To whom it may conern,Pulte Homes has been in direct contact with this customerTheir driveway was not poured on frozen ground in January of 2013, as construction did not begin on their home until the end of October of The driveway was poured in the second half of November at the completion of the foundation stageAll homes closing during the winter months had the driveways poured during the foundation stage to avoid the frozen ground issue the customer is speaking aboutIn late November of 2013, the ground was not frozenThe rest of the customers exterior concrete was pour in late winter/early spring of once the worst of the winter weather of was over.The customer has been advised that at this time their concern over the cracking of their concrete is not warrantable as it does not meet or exceed the performance standards of the warranty they were given by Pulte HomesShould, during the warranty time frame pertaining to exterior concrete, the concrete crack in excess of the warranty tolerance, Pulte Homes will take the corrective steps needed.Thank you,

For your reference, details of the offer I reviewed appear below:Pulte contends that this is only a concrete materials issue, of which it is not The concrete on my driveway is cracking as a direct result of the underlying materials settling due to poor workmanship and inadequate compaction There are hollow or void areas under this driveway that are a direct result of their subcontractor's shoddy preparation Custom Concrete, Pulte's concrete subcontractor placed the aggregate on frozen soil in January and after spreading it around they poured the concrete the next day Pulte representatives have states that they do not require compaction of the aggregate because they rely on construction traffic to tamp it down, which did not happen because Custom Concrete poured the concrete the very next day after placing the aggregate In addition, another portion of my driveway has settled almost 2" over a poorly compacted utility trench These conditions are a direct result of shoddy workmanship and the lack of base preparation that have now directly resulted in cracked concreted, which is their reaponsibility to correct

Pulte Homes is currently working with this customer to resolve this concern. The removal of the exterior facade of the home, as the customer states in the complaint, is not a resonable request. The brick on the exterior, as well as the house...

wrap and rubber flashing behind the brick can not grow mold. A small cut in the rubber flashing was noticed at a prior inspection and corrected as well as the small gap between the metal drip cap/brick flashing and the brick itself was sealed closed. It was determined this was the source of the water infiltration. In normal situation, water getting behind the brick is a normal practice and this water is allowed to escape this cavity through the weep holes at the bottom of the brick. Due to the tear in the rubber flashing, this water was allowed to travel down the exterior wall and enter the wall cavity.
At the time of the initial repair, all damp insulation and drywall was removed and replaced with new material. The location of the damp material was isolated to a single stud cavity due to the water accessing the inside of the wall cavity by one small location. No smell or odor was noticed during the repair. If an odor has become present since this repair, Pulte Homes will investigate further. In a recent email last week to the customer, we have offered to come back into the home and investigate the space under the foyer stairs as this is below the location of the leak. To date the customer has not responded to our Customer Relations Manager with a specific date and time that works with his schedule for us to come back into the home and investigate the odor concern.
To our knowledge, no further signs of water infiltration have come up since the repair was made, even with all rain storms that have occured since the repair.

The gas leak was reported as a NON HAZARDOUS  leak . RT Moore was scheduled to repair leak when weather would allow the pipe to be removed and gas shut off.   Called RT Moore and gave me 3/10 service and RT Moore contacted homeowner as well.   The leak described was...

first thought to have been a a foundation leak. When I visited the address it was noted the leak had been on of a previous leak . Gutters and exterior corner had substainial ice and snow and temperatures the previous days increased allowing ice-damming.  Previous rainfalls have not warranted any calls regarding this area . Notable the corner in seam of brick has crack .. This has been forwarded to the Homeowners association as the exterior issues and they have replied that exteriors and structure including walls and doors , windows and roofs be kept in good maintenance and repair by the Owners of the unit .  Homeowners Association also does not warrant Ice Damming .  Field Managers also states that Ice and water shield is in place 3 ft in effected area.

Pulte Homes has met and addressed this concern with the customer on a few different occasions. Per the Pulte Homes Performance Standards, concrete cracks that exceed 1/4" in width or height displacement will be addressed by Pulte Homes Warranty. All concrete will eventually crack throughout the...

curing process. All exterior flatwork poured by Pulte Homes utilizies the use of control joints to try and force the inevitable cracks to happen in the control joints. At times this works and at times it doesn't. This customer does have cracks that are outside of the control joints, but the width and/or displacement does not exceed that of the performance standards set forth in the warranty. Should the cracks exceed these standards, within the warranty time period, the cracks will be addressed.

Pulte Homes is in the process of working with this customer to address their concern. There are a few options of reworking on the slope of the gutters to try and redirect water to other downspouts, but it will be impossible to fully eliminate all water that comes out of the downspout located...

in between the two garage doors. There is no where else for this water to go. The lot that was chosen has the home facing north, so this time of year, the driveway and front of the home has minimal sun exposure, especially at the warmer mid-day temperatures, so snow is not allowed to melt. This is unavoidable due to the orientation of the home and seasonality of the sun exposure. We will do what is necessary to minimize as much water as we can from being directed to this area.

As Pulte's own field manager acknowledged when visiting our property, the site selected for the home is substantially closer to our property than permitted by local ordinance or the neighborhood bylaws. Other representatives have been repeatedly asked to come to the site to measure and show us any differing measurements but have refused. The structures inside the hole are significantly closer to our property line than the 5 foot minimum. Pulte's response also fails to address the series of fraudulent statements made up to our closing on the home less than a year ago. Also, Pulte's response falsely indicates they had no control over the type of home placed on the adjoining lot when in reality they selected the model and placement on the lot--this is a spec home and NOT one built for a specific customer.
 
Pulte has also failed to provide any sort of compensation or redress done to the vehicle and playset located on our property which were damaged by the reckless and/or negligent actions of their employees and subcontractors.
 
We have repeatedly tried contacting Pulte's local representative, Ryan Kibler to ask him to come to our property to show us how he is obtaining the measurements he keeps quoting because they only make sense if one assumes our property line ends midway through our driveway, which obviously is not the case.  However, he has refused to meet with us and we have not been able to get a return call from him.  The HOA has told us repeatedly now that the adjoining home is NOT allowed to be within five feet of our home. As of today, the structures inside the hole adjacent to our property are at most 3 feet from the property line. This is unacceptable.
 
Businesses should not be allowed to trick customers into purchasing through them and then to fail to follow through with assurances.  It is also disgraceful that local management with Pulte chose to dig a hole less than 2 feet from an elementary school bus stop when they knew that would be a hazard and when- by the admission of their own field manager--they could have placed the home several feet further away and avoided this hassle. The impression we have gotten is that Pulte knows they screwed up and are refusing to even try to fix this because it would slow them down or cost them money. This is not an acceptable business model.

Pulte Homes of Indiana has been in communication with this customer since this concern was brought to our attention. This customers concern is understood, however we are not able to relocate how a home is positioned on the lot after the basement is excavated. The home in question, and all parts...

of the excavation are contained within the property owned by Pulte Homes of Indiana. No part of our construction is damaging or inhibiting this customers property. Due to the safety risk of the excavation next to this closed home, we have installed 4' safety fence along this property line. This excavation will be back-filled with dirt at the completion of the foundation phase in the next few weeks.At the time of purchase 2.5 years ago, there was no way for Pulte Homes of Indiana to set a clear expectation as to total distance of the side and rear yard dimensions in relation to future homes. The community has minimum distances that are required to be met, so the minimum is the only information we could give at the point of sale. All of our homes have varying widths and depths, and until a lot is sold, those dimensions will change depending on what homes are sold on different lots. Every customer has the same opportunity to chose what house plan and lot they want. Certain homes will not fit on some lots, and in those situations, if a specific house plan is desired, a specific list of list needs to be chosen from. The home we are building on the neighboring lot in question, meets all setback requirements for the community and City of [redacted].
Although we do understand the position of the customer, there is no further action Pulte Homes of Indiana will be taking. All steps previously taken and future steps have been reviewed and approved by the appropriate parties in order to build this home correctly.

On Thursday, 3/3 a Pulte Homes of Indiana representative met with these customers, now that the foundation on the lot next to their home was to a stage that we could pull measurements. As verified by all present, the home in question measured out to be exactly where it should be per the surveying documents. We understand the customer may not approve of the placement of this home, but Pulte Homes at no time put a foundation in the ground that did not meet/exceed all community and zoning requirements.
As to the concern of damage to a vehicle and plastic play set, we were told the vehicle was not there and was a family members. The first we heard of any personal property damage was the receipt of this complaint back on 2/25, which was well after any large machinery was on the lot. As to the plastic play set, Pulte Homes has offered to compensate the buyer for any replacement parts needed. It could not be verified that the damage was the fault of Pulte Homes.
In response to the claim of trickery or fraud, we ask the customer to please reference their sales contract. At no time has a representative of Pulte Homes willingly attempted to mislead this customer.

I have responded to each communication. I do believe the leak has been fixed, but they have not responded to my concerns about the odor. The leak was located by way of a water test.
