Dear Sir/Madam: Pursuant to the Sales Contract entered into with the complainant, customer was required to immediately return the dog to our store location. We ask this, because if there is a problem, we have a Veterinarian on staff and a Veterinarian under contract with us. This saves veterinary... costs for customer. This particular dog was just certified as healthy before it was purchased. We were not pleased to find out that the dog was taken on a long car trip to [redacted] ***, upstate. New York State's Lemon Law limits our liability to the cost of the dog purchased plus sales tax and the cost of the "unfit for sale" letter from the Veterinarian. We are not responsible for customer's Veterinarian. In any case, because of the distance from our store, we decided to return to the customer $1000.00 (purchase price of the dog) and another $1000.00 in good faith. The customer has evidently decided to not cash our checks and instead has initiated a civil suit in Small Claims Court. I guess the matter will have to be determined in Court pursuant to the limitations provided in the Lemon Law. Section 753 (a) permits the customer to return the dog and receive the purchase price back plus applicable sales tax. She will also be awarded the cost of the "unfit for sale" letter from the Veterinarian - usually about $25.00. This will be considerably less than what we offered her. We apologize for the inconvenience, but the solution we offered up front was very generous. Thank you for your attention to this matter.

Attached are the documents that were required by Pup Slope establishmentThe owner stated that he returned the purchase price of $which included the tax which was incorrect if you view the attached purchase/guarantee/health documentIt also guarantees the health of the puppy from life threatening illnesses up to weeks from purchaseThe time lapse between purchase, hospitalization and return of the sick puppy was days (purchased 12/**/15, hospitalized 12/** -12/** and returned 12/**/15)I stayed in contact with the establishment the entire timeThe document also states that I must take the puppy to my vet with in hours which was done within hours of purchase, the puppy was diagnosed with *** *** and had to be hospitalized for two days before transporting the puppy back to the establishment, where it was purchaseNo where in my documentation did it say to return the puppy to be seen by the stores veterinarianI complied with the hour doctors visit and the return policy before the week deadline after purchaseI submitted the certification of unfit for sale which is attachedAlso attach is "The sale of Dogs and Cats NoticeIt states that I have day if the animal is unfit for purchase due to illness, to return the animal and receive a full refund (which I did not get), or receive an exchange (which I did not want) or retain the animal and receive reimbursement from the pet dealer for veterinary services performed by a licensed veterinarian of the consumer's (my) choiceI chose to return the animal because the owner refuse to pay the charges for the veterinarian that I was advise to doI did not cash the two checks for $ each because there is a balance due of $that would be null and void if I didI did file a civil suit to recoup the $and if necessary, I will report the owner for violating the law pursuant to the Law the Commissioner of Agriculture and Markets put in place for merchants like the owner of Pup Slope to followIn addition, the puppy purchase was not vaccinated for kennel cough which cost me an additional $(which I did not charge the store owner for) to vaccinate the other puppy purchased with a boosterIt is sad that a consumer has to be victimized by merchants that do not stand by their word and the Laws set in placeThere are more documents

Hello:Your website would not let me log in because it did not recognize my EMail address. Accordingly, I am using this portal to respond to [redacted] answer to our response to her complaint.As [redacted] correctly states in her response to our answer to her complaint, she had 14 days to return the pet to us for a full refund of the purchase price of the dog and the tax. She did return the dog in question within 14 days and we refunded $1000.00 plus an additional $1,000.00. She is seeking additional money for Veterinarian fees beyond the cost of the dog. The Pet Lemon Law limits our liability to the cost of the animal plus tax. Had she kept the animal, she could have demanded Veterinary fees, but she chose to return the dog to us. The extra $1,000.00 we sent her covered more than any incidentals we are obligated to cover. She has refused our offer and is suing us in small claims court where her recovery is limited to the cost of the dog plus tax and the charge from her Veterinarian for writing an "unfit for sale" letter.If she would just read her own quote from the Pet Lemon Law, she would understand how generous we were with her.I don't know what else we can do for her now that she has started a Civil Court case against us. We will have to let the Judge explain it to her.Thank you for your help in trying to mediate this issue.SAL P[redacted]
