Dear [redacted] ***: I received your letter yesterday regarding the above complaint [redacted] contacted our office on 4/16/and asked if we could assist him with a claim for damages to his homeWe agreed to meet on 4/22/to retain our serviceDuring that meeting I told [redacted] that his homeowners policy requires him to “protect his home from further damages" and since he had water pouring through his home he would need to contact a contractor to make temporary repairsI always recommend that our clients use a contractor that they already had a relationship with or they have been happy with in the past[redacted] said he knows no such contractor and he didn't have the money to pay them anywayHe then asked if I could recommend anyoneI told him I only know one contractor that will do the repairs and then wait until the claim settles to get paid and that was [redacted] I told him I would ask [redacted] to contact him [redacted] invoice is enclosed along with the page from [redacted] ***'s insurance company showing he was paid dollar for dollar for the emergency work [redacted] performed to his homeI have also enclosed a copy of the State Insurance Department mandated contract that [redacted] signed with our companyIt clearly states “insured agrees in advance, the insured will reimburse Property Adjustment Corporation for extraordinary expenses above and beyond the costs of doing - business, such as expert witness fees and expenses, engineer and inspection - fees"In addition to the temporary repairs made to [redacted] ***'s home to protect from further damage, the only extraordinary expense we incurred was a satellite inspection report or “ [redacted] "A copy of the $ [redacted] invoice and report are enclosedI was with my brother Charlie at a national conference when he received a call from [redacted] ***s on his cell phone [redacted] ***s became aware that his insurance company issued a settlement check to our office in the amount of $27,He pressed Charlie to tell him at that moment exactly how much money he would be walking withCharlie told him he would be back in town in a few days and would let him know as soon as he could check his file [redacted] ***, using his very aggressive pushy personality, told Charlie that the check amount was for $27,less 25% so he should walk with $20,He went on to state he called Karen D [redacted] our office manager and she confirmed the check amountCharlie again reminded [redacted] that he was out of town and he would have to check his file but to his recollection “the numbers sound about right"Once Charlie returned to the office he realized there was the roofer's bill and [redacted] expense that also needed to be deductedUpon this news [redacted] stepped up his aggressive calling to our office to the point that every employee knew his voice on the phoneIn an effort to make [redacted] happy, agreed to revise the disbursement of his claim and not take a fee from the roofing invoice and [redacted] expenseApparently this gesture of compromise was not enough for [redacted] and our office is now expending resources responding to this complaint instead of carrying on with our workI would never expect someone else to pay for work done to my home, I don't understand why [redacted] would expect suchThis year my company is celebrating twenty five years of getting our clients everything they are entitled tooOne thing I don’t have a stomach for is people trying to get something they are not entitle tooIf you have any additional questions, please feel free to contact the undersignedSincerely, PROPERTY ADJUSTMENT CORPORATIONKevin K

I am rejecting this response because: While I thank *** *** for wishing me happiness in life, I can not accept his response as it did not address the outstanding issue of money owed to me based on what was promised. I do agree, and have mentioned this in a letter to *** ***, the results of the claim were very goodHowever, the payout portion that was promised by *** ***, and his staff, differed from what was delivered. Happily,

I am rejecting this response because:
Dear *** ***,
*** ***’s letter is filled with inaccuracies and lies,
and one thing I don’t have a stomach for is a LIAR!
My response to the various inaccuracies and lies is as
follows:
*** *** states “I told *** *** that his homeowners policy requires him to “protect his home from further
damages” and since he had water pouring through his home he would need to
contact a contractor to make temporary repairsI always recommend that our
clients use a contractor that they already had a relationship with or they have
been happy with in the past.”
There was never water
pouring into my house, however, we understood the home needed temporary repairs
to prevent further damage, and issues with water getting into the houseHe
never recommended using my own contractor, he said he would take care of it
from the beginningAfter we signed with *** ***, I asked what the next
step wasHe explained that he would have his guy out to make temporary repairs
to prevent further damageI asked who handles that part of the process, he
explained that he wouldI asked who pays for his services, he explained he
handles itI specifically asked if that charge is included in his 25% fee,
which he confirmed it was
*** *** states “*** *** said he knows no such
contractor and he didn’t have the money to pay them anyway.”
If I had to get my own
contractor, I certainly would haveI interviewed several contractors to
eventually do the workI never said I didn’t have money to pay them, but why
would I when *** *** said he would take care of it
*** *** states “It clearly states “insured agrees in
advance, the insured will reimburse Property Adjustment Corporation for
extraordinary expenses above and beyond the costs of doing business,
such as expert witness fees and expenses, engineer and inspection fees".”
This is a conveniently
vague statement that *** *** now wants to point toWhat is defined as
extraordinary fees? *** *** previously mentioned it is a requirement to
protect the homeExtraordinary means very unusualIf it is a requirement, it
is not very unusualIn addition, *** *** told me it was covered in
his portion of the 25% fee
*** *** states “I was with my brother Charlie at a
national conference when he received a call from *** ***s on his cell phone
*** ***s became aware that his insurance company issued a settlement check to
our office in the amount of $27,He pressed Charlie to tell him at that
moment exactly how much money he would be walking with.”
This is a lieCharlie
K*** notified us, in writing, of the amount in a letter dated June 17,
I received his letter on June 19, and immediately sent him an email
with some questionsWhen I did not hear back from him, I called his officeI
was informed he was out of town at a conference and would be back the following
weekI spoke with him on June 24, I asked if he had received my email,
and he confirmedI asked him to confirm the payout amount we would receive
after deductibles, fees, etcMy expectation was $20,He placed me on
hold to “double check” his figuresWhen he returned, he did confirm the amount
we were to receive was $20,I never spoke to Charlie while he was at the
conference *** *** mentionsCharlie K*** was back in his office when
I spoke with him and I have phone records to prove it
*** *** states “*** ***, using his very aggressive
pushy personality, told Charlie that the check amount was for $27,less
25% so he should walk with $20,528.99.”
Saying I have a very
aggressive pushy personality to excuse your mistakes and lies is laughableI
simply asked Charlie to confirm the payout amount we were to expect along with
a few other questionsRemember, I am the customer hereI don’t do this every
day, so I wanted to make sure I knew what to expectI have the email to show what
I asked, and how I asked itIf I was so pushy, and you seem to have a
completely different recollection of how the events actually took place, why
wouldn’t both you and Charlie make sure you called me back to say I was
mistaken?
I had a damaged house

interviewing contractors to do the workI needed the payout amount so I knew
how much I had to spend on the repair workThis is not an unreasonable

mistake had been made or with further clarification I was never notified of this news! The first I
heard any of this was when I stopped into the office to pick up the check
*** *** states “Upon this news *** *** stepped up
his aggressive calling to our office to the point that every employee knew his
voice on the phone.”
Another lie! The first
I heard any of this was when I stopped into the office to pick up the check and
noticed the amount differed from what was promisedI questioned the amount
while standing in the office and asked the woman in the office to have *** ***
come down to speak to me about itI was clearly upset at this point, and I
apologized to the woman in the office because of itIt was not her fault, but
I had every right to be upsetI was told one thing, and when I came to pick up
a check, it was not what I was told to expectTo make matters worse, Mr
K*** did not have the decency to come down stairs from his office to speak
with meI asked that he call me as soon as possible, and I leftI made
several phone calls throughout that day to both *** *** and his brother
CharlieTo this day, I never heard back from Charlie, who handled the claim
When you have a
customer who is clearly upset, a simple phone call would have gone a long way
to settling the matter down
*** *** states “In an effort to make *** *** happy,
I agreed to revise the disbursement of his claim and not take a fee from the
roofing invoice and *** expenseApparently this gesture of compromise
was not enough for *** ***”
When *** ***
finally called me to discuss the discrepancy on the payout amount, he told me
the invoices for repairs and *** were paid 100% by the insurance company
before the payoutI questioned why then he took his 25% fee first before
reducing the claim by those amountsHe had no good explanation and agreed to
revise the payout
Please do not let Mr
K*** fool youHe made no such effort to make me happyHe only agreed to
make the change because I caught him in a lie, and called him out on his
dishonest business practices
*** *** states “our office is now expending
resources responding to this complaint instead of carrying on with our work.”
I do not care if your
office is expending resourcesI have had to waste a lot of my valuable time
fighting with you to make this rightYou did not deliver on the expectation
you set for me, and confirmed throughout the processHad you done the right
thing, you would not have had to expend those resources

to pay for work done to my home, I don’t understand why *** *** would expect
such.”
I do not expect
someone else to pay for work done to my homeHowever, I do expect someone I
hire to be honest and deliver on the expectations they setAs I type this
response, I have someone performing work at my house that I am payingI have
countless receipts and invoices showing I pay for work done at my house
Does *** ***
expect to be ripped off by someone he hires? I think not, but that is how I am
left feeling
I can appreciate that *** *** handles hundreds of
claims and may take certain things for granted when speaking to customers
However, I have only ever dealt with one claim on a home I have owned in the
nearly years as a home ownerSo I asked the questions to make sure I was
clear on what to expect, only to be blindsided when I go to pick up the check
at his office
*** ***’s attempt to attack a customer who brought him
business, by name calling, in defense of clear mistakes and lies he and his
employee had made, is just plain pathetic
If *** *** would like to make a settlement of a
different amount that I am requesting, I would consider it, at this point, to
put this whole ordeal to rest, but I can simply not let this go without any
sort of compensation as I feel I have been ripped off
Ultimately, I do not know if there is any legal recourse for
this matter, but I will explore all options if *** *** is not willing to
do anything

I would never expect someone else to pay for work done to my home, I don't understand why [redacted] would expect such. This year my company is celebrating twenty five years of getting our clients everything they are entitled too.
