Initial Business Response /* (1000, 12, 2015/09/12) */
Resolution to this situation started on 08-09-when *** the owner tried to come to look at work but customer said it was to late as *** was on another jobThere is many statements and PRT Flooring is counter claiming in small
claims with Defamation, Damages, etcto business because of this and uncontrollable acts of Slander , which he called the *** *** radio show and *** even told him he can not charge twice, and had to get him off air because of his uncontrolled behavior. On 08-08-Customer ran out of grout so needed to come back when he got it(never not finished job as they ran out of grout),)n 08/09/2015- He refused *** from coming over because that time wasn't good for him, On 08-10-Customer left phone message saying he is starting all his complaints with everyone he can ( not even Hours after we left his home because he didn't have enough grout , On 08-11-Still never heard form customer yet, On 08/12/They wanted our Insurance information instead of letting us come in their house to see what the issue is and fix it, On 08-13-He started sending more complaints to Revdex.com, ***'s *** *** ***, *** with statements concerning this matter, On 08-14-He went and filed a Small claims for over 5,For things added twice, things not on his receipt, and Contractor that was over charging him for things that don't needed to be doneUnder the Colorado Construction Act Law that he has not given our business a chance to come in and look at the issue or the time to resolve this issue which gives us Days before he can sign any legal claims against us because of unfair Consumers who try to get things for free or make businesses look bad because of their neglect and uncontrollable bad behaviorThis customer has never tried to resolve this the right way and his behavior has over proved that he is out for revenge of some kind and ruin our small businessWe were advised to let customer take this to the small claims court with a counter suit with damages of 7,and also our resolution along with that charge because of the damages he caused because of statements he made without proof, as he already took out all the material so no one can say what was damaged and what was not and he has also broke our contract as he hired another contractor while being contracted with usWe were gone to let it slide by him touching our break which broke our contractIf he does not take our counter claim them we will have no other choice but to get this case dismissed and go threw County Court with our LawyerWe are sending you some of the Evidence of statements and so on, and our case has over pages of information on this case plus statements from Sub-Contractor, Pictures, Texts, Emails, Business Statements saying customer made statements about our Business, EtcSo this Customer shows over several times he does not want to resolve this in a professional manner but in a uncontrollable matter that will lead up to Damage to himself in the long runThis Customer is breaking many laws and contacts and is a unwilling attitude
Initial Consumer Rebuttal /* (3000, 15, 2015/09/15) */
(The consumer indicated he/she DID NOT accept the response from the business.)
This statement from PRT is completely falseThis contractor has been negligent from the day they started the installationI dismiss their claim of defamation and slander because for that case to hold water the claims I made have to be and they are notEverything I have stated is trueThe tile is still on the wall for everyone to seeI never hired another contractor because I have to get this matter resolved first to be able to get my materials replacedI have documentation showing that they have been the ones that are out of control and threatening me with $50K lawsuits and sending complaints to my workplace seeking revenge upon me for stating what I have every right to stateThe Revdex.com, *** *** *** and *** are avenues for consumers to take for protection and to protect future consumers not to slander or defame small businesses.I have attached a thread of conversations that we have had with PRT from the day after the installation of this tile for your reviewI have also attached some pictures but this response will only allow me to attach a handful of picturesI would like to send the rest via e-mail so you can get the full scope of the poor workmanship and damage they have done to my homePlease provide me an avenue to get you the rest of the pictures and all the documentation possible before allowing this complaint to be settled one way or the otherThank you very much
Final Business Response /* (4000, 20, 2015/09/28) */
We have responded to this claim and we are headed to court as we are the wrong business he claims did the work as it was our contracted sub-contractor who did the workWe were advised that we have no other contact with no one concerning this matter as we have % proof of damages and defamation with all he contacted was and did major damages to our businessPlease close this case because this is not the company he should be suing and damaging as with hours he started his statements everywhere he can without even letting us respond before he emailed us and told us to stay away from his house and that is not resolving, that's out of controlIf this matter has to go to county court or higher we will go there cause we have a complete damage estimate from the store and etc
Final Consumer Response /* (4200, 22, 2015/09/29) */
(The consumer indicated he/she DID NOT accept the response from the business.)
This is not a resolutionThey continue to say that I have to take this up with the sub-contractor but I never signed a contract with the sub-contractor, it was with PRT Flooring and they should be responsible for the work their sub-contractor performedI am disputing their counter claim for defamation

Initial Business Response /* (1000, 6, 2015/09/21) */
Job was scheduled for 08/26/2015 for starting work for Demo and Install but we started earlier on 08/19/2015 due to one of the customers having surgery. We got crew there to do Demo to remove baseboards( on which sometimes some crack and brake...

on removal) WE REPLACED ALREADY ! Owner of PRT encountered major demo problem due to old mesh wire under tile, which took four times longer to remove. PRT had to delay again because carpenters had to remove cabinets to finish our demo and on said time we installed premat. Then on the day of install there was another delay because of said customers where unsure of the size of spacers to use on tile because the owners where not home as they had two elderly people watching house and they were telling Installers what they wanted done. We couldn't start until over a hour late because customers who signed contract with us was not communicating with us.As we were working on the job and laying tiles which were all being leveled at every line being layed and for extra security was also taped so tiles had no way of moving and also when we were laying floor the elderly man was over the owner of PRT trying to hand him things to hurry the job. [redacted] told man that we professionally lay floors for a living and do not recommend on going to fast because all our work is like a art and every tile has to be layed right. When we got to the end of the floor we noticed we had to put more mortar down to make all tiles level because there is not one house out there that is completely level and then we asked man if he wants us to pour leveler down it would cost a extra 500.00 because of the extra time and extra work. Within less then 24 hours the customer texted us and said they got some one else to finish the work and that means that they have broken our contract and started a new one with someone else. Customers feel they can brake contracts with business owners because they feel like it and that's not the truth as you have to give a business a reasonable time to request to brake a contract, let a business inspect their problem and then fix it, but its seems this man in customers house wanted it done to fast and in a incorrect way and not wanting to pay the extra 500.00 to make it done the right way. They delayed our work since the first day we started and getting a person involved that wasn't on the contract to tell us what they wanted done not the customer. They now want there deposit back so that would make doing all the ( DEMO, TEAR OUT AND OUR TIME FOR FREE PLUS BREAKING A CONTRACT WITHOUT NOTICE ) which was four times longer then laying of tile. In 48 hours the customer demanded their deposit back which paid for all the demo, tear out, permat install, breaking of contract, tile install. This is all unfair to our business as we have pictures of how good our work was and a recording of one of customers saying yes the floor was perfect and level. This customer wants all this work we done for free and yes they probably got a contractor who told them they need to tear it all out so they can make some money and now they want us to pay for installing the floor that was perfect. Here what we must bill them for because we are no longer under contract :
200 SQ FT Tear Out Bamboo @ 5.00 SQ Ft = 1,000.00
400 SQ FT Tear Out Carpet @ .30 SQ Ft = 120.00
900 SQ FT Tear Out Tile & Mesh Sub @ 7.00 SQ Ft = 6,300.00
1,200 SQ Ft Install Permat @ 1.00 SQ FT = 1,200.00
400 SQ Ft Install Tile @ 8.00 Sq FT = 3,200.00
10 % Cancellation Fee = 1,100.00
TOTAL BALANCE OWNED TO PRT FLOORING - 12,820.00
Manager Fee's @ 100.00 Hr = 1,000.00
GRAND TOTAL SO FAR = 13,820.00
INCLUDED IS MESH TEAROUT & DUMP
We want this customer to stop making false claims and wanting all that work for free. We will be sending them a bill and legal documents in the mail, as we were gone to let this go on them breaking a construction contract without notice and doing more work then they gave us but it seems they want to go further with this and if customer wants to take this further then we will advice them that it will cost them a lot more money for our lawyer fee's and my mangers time.
We also request them to retract all their complaints with this resolution.
