Dear Mrand Mrs [redacted] , we regret that you feel that we are stalling on the completion of your escrow items This is genuinely not the case The sod cannot be laid and final grading cannot be completed until the soil dries Your area has received a tremendous amount of rain over the last several weeks Every day of rain delays items of this nature future The equipment need to complete this work is sitting in close proximity to your home and you yard has been given priority As soon as the weather cooperates and the dirt dries enough for our vendor to work in the sod fields we will complete your yard We appreciate your patience as we work to complete this for you Kind Regards, Pulte Homes Customer Service

To Whom It May Concern: The General Sales Manager, [redacted] , met with Mr [redacted] and his realtor on Thursday December 1st to discuss cancellation and refunding earnest money They informed her at that time of their concerns with construction and the building processShe explained that the Builder would address any items prior to closing and that they would deliver him a complete home She also reminded him that we do not allow anyone to close on a home until they have signed off that they are satisfied Ms [redacted] offered numerous solutions to alleviate those concerns including covering the costs of a private inspector of their choice Mr [redacted] informed her that he no longer wanted to move forward and that no solution would work for him or his familyI let him know that we would not be refunding earnest money due to buyer’s remorse per our purchase agreement We have sent out the cancellation agreement and it remains unsigned by Mr [redacted] We have also sent him a letter from our closing department letting him know that we will be cancelling the contract

The local contractor we are using for Georgetown is currently trying to work with two vendors to get the worked completed for the customer once he gets things worked out with the vendors he will reach out and get with the customer to get everything scheduled [redacted] Sales Administrator Indianapolis-Louisville Market Office: [redacted]

Pulte Homes has addressed the concerns this customer has brought to our attention. Some concerns were not warrantable due to not being outside of performance tolerances of the home set forth in the Pulte Protection Plan warranty coverage. Specifically to the concern of reimbursement for the interior... painting of the customers home, the customer had been advised on numerous occasions, prior to the customers vendor performing the work, that Pulte Homes will not reimburse for this cost. The customer did not like the original color of the paint within the home that she purchased, so repainted the interior of the home a different color. This cost will not be reimbursed by Pulte Homes. Should the customer have any other warranty concerns, Pulte Homes will work with the customer to resolve them.

Ms [redacted] is concerned that some homes in her area have not yet received sod and in general is dissatisfied with the amount of mud in the area Although, she mentions her escrow items as a concern, they have been completed We did ask for her to submit documentation if our records are wrong, but this has not been supplied and she has not disputed that she has in fact received her escrow items We then believe her main concern is with the condition of the yards around her home We regret her dissatisfaction regarding the near by yardsConstruction in an area can sometimes cause unavoidable inconveniencesWe recognize that yards that are incomplete can be unsightly We further recognize that inclement weather can create mud in such areas We clean the streets periodically to help alleviate this issue At present the streets are in acceptable condition We regret her dissatisfaction regarding the unfinished yards and sidewalks,However, they are in the construction process and it can take several weeks for these items to be complete During the cooler months we are unable to install yards, sidewalks and the like When the weather warms there is a backlog of homes that require work This can take some time to correct Although we apologize for any inconvenience this may create for her, it is a time consuming process which we have attempt to explain We understand she would like things to move faster but there is no obligation to Ms [redacted] that has not been met Pulte Homes is committed to completing the yards inside of our individual contracts with the individual homeowners of the properties in question We have asked that she let us know if there are issues with her home and her yard but have not received any such concerns At this time there is no immediate action to be taken on the part of Pulte Homes as there is no outstanding obligation that has not been met The issues reported are known and slated for repair or installation as time and our individual contracts with others allow Pulte Homes Customer Service

I am rejecting this response because:
There were other stipulations to the finance documentation that were concerning, not only the interest only disclosure, but other inclusions that I could not consent to. Document *** is a "Savings Plan" commitment which I had to agree with and commit to and changes would "affect...loan approval". I have never in any finance purchase agreed or seen a "Savings Plan" clause that could affect the loan approval and this was not initially disclosed prior to initial commitment (and there is a list of consumer complaints online which claim the "unfair" adverse impact of such clauses www.consumeraffairs.com/housing/pulte-homes.html)I have included my reasoning for requesting refund under the attached finance addendums and highlighted. There are numerous instances within the document that plainly state instances of the buyer being entitled to refund and the document prevails in disputeThere is not much more I can say if the company is refusing to acknowledge my grievances under the Uniform Commercial Code Article 3-303. Their loan process and sales process puts buyers at a disadvantage because they do not get to make a fully informed decision until after money is exchanged and then they seemingly attempt to coerce or extort (not to be exaggerated but by definition "threat" to retain deposits even with numerous clauses mentioning buyer return of deposits as in Finance Addendum). That is what I have had to deal withLastly, I tried other remedies in trying to bring awareness to this kind of issue of and then it may seem others could be victim to depriving of deposit in instances where it would not be right. I feel I reacted promptly to concerns and issues with Pulte and tried to address them immediately within days (business days) of initial transaction and am just now being told I am in default of contract after numerous communication attempts finally have to hear back in writing from Management through Revdex.comPulte should also be aware, related to this same issue, I have attempted to file a criminal complaint with SAPD (Case # ***) under Texas Penal Code Chapter Offense Against Property as I am disputing that I could not have had effective consent given the circumstances (i.eswindling, deception). Additionally, I have filed a complaint with Texas Attorney General Consumer Protection Division case ***. The resolution is simple but Pulte maintains there position and I maintain mine

December 4, UPDATE from consumer.A local contractor was finally hired and did come to our house and he fixed our doors/trim work, flashing, window shutters, our kick boards around our kitchen cabinets, and he left us outdoor paint so we could repaint or front door. Things that still need to be fixed are our sidewalk leading up to our front door is not level and water stands against our foundation. There is dried concrete all over our brick leading to the front door from where the poured our sidewalk and we would like to have that cleaned off. We need excavating work in our back yard because when it rains we get a stream that leads to a drain. If it rains a lot water will stand in our yard. Thanks again for your help!*** ***

There have been plenty of nice days this summer seasonPulte employee's are simply irresponsible in ordering the material on time and staying focused on one taskI have many of text messages from the management in my subdivision where we have texted asking what the plan is? since its not raining and the ground in completely dryseveral times the excuses was simply material ordered wrong and that's going to take another week or soWhen I drove down to ***'s where Pulte was suppose to order the type of material from them, ***'s management stated there is no reason for this type of material to be on order since we keep plenty in stockMagically the same day block was delivered to the houseHowever not enough block was delivered that put the project of for the next weekSince it rained the remaining the of the weekLater on they have delivered palets of block which we told the pulte management wasn't going to be enough but Mr *** wasn't listeningThe next week they came and ruff graded the yard and leftnothing additional has been done sinceYes past Monday it has been raining and I completely understand they can't grade when its rainingMy whole point of this is when we called Mr *** to tell him the wall wasn't finished when are they coming to complete the wall before the rain moves in later that afternoon he was under the impression that the wall has been completed.!! He even wasn't on top of his game on our projectI have asked him to stop by the house and see the progress that his contractors are making and he did and he also gave us more excuses why the job is going so slowEvery time Pulte contractors finally show up to do the work they always show mid morning and usually not ready to hit the ground running (no material or equipment) It is hard to believe that we are waiting on our sod and everything else that Pulte has to do since Early MayIt is almost August and we still have mudThis is unacceptable

Pulte Homes sincerely regrets the homeowner's perception that things could have been done more efficiently and more expediently. However, Pulte Homes continues to work to install the escrow items for the homeowner per the terms of the signed warranty documents Pulte Homes wants every homeowner's experience to be positive and has prioritized this home as much as possible to ensure a timely installation of the yard and wall. Regrettably,, weather is a determining factor, as is material and contractor availability. The amount of rain that the area has received has created a backlog of work for our contractors. We regret any delay, and continue to work to have the items completed as timely as possible

We have been in contact with the homeowner and have set up a time for our construction manager to come out and look at these issues and get the repairs set up ASAP for this homeowner.

We have been in contact with the homeowners they are making a list of all issues that need to be fixed, our Construction manager has an appointment with the homeowners to address all issues. We have also hired a local contractor that will help us resolve all of the issues.

Pulte reconsidered the offer of reimbursing Mr. [redacted]'s earnest money.  Mr. [redacted] has signed a termination agreement.  At this time, we believe the matter has been resolved and there is no further action to take.

The General Sales Manager, [redacted] spoke to Mr. [redacted] when she was at the Champions Park office over the phone.  He explained to her that he was upset with the closing costs that were disclosed to him when he applied and that he was also upset because he had been given an interest only loan option.  [redacted] reviewed his contract and his Home Affordability Tool that was signed as part of his contract.  It showed an estimate of closing costs on an FHA loan that was in line with the closing costs given by Pulte Mortgage Company.  She also verified that he was given an FHA loan option and not the interest only option he described.  [redacted] explained to Mr. [redacted] that if he wished to cancel his contract then he was able to do so but would not be receiving an earnest money refund.  He became very upset and asked in what cases earnest money would be refunded per the contract.  Jaci then explained that we refund earnest money in the case of non-approval and contingency contracts which did not apply in his case.  Since he is looking to cancel his purchase agreement and has not been declined by our mortgage company nor is his contract contingent then he is in default per our contract and his earnest money is non-refundable.  This will be our final decision.
