Review: Wayne Mullins, President and owner of co. put on an addition to our house in 2006/07. There is a valley were the old part and the new part meet. The shingles were not put on correctly causing water to get under them & rot the plywood at the bottom of the valley and some of the valley. This was repaired by a license contractor because the original contractor would not return my calls. My neighbor noticed my roof was dipped down on the corner & told me.I called Mr. Mullins on August 14, 2013 & told him about the leak, could he check it in a couple of days. He was short with me & told me he didn't have time to check it in a couple of days. I said next week all right. After a week I called him several time & left messages & he never called back.Desired Settlement: I woud like for Mr. Mullins to pay $511.62. The total cost was $682.14. I will pay for 1/4 of the repair.

The builder warrants that the dwelling was free from structural defects and was constructed in a workmanlike manner to pass inspection without objection in the trade. The construction went through inspection phases through the city of Staunton and passed each one. Workmanlike manner is in force for one (1) year from the date of conveyance of the occupancy.(Virginia Code). If a non-emergency problem arises in materials (it is up to the homeowner to contact manufacture of the materials) or workmanship that is covered by our warranty, a written list should have been submitted immediately during the warranty period, which was 1 (one) year from occupancy, not 7 (seven) years later. (Virginia code). Your home will be exposed to all four seasons of the year, including extreme summer heat and icy cold winters. Some changes may occur during the first heating season and are caused by the drying and shrinking of materials. Materials will sometimes “spread apart” due to the sun on the outside. This is normal and is considered a maintenance item to be cared for by the homeowner. I have been to his residence numerous times and given estimates on problems that I am not responsible for and have not gotten paid. He has also been to my wife’s place of business and contacted her by phone which is unacceptable behavior on his part.

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.I would like to respond to several of your statements in your letter to me. I do not know the VA codes and I’m sure what the inspector saw was up to code. You stated hot or cold weather could cause the material to shrink or expand. The contractor that I used to repair the problem said that in the valley some of the roofing shingles were put on upside down and the way they were nailed in the valley could cause a leak. The only way this could be solved was raise up the shingles. I’m sure no building inspector will do that. If the leak was caused by hot or cold temperatures, why doesn’t the whole roof leak? You said that some times material will spread apart due to the sun. I feel that isn’t a good argument if it was done right the roof would not have leaks.You stated you have been to my home numerous times (you were there twice) to give estimates and had not got paid. I was waiting for the check from the company that you bought the decking material from. When I received the check I called and left a message for you to call me. I wanted to get on your schedule to put down the new deck. You would have been paid for it, the amount you had in your estimate, but you never returned any of my phone calls. How was I supposed to get you to replace my deck? I thought you were sick or on vacation since you didn’t respond to my phone calls, that is why I contacted your wife.I thought we had a better relationship than this and we could talk man to man.Staunton is too small of a community to have an unhappy customer.Regards,[redacted]
