ProHealth Chiropractic of *** as well as ProHealth Chiropractic of *** violated contractual agreement/policy of *** in ***. *** terminiated their agreement with ProHealth Chiropractic in *** and sent legal documents directing ProHealth to cease and desist using *** trade name and or trademark. ProHealth continues to use *** materials, name and trademark in their business and advertising. ProHealth has done radio adds and referenced ***. Radio station was contacted to correct. ProHealth continues to advertise in the *** Directory using *** name. They received a letter from legal in *** to remove all trade name, trademarks and etc from advertising. ProHealth advertised again in *** Directory for *** using *** name again. *** legal department is in the process of contacting ProHealth. ProHealth also is using false advertising on their website using results from the *** program from *** to ***. The only started using ProHealth Diet in ***. They continue to financially hurt the only authorized *** Clinic in *** Weight Loss Clinic due to their false advertising.

Desired Outcome

Correction of advertisement on ProHealth's website. Dieters used the *** program from *** to ***, any results from *** should be stricken from total results listed on their page. A disclaimer should be put on their website stating they are not an authorized *** provider. They should not longer reference the trade name or trade mark in social media, advertising, radio, newspaper, tv, website and etc... A statement should be placed on the Revdex.com regarding this matter and business.

ProHealth Chiropractic Wellness Centers agreed to terminate their contract with *** in *** in an effort to benefit our patients in more flexibility while they are dieting, as well as better value and variety in meal replacement products. Since that time, we have discontinued the use of *** name and materials in all marketing and patient interactions. Third party advertising vendors have also been instructed to no longer associate our name with theirs in any and all advertisements. Unfortunately, in *** or ***, a radio station employee played a previously recorded advertisement using *** name on the air. When we learned that the ad had mistakenly run, we recontacted the radio station and requested that they delete all of our previous ads to prevent the error from reoccurring. To our knowledge, they have complied to our request. In regards to *** advertising, in ***, several *** companies were instructed to downsize ads and remove any reference to ***. When the books were released in ***, all of them complied with one exception. That particular book was directed to remove all column ads and replace those ads with bold listings only giving the name of the practice and phone numbers. No other information or detail was to be printed. The ads in other sections of the book were corrected and the only proof sent for approval was for the name and phone number of the practice. When the book was released, a column ad was mistakenly left in the weight reduction services section that had been used the previous year. We notified the company that that was a violation and they confirmed via email to us that a note was placed in our account that the *** name would not be used in our advertising moving forward. When the book was released in ***, the same ad was again mistakenly printed in their book. No proof was delivered to ProHealth and since our account was bold listing only, it was explained to us that it was changed to auto renew status which meant that prior approval was not required before print. When *** national development coordinator contacted us on *** to let us know that the ad had been reported, an agreement was made to put a disclaimer on our website that ProHealth was not affiliated with ***. On ***, that disclaimer was added and on *** another email was sent to the national coordinator from ProHealth that the *** company agreed to cancel our advertising account with them to prevent any misrepresentation in the future. As for statements of results and pounds lost, ProHealth simply states that our office has assisted our patients in loosing the said pounds since we started formally tracking those results. It does not associate which product supplier was used to achieve those results as we have the freedom of using multiple products and companies to better our patient's health. The credit for those results belongs to the facility that advertised and orchestrated those results. ProHealth has and will continue to take all steps deemed possible to prevent the use of *** name in our own efforts as well as third party companies. Confusion in the general public about which product we use for our patients is potentially harmful to ProHealth as well.
