Good morning,Unit was towed on 12/3/@ 1:am Unit was already hooked up when individuals, a young man and a young woman came out of the home, the young man stating the car was his Young man, [redacted] appear to be very intoxicated Driver asked him if he had a pass for his car as he had no parking decal for his car [redacted] first pointed to the hood of the car and when driver told him pass would not be there he then pointed to the rear view mirror to something hanging from it Again driver told him that was not a parking pass At this point the young lady asked where they could pick up the unit At no point was there a request to drop the unit Drivers are aware that if owners ask they are to drop unit at location (release on location ) and charge lesser rate Drivers had already performed two ROL that night already so they are more than educated on the procedure Father, [redacted] came to our office on Wed, 12/after stopping at property management company and stating he had driven hours to get matter resolved Clerk at our office stated Mr [redacted] would need to speak to owner about matter and owner had left out to pick up cars in Grayon County (an hour away) and would be detained till about pm Mr [redacted] was not satisfied with that answer and proceed to pull our his police badge out and stated he was an officer of the law in an attempt to intimidate the clerk to get a refund Clerk took his number to have owner to call him back Owner was detailed in Grayson County and called Mr [redacted] before he left the office at pm to tell him owner would be back at approx pm or after and Mr [redacted] stated it would be fine to call late as he would be driving home late into the evening.When owner did return to the office and call Mr [redacted] at 9:and try to explain his side of the story Mr [redacted] begin to yell and threaten legal action and said he was going to report all of this to the towing board He would not even listen to the owner to explain the proper procedure on filing a towing complaint with the state We have contacted the police department in Charlottesville, VA and left a message for the Chief of Police to contact us to as we feel it was very unfair and unethical of Mr [redacted] to use his police badge as an intimidation tactic to get his way in the situation We have video surveillance at our location and reviewed the recordings this morning to verify we can plainly see him pull and present his badge to our clerk Regards, [redacted] Office ManagerPRS Towing [redacted]

I have reviewed the response offer made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below.IF there was audio of the conversation it would prove that I clearly explained, not only to the clerk (Which is the stepson of the tow company owner) but to the owner as well, that the only reason I told them about my law enforcement experience was to demonstrate that I know the laws very well after having enforced them for almost years I even specifically stated that it was NOT to influence them Secondly there were several witnesses to this incident and they have verified that [redacted] was NOT intoxicated and that this is standard practice for PRS Towing to make that claim when dealing with college students in an attempt to intimidate, and bully them into paying Said witnesses also verified that the tow truck was not hooked up to the car prior to [redacted] walking over and inquiring what he could do about it (Owner admitted to me on the phone that the car was not hooked up at the time of initial contact) Owner admitted that he never informed [redacted] about the ability to pay a drop fee, and went further to state the he didn't have to The response writer from the business was not even present during any of the conversations and in fact quickly left as I was arriving so that the clear would be the only one there I had called the property leasing company and discussed the incident with [redacted] the property manager She called PRS to try to straighten it out as well The clerk even stated the he was sure that it could be resolved without court or further complaint in a way satisfactory to all The owner kept changing the time that he would be there to discuss in person as to what happened and to resolve it I had to leave to get back to work and he didn't even call until after 9:at night He was rude, vulgar, and used profanity multiple times I never even raised my voice or cursed at him He is using predatory towing practices and needs to be stopped I will only accept a refund of the difference of what the drop fee should have been that night The Attorney Generals office will be investigating Regards, [redacted] ***

We will await contact of the Attorney General's office and present our side of the case to them upon their contact. We apologize this could not be resolved but feel we have been unfairly accused in this matter and must stand our ground with our decision. Regards,PRS Towing
