we have a problem with our dwelling unit, as you may know, our dwelling unit was not move in ready as of 8/5/16 as promised and has a pet urine smellPlease be advised that we have a problem with our dwelling unit. As you may know, our dwelling unit was not clean at time of move in, there were ants all over the unit and there is a terrible pet urine smell in the living room/dining room area. Our unit was not move in ready as of 8/5/16 as stated on our lease agreement, therefore we were unable to move into the residence until 8/15/16 after which the residence was re cleaned and the carpets were cleaned. We had to spend $21.84 at Target for ant traps and ant spray as well as $10.65 at [redacted] for a duct hose and clamp for the dryer as it was not connected. We had to continually come to the office as our calls went unreturned and finally you had an exterminator, carpet cleaner for the second time and cleaning crew come out to the unit. The ants and cleaning were resolved, however the carpets are still an issue. We have since then contacted you several times regarding the pet urine smell in the dining room/living room area and the issue leaving messages with Abigail as she states every time you are not in the office. We have not received any communication from you or your office since 8/15/16 when the move in check list was returned and the issue was again presented. This problem creates uninhabitable living conditions. This problem has persisted since 8/5/16. NRS 118A.290 requires you to maintain the dwelling unit in a habitable condition. This dwelling unit violates provisions of health codes concerning sanitation for habitation of the dwelling unit. NRS 118A.355 requires that you remedy this problem within 14 days. If you fail to remedy and fail to attempt to remedy within 14 days, we will withhold the rent. We also have the right to terminate the rental agreement, recover actual damages, and apply to the court for appropriate relief. Alternatively, we will correct the condition at your expense. We will supply an itemized statement of the costs to you and deduct this cost from our next month's rent. Desired SettlementWe are asking that the pet urine smell be fixed in the dining room/living room area and that we be reimbursed for the rent that we paid from 8/5/16 to 8/15/16 and be reimbursed for the expenses at Target and Home Depot. We thank you for your anticipated cooperation in this matter. Please contact us to set up a good time for you to repair the problem and discuss reimbursement. Nevada law prevents retaliation and prevents eviction and late fees that result from our withholding the rent.Final Consumer Response
