systems, rents, vehicles, insurances, phones and people. Ms. [redacted] wanted to take full advantage of our services only later to claim the are unneeded and overpriced. How can she accurately say what our costs are or what we have spent? Why is it that her claims against us was dismissed by AL and they denied her a refund? I look forward to being able to put this complaint next to the AL complaint so the evolution of her complaint can be seen openly. As any reasonable person can tell by our responsiveness to her complaints, we take great pride in being a top rated, award winning company. The only reason this job is a problem is because of Ms. [redacted]. We do not concede that we have done anything illegal, unethical or unreasonable. We deny all the claims made by Ms. [redacted] as they are inconsistent and flat out inaccurate. We have certainly consumed a great deal of time and money dealing with her frivolous allegations and we are considering all this time as losses as a result of her breaching the contract. If the issues persists or is elevated to legal action we will be including all the hours spent responding to her allegations on two different arenas in the amount of our claim.Ms. [redacted] will settle for nothing but a complete loss of our costs with nothing but a transparent allegations that root back to the start of the contract. This is done because if she can prove the contract was done improperly then her breaching it doesn't matter. That is why these claims have nothing to do with why she actually called and unilaterally breached the contract. Our position remains and we hope that the Revdex.com will consider this issued responded to without resolution out of respect for the time and money we spend to continually re-iterate the same consistent story. Thank you and good day.

Contracted with Tub Gurus of New England, could not fulfill work on that date, I was notified that they were behind schedule and lost staff. I had also left a $500.00 deposit check that was lost and made another $500.00 deposit online through their website to compensate for the lost check, when I wanted to cancel, due to all of the inequities was notified I would only receive $250.00 of my deposit (which I have received). I would like to get the other $250.00 of my money returned.Product_Or_Service: bathroom remodelOrder_Number: No order no.Account_Number: ContractDesired SettlementWould like the other half ($250.00) of my deposit returnedBusiness Response [redacted] Contracted with Tub Guru of New England to remodel bathroom. Due to circumstances beyond our control, an employee contracting Lyme's Disease, we were forced to delay the project. Initially she was understanding of the situation. [redacted] proposed that we hire her "friend" who she said was capable but had a "drug problem" (her words). Then on Sunday we received an email that requested we cancel the project and that she receive a full refund of her deposit. We contacted her Sunday via email and told her we would be issuing a partial refund based on our costs. We received a hostile phone call on the owners cell phone from a person who was previously unknown top us that identified himself as the"owner". It was the owners observation that this person sounded under the influence. We explained that we were unable to discuss the contract with him and he threatened to sue us. Although our contract clearly states that we are not responsible for delays that are beyond our control, we in good faith issued a partial refund of the deposit the following day. We received an additional email stating that if we did not "concede to her demands" that she would slander and defame our company everywhere available. We informed her that we take these matters seriously and that she would be held accountable for her actions. We attempted to work in good faith with this client and had already invested several hours of company resources in preparation of this project as well as turned down new customers to keep her spot open. The portion of the deposit that we withheld only begins to cover these expenditures. Tub Guru of New England always works to create a positive working relationship with all our clients.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)I do not accept this response because they have not invested several hours of company resources in regards to my bathroom remodel, and also initially lost my first deposit check, which I have yet to have returned to me. This company is disorganized, unprepared and have pushed my date up, and I expect a full refund not a partial one. I am a single mother with three children struggling to make ends meet. This is just not fair.Final Business Response We would like to reiterate [redacted] breached the contract with us. Although it went above and beyond our responsibilities as a gesture of good faith we issued her a 50 percent refund of her deposit which she accepted and cashed our check. Even after these efforts she threatened to defile our good name on Social Media.Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)I did not breach the contract, Tub Gurus breached the contract by moving the proposed work dates up to a 3 week period, when I was called and notified they had too much work and short handed. Tub gurus breached the contract by not fulfilling the work date of 8/3/2014. My original deposit check of $500 was also lost which I have yet to have returned to me.
