Progressive Home Warranty did not provide me with a reasonable assessment on my homeThey state that the heave in my flooring is a patent defect (error in workmanship or not built to code which was visually apparent at time of possession) This is not the case, the issue was not apparent at walk through and several other areas in my home have developed uneven flooring issues since possession Progressive Home Warranty will not provide me with the criteria of why they came to this decisionThey have advised me that since they claim this is a patent defect which does not have coverage under warranty, that they do not have to determine the cause of the issueI have a problem with this for many reasonsHow can they determine with certainty that it is a patent defect if they do not know what caused the issue in the first place? What part of my home does not meet code or has failed in workmanship...framing, flooring, foundation? If they had at least hired a structural engineer to assess the home they could rule out a structural issueWithout that I am unable to repair my home myself because I do not know what is wrong with itI am supposed to have a year structural warranty and coverage for a minimum of year on all materialsI noticed these issues within year of moving in and started my claim within the year periodThere is no excuse for not helping me repair my home or at least investigating to determine the cause of the issue Final Business Response / [redacted] (4000, 17, 2016/05/25) */ Without prejudice, Progressive Home Warranty has agreed to have a structural engineer assess the floor situation and provide a reportThe purpose of the report is to see if the reported issue is a structural defect as defined by the policyThe claim remains denied however upon receipt of the engineer's report the matter will be reviewedThe homeowner has been made aware of this action Final Consumer Response / [redacted] (2000, 19, 2016/05/26) */ (The consumer indicated he/she ACCEPTED the response from the business.) I am pleased that the company has decided to have the flooring issue investigated further by a structural engineerThey have agreed to send an engineer but I have not been contacted yet and the assessment has not taken placeHopefully once the assessment is complete a fair ruling of coverage on that item will be agreed upon
