Dear Ms***,This letter is about the complaint filed against Providence in the Park Apartments in Arlington, TX.Attached is a copy Of the resident ledger, conversation logs documenting discussions with the resident and his lease contract.*** and I spoke to Mr*** on 3/27/in the
Assistant Managers office about the late charges that were incurred on his accountHe told his story about how he made his rent payment online and has a receipt of payment made on 3/1/He called the office on 3/8/inquiring why rent had not been taken out of his account yetShe informed him his rent had not been received in the office as of that date and if he could bring in the payment in form of a cashier's check or money order that day she could waive the fees*** called the resident back on the 3/13/to inform him rent has not been received as of that dateHe admitted to her he had forgotten due to his work scheduleShe informed him he could go to *** and get money orders up to $for cents each and put it in the night dropShe gave him the total owed and he stated he remembered how much, he just forgotOn 3/27/2018, Mr*** called again about getting the block off his account so he could pay onlineThen he called back on that date wanting to know why he owed $She informed him it was due to rent not being paid until the 13th of the monthHe informed *** since he paid rent on time he should not have to pay the late fees, he has the receiptShe informed him when you set up your account you put in the wrong numbers so your payment was never registered due to this issue(See enclosed ledger) That is when he wanted to speak to meSo, after this discussion I ask him why did you not come in that day she ask you to come and pay what was owed? He stated he could not get here due to his work scheduleI said but she had to call you back on the 13th to inquire why rent had not been paid yet and your answer was I forgot due to workingHe kept saying he paid on the 1st he has the receiptI explained to him the process that happens when you make a payment online and when he set the account up and had put the the wrong numbers in and when the payment went to his bank it was rejected due to the account was wrong so no payment was ever registered for MarchI also ask him If he had he contacted his bank to see what the issue is? He said he did not need to it was our issue and the Assistant was a liar and he did not have the late feesI told him we do not have access to what you set up online only you doWe could not have corrected the account to get the payment to go to his account if we wanted to, notice to vacate was delivered the 6th to the unit and rent did not get paid until the 13th so yes, late fees were charged as his lease states.He stated the Assistant had told him just to pay the rent you won't have to pay late feesI told him I do not think she would put her job on the line to tell you to pay rent whenever cause if we do that for you we will have to do it for everyone, that we must stand by what the lease statesHe got up to leave and says so you're just going to back the lease contract and I agreed.On the 3/28, his wife did come in the office with the copy of the receipt of the rent payment when he made it online and I explained the process to her that he did make the payment but because he had set the account up wrong when it hit his bank the payment was rejected due to wrong account number was put in at set up and rent was not paid until the 13thI mentioned the 3-day notice to vacate was delivered and put on the inside of the front door on the 6th and the discussions he had with the Assistant ManagerI explained to her the Assistant has a time frame on what happens each month and she is required to go by it.The late fees were paid with Aprils rent payment.Sincerely,*** ***Property Manager

Per the application that was signed by all parties states the Application Fees and Administration Fees are not refundableIt also states that once approved the deposit is no longer refundableThe $check that was presented to us for payment has been returned for insufficient fundsOur records
