Ms. [redacted] owns a condominium at [redacted] condominium in Federal Way.  Property Concepts, Inc. is the management company hired by the [redacted] Condominium Board to handle collection of owner dues, payment of Association bills and assist with coordinating the maintenance of the...

property.
 
Per their governing documents, [redacted] owners are to pay monthly maintenance fees by the first of each month.  If payments are not received by the 15th of the month a $50 late fee is charged along with interest on the outstanding baslance.
 
Attached as a pdf file is a copy of one of the letters received from Ms. [redacted] and copies of the checks she sent.  Also included are copies of Late notices Property Concepts sent her.  The dates shown on each of the check copies sent by Ms. [redacted] is the 15th of the month in which those payments were due.  Regardless of how fast or slow the mail delivery is it is impossible for us to receive a check the same day she wrote it.  The dates on the check copies we received and their posting dates on Ms. Brown's checking account document that the checks were deposited between the 17th and 22nd of the months they were sent even though they were written on the 15th of the month.  so there is no doubt the checks are being processed promptly once received.
 
Ms. [redacted] has been advised that payments are due on the first of each month as it was written on the Statement of Account sent to her dated 9-30-15.  A copy is included in the attachment to this response.
 
In reviewing the account history Property Concepts maintains for each unit I see that Late Fees and Interest have been waived for at least 5 months since March of 2014 for Unit D-06, yet we continue to receive the payments after the 15th of each month.  This results in Late Fees and interest being posted to her account.
Normally we will waive one or two late fees each year if the payment history is otherwise good.  We have done it 5 times for Ms. [redacted] but her payments continue to be received late.
 
If Ms. [redacted] were to pay one month in advance or mail her checks earlier each month Late Fees would be avoided.  The [redacted] Board of Directors sets the Late Fee policy and we have limited authority to diverge from it.
 
We don't like the extra wor4k involved but cannot simply remove legitimate Late Fees when payments are received late repeatedly.
 
How we can cash a check the day it is writtten I don't know.  Future checks should be sent earlier each month to avoid the same problem going forward.

I am rejecting this response because: This is in regards to their response.  I do pay them in a timely matter.  I always mail payment out before the 10th of each month.  I do have until the 15th of month to pay by.  So this gives plenty of time to reach there before the 15th.  I do make the dates of my check out for the 15th.   It’s not that I’m mailing them out on the 15th so the statement of them saying I mail the check on the 15th is incorrect.  They’re the ones not cashing them in a timely manner.  Yes they have been clearing my account around the 17th-24th of month.  But this has nothing to do with when I pay them.  This all has to do when it clears my account.  So they’re going off of this and charging me late fees.  This is not correct and therefore this is why I’m rejecting this response.  They’re charging late fees that shouldn’t be charged do to this.  Yes I did state to them I was late once this year back in February I believe.  I told them once they correct the bill I would be happy to pay them the one month late fee not the rest that is not my fault.  As to the statement of them saying the waived five months of late fees that’s inaccurate.  In the past when I was late I paid the late fees at the time I sent checks because I knew I was going to be late and if I have to go back find copies of these checks I can or go to my bank.  So this is an incorrect statement on their part I have paid all late fees in the past that I was late on.  So once again if they will correct the statement as I stated in letters to them I will pay the one month late fee that I was late on in February.       Sincerely,[redacted]
