Complaint: [redacted] I am rejecting this response because: AP / [redacted] Style Definitions */ Again 1) I moved into MsW***’s property 1/The Heater fan was very loud & I was concerned that there was a serious problemI later learned that the heater was over years oldI discussion with utility & home heater professionals the standard life of a heater is to years at the most MsW [redacted] stated repeatedly that she would get unit repaired yet failed to resolve the problemIt took over months to get any attention from [redacted] heating MsW [redacted] stated in the presence of witness that the additional dollars per month was to be applied to future rent thus applying undue coercion in the attempt to force me to agree to her inflexible terms 2) When lease was due to be signed (8/16) I repeatedly asked MsW [redacted] to address the issue & requested that she put the heater repair stipulation into contract (which she repeatedly denied) she demanded that I vacate the propertyMsW [redacted] stated she had other renters lined upThis statement was false, as the house remains vacant through 12/ MsW***’s initial response 1/was welcome to SW ColoradoHer response 8/was I will not talk to you about the heater & move out of my property 3) Having paid an additional 1, dollars to stay in said home with subsequent loss of dollar security deposit I was forced to move miles from my work because of the hostile conditions & not having the + year old heater repairedBecause MsW [redacted] owns almost all rental property; a clear monopoly on this market, in this small community there were no alternative living arrangements near my work place 5) In the Dove Creek community MsW [redacted] has a long history of entering her occupied rental properties without any notice something that others & I have experienced 6) When I moved into MsW***s property there were other problems: back yard badly torn up & front on poor condition, damaged old refrigerator & stove, scattered carpet stains, sink & bath in poor repair, all of which she now claims were my doing & has taken my security deposit for these reasonsShe NEVER signed the document about home condition statement Failing a return on monies discussed I would simply like this malfeasance reported Regards, [redacted] [To assist us in bringing this matter to a close, the consumer must give a reason why they are rejecting the responseIf the consumer does not provide a reason the complaint will be closed Answered]

I am rejecting this response because:Ms W*** takes marked liberties with the truthAgain for months she refused to fix a problem that she had repeatedly promised to repairIt took over a year for her to make amendsThe heater fan was never properly repaired & when Ms W*** finally "got around" to addressing the issue I had already paid an additional 1,dollars on top of rentIn a verbal agreement witnessed by *** *** Ms W*** stated that if I paid the additional (1,dollars total) we could sign a year contract dependent & contingent on her following through on promised repair.The retention of the dollar security deposit was based hugely inflated charges for which there is no basis in realityWitness: *** ***.I expect a minimum of a 2,dollar refunded as there was no "good faith" follow through on Ms W***s part. Having a monopoly of the rental market in Dove Creek there were no other options for living thus forcing me to move.In the community of Dove Creek there are several people who would testify to her over bearing, pushy, mean spirited management styleMs W*** has a reputation of walking into "her rentals" without letting the tenants know she was going to enter the domicileThis unannounced entry occurred several times during my occupancy.It is important to report Ms W***s manor of behavior, mean spirited poor management be reported and recorded so that other individuals understand what they are getting into

I called Comfort Air of Cortez (35 miles away-the closest big town with services) and they came and did a check of the furnace as well as removed interior sections and cleaned...

and serviced it. I checked back with the tenant more than once the first winter he was there about the fan and he stated that since he burned so much wood in the wood insert/fireplace, that the fan hardly ever ran and it was not a concern to him. The tenant never complained until the summer of 2016 when the fan became an issue again. I contacted another service person who was busy with a/c issues and asked if he could take a look at it in the fall before the weather got cold. I agreed and informed the tenant of the arrangement, but for some reason, it became a regular issue, although it had been checked and serviced the year before. Tenant admitted that he did not replace the furnace filters although they had been provided to him and stored next to the furnace when he moved into the property. I made two additional calls to the serviceman to facilitate his visit to look at the furnace, but he was busy with summer a/c work and could not fit it in. When the serviceman did come in October, he informed me that it was old, but safe and that we should consider upgrading, which we have plans to do in the Spring. (2/3)1 contacted the tenant one month before the lease period ended and asked what his plans were. He stated that his live-in girlfriend was looking for work 35 miles away and she did not want to drive in the snowy conditions that we regularly get in the winter. He said that they were looking to rent a property closer to the area she was looking for work in. I had no issue with that but when I stated that I would need a lease and did not rent month to month, he continually put me off and refused to sign a lease, but would not vacate the premises. The tenant proposed paying an additional $500/per month to stay until they could find a property. I agreed, but only thought it would be a month or two and told the tenant that I didn't want to get into the winter months with such an arrangement. He assured me that he would either sign a lease or give me notice on several occasions, which never happened and most of the correspondence from his end took on an ugly tone, which was surprising as I had thought we had gotten along well. Most of our conversations were through text messaging which I still possess. (5,where's 4) I never entered the tenant's property without he or his girlfriend being present, often we would make an arrangement to meet for me to make repairs. The tenant had a pit bull mix dog that was rarely outside. It is not my habit to enter properties without tenant's being made aware of it. Common sense and common courtesy always prevail when it comes to my properties. (6) I have pictures of the property, before and after the tenant's stay. I am willing to share those photos and also to provide receipts and testimonies, and am willing to allow the local authorities to tour the property as to it's condition, as per the complaint of the former tenant. **The last "text" was fabricated and added. I never received this text from the tenant. **I always made an effort to get along with the tenant. I did all his yard work or hired it done, although it was in his lease to take care of the yard. **I refunded a portion of the tenant's deposit, although it cost greater amount to clean and repair the property after he left, I thought it would be a goodwill effort on my part. **I hold no ill-will against this person and hope that he can move on with his life and find some portion of happiness in it.

Revdex.com ID# [redacted]January 2, 2017Response:I received the response when I returned from the holidays on January 1, 2017.Mr. [redacted] is amiss in his accusations regarding the heater issue he brought up to me in June of 2016. I had the heater serviced BEFORE he moved in and have an invoice from the company that serviced the furnace as proof. I was willing to have the furnace heater fan repaired or replaced and stated that it would be handled properly by the service company [redacted] Heating when I contacted him 7/06/2016. Mr [redacted] did handle the service call in October as promised. The text messages from both parties confirm that.Mr. [redacted] offered on his own accord to pay an additional $500/month until he could find suitable housing while his lease was expired or until he decided he was willing to sign an additional 10 month lease which was offered to him each month, May, June, July and August. I felt that our tenant/landlord relationship was in a good enough position to offer him a lease and he refused to do so, but repeatedly asked to stay an additional month with the promise of making a decision by the following month. He continued to pay rent and later, the $500 bonus HE offered to pay for the privilege of staying month to month until I pressed him for a decision as I had other parties interested in a lease agreement.The cleaning, damage and security deposit was refunded in the amount of $250. The charges for each item were clearly detailed in the itemized statement sent to the tenant. In all honesty, the tenant should not have received any monies back, as several items were not charged to the tenant, such as return of the keys for the property, damage to the ice maker with a screwdriver or ice pick, cleanup of bales of hay in the yard and the list goes on. I only sent the $250 as a goodwill gesture, which was obviously a waste of time and money.Ms. [redacted] was not at the property at the time that Mr. [redacted] moved or I am sure it would have been left in better condition. I believe she had traveled to Denver weeks before the actual move.I do not have a monopoly on the rental market as Mr. [redacted] states, however I do have several nice properties. There are many rental properties in the area, but Mr. [redacted] stated early on in the Spring that he was looking for a property closer to the area his girlfriend was looking for work as she was uncomfortable driving in the snowy conditions. I totally understood, but still gave him the option to lease the property again at the beginning of May, which he refused to do. I gave him the same option as I stated before in June, July and August as well.I stated before that I never entered the rental property without Mr. [redacted] or Ms. [redacted] being present. It is not my policy to enter properties without the notice of tenants. Mr. [redacted] has a pit bull mix dog as well, so common sense as well as common courtesy would dictate my actions.I have been in the rental business for over 30 years and I am happy to give former rental references to any potential renter that wishes to rent from me. There will always be some unhappy tenants no matter how hard I try to satisfy them. I keep receipts, correspondence, photographs, and additional documentation to support my properties and claims.Thank you for the opportunity to address this concern.Regards,
