Complainant Response Contractor contacted my daughter 12/13/during her work hours in which she was busy and unable to respond to him. However, she did respond the morning of 12/14/and offered two different time frame options that he could stop by. I requested that he come when my son-in-law was home as I have become uncomfortable with his demeanorThe contract clearly states that the contract end date was 12/15/17, therefore he could have stopped by the evening of 12/when my son-in-law was home. As for the punch list the contractor deems to be completed, there are several issues that were addressed, that were not finished in manner that is acceptable. There is a screw hole and over sized cuts in the brand new siding which can allow water access behind the sidingIt was requested that all siding seams (joints) run the same direction which is not the case on the back porch over hang. During the course of the work we had to repeatedly point this out to the contractor where lack of attention to detail showed. When contractor gave original estimate he stated that he would have to rent equipment to dig out 4-inches and level the ground then put something down to prevent mud and such from coming through the inches of limestone. He tilled the ground put in 4xtie rails and poured the limestone. NO dirt was hauled away as he stated there would be. He also did not tamp the stone down. It is currently raining and there is standing water and mud in this area. These are just a couple of the problems from the punch list that he did not take care of among several others. Each time the contractor was confronted in regards to an issue he became argumentative complaining that we were "nitpicking" and threatening (just as he is being threatening in his response).On more than one occasion he threatened to put a lien on my home. There were also times when I pointed out issues that we would pack up his equipment, leave and not return to the job for several daysThere was even a 3-week period that he did not do any work at all to my home. When I gave the contractor the punch list as requested he became argumentative yet again and responded with that he would be unable to complete it until March or April. Regarding the final payment the contractor wrote right on his contract "until completion& customer satisfaction". I have pictures showing all issues that have not been addressed, by the contractor if necessary

Homeowner is complaining about quotes and completed punch list itemsI’ve addressed everything listed on punch list and as stated on our final agreement I met all requirementsAfter completing our agreement homeowner failed to meet with me and do a final walk through and didn’t respond back till
the following day in which she breached our contractTwo days afterward her daughter approached me with a statement which was not specifically wrote in a professional matter that had anything regarding my agreements to finalize the contractTherefore the homeowner knowing my deadline insisted on waiting the day after to pursue a meeting; which in turn would make me seem to be at fault for not completing the agreement on timeI informed the daughter that I had no other choice but to take legal action and therefore I did in fact take a lein on their home: I repeatedly tried to accommodate the owners request but unsurprisingly everytime I would complete one request I would for some reason accumulated two more: Make mention also that in the event of providing my services to the homeowner I have different employees that worked on these premises during The Whole job from start to finish: If necessary I have character witnesses that will testify to the continuous request that were completely obscure And also I would like for the homeowner and anyone in her family to understand that if they discredit my business or slander my name I will take futher legal action

Mr O*** understood the scope of the job and had a thorough discussion with us and looked at a number of photos of all sides of the home. We had a painter linand ready to begin when Mr O*** begged us to let him do the job. Since he had done a decent job on one house we relented when he underbid the painter we had planed to use in Florida. We signed a contract which spelled-out what the job was to entail. No part of the job was done. There was absolutely nothing in the contract about recouping any travel expenses in case he chose to dishonor the agreement. He did dishonor the agreement and complained that the job was bigger than he thought and would take a lot more time. He suggested that he would want to tethe agreement and write one for more money. In fact this is what he did on the first house. When he seemingly, suddenly realized that we expected him to paint the first house a certain wayhe insisted that we would have to pay him more money. We reluctantly did, in that case. We feel that this may be his MO. That is, agree to a lower price then change the price after he has the deposit. Very deceptive and immoral. Since Mr O*** took us down this deceptive road, we have lost our time-slot opportunity with the originally planned painterThey moved on and we have to wait an extended period of time before we can have them do the job.WE HAVE RECEIVED NO REFUND OR ANY COMMUNICATION from Mr O***. He claims to have sent or given us our refund on or about August or 9. WE HAVE NOTHING. He has our $2,and we have nothing.One last unsettling thing, Mr O*** seems to think he can enter un-announced into a clients home at will. He did this several times at the first house he painted for us. This is bad behavior and he should know it

Mr O[redacted] owes me a full refund of $2,000.  Our contract included no provision for payment of any kind for work not done.  It mentions nothing about covering travel expenses especially when no work is done.I will send a copy of the contract to you (Revdex.com) very soon when I return from my buisness trip.  By the way, why doesn't Mr O[redacted] send you a copy of the signed contract to show he is entitled to some compensation? This man is deceptive and un-trustworthy.  He "baits-and-switches" the price.  After he gets a large down payment, he comes back saying he needs more money.  We fell for this once with him.  And he attempted to do this in this case too.
