Progressive Home Warranty did not provide me with a reasonable assessment on my home. They state that the heave in my flooring is a patent defect (error in workmanship or not built to code which was visually apparent at time of possession).
This is not the case, the issue was not apparent at walk through and several other areas in my home have developed uneven flooring issues since possession.
Progressive Home Warranty will not provide me with the criteria of why they came to this decision. They have advised me that since they claim this is a patent defect which does not have coverage under warranty, that they do not have to determine the cause of the issue. I have a problem with this for many reasons. How can they determine with certainty that it is a patent defect if they do not know what caused the issue in the first place? What part of my home does not meet code or has failed in workmanship...framing, flooring, foundation? If they had at least hired a structural engineer to assess the home they could rule out a structural issue. Without that I am unable to repair my home myself because I do not know what is wrong with it. I am supposed to have a 10 year structural warranty and coverage for a minimum of 1 year on all materials. I noticed these issues within 1 year of moving in and started my claim within the 1 year period. There is no excuse for not helping me repair my home or at least investigating to determine the cause of the issue.

Without prejudice, Progressive Home Warranty has agreed to have a structural engineer assess the floor situation and provide a report. The purpose of the report is to see if the reported issue is a structural defect as defined by the policy. The claim remains denied however upon receipt of the engineer's report the matter will be reviewed. The homeowner has been made aware of this action.

I am pleased that the company has decided to have the flooring issue investigated further by a structural engineer. They have agreed to send an engineer but I have not been contacted yet and the assessment has not taken place. Hopefully once the assessment is complete a fair ruling of coverage on that item will be agreed upon.

This claim was regarding reported frost in the attic. The issue was investigated by the builder and improvements were made to the sealing of the attic hatch. Frost accumulating in an attic is not unusual in our Alberta climate in the winter....

There has been no report of the frost melting and then entering the living space. The Alberta Government has produced a Construction Performance Guide, which was referred to when dealing with this claim. Section 9.10 of the Performance Guide speaks to this issue. Our position is that the builder acted in good faith in handling this claim and that Progressive Home Warranty acted in good faith in coming to the determination that the repair is acceptable. Cited below is the text from Section 9.10 from the Performance Guide.

During periods of extended cold weather, moisture from the living space or outside sources carried by air movement can accumulate as frost on the underside of roof trusses and sheathing. The degree of frost accumulation is related to the relative humidity of the house air, the rate of air movement into the attic and the length of the cold spell. When temperatures rise above freezing, this build-up may melt faster than the attic's ventilation system is able to exhaust the accumulated moisture.
Homeowners have a responsibility to mitigate damage by reducing humidity levels in their homes during cold weather. Although builders can minimize the moisture reaching the attic by ensuring the air/vapour barrier is as continuous as possible, air leakage into the attic cannot be completely eliminated. Even a small air leak can deposit a significant amount of moisture over a long cold spell if the moisture content of the air is high.
Attic spaces shall be designed and constructed with an air/vapour barrier to minimize the migration of moisture laden air from the interior of the home into the attic space.

I received a letter to sign and give back as well as some info about the next step, from Progressive. I attempted to call 2 times to ask for the representative, he was not there. I left a message, as well as sent an email. I was looking for some information and someone to answer my questions regarding all the stuff that was sent to me. The fellow had called me back, unfortunately I was not home. He left a message on my machine for me to call him back. I called him back he wasn't there. I left him a message to call at work, no call nothing. To me I guess they aren't too interested in helping me with my questions. So, with that I'm done with this level and will be taking my concerns else where. Unprofessional is all I have to say about Progressive Home Warranty.
