My personal trainer was fired from Pure Body. When I first signed my 6 month contract, I signed in good faith that I would have a specific trainer.Problem Date: 2/20/2015. Pure Body didn't notify me that my trainer was terminated. I called to speak with management, no one was in. Called the cell phone of[redacted]. He told me he would call me back that evening after he discussed the situation with his business partners. Never called back. I text him on Saturday saying that I never heard from him and that I could stop by the studio. He responded and said that we could have a meeting on Monday at 5:30. I received a text from[redacted] on Monday afternoon, saying that I didn't need to stop by the studio and that he would call me at 5:30. He called me after 6:30pm to discuss my contract. I signed a 6 month contract with Pure Body for personal training with [redacted]. [redacted] was terminated on Thursday night after my personal training session. I decided that since my trainer was fired that I wanted to break my contract because my trainer was gone, and I didn't feel respected as a paying customer. (Never notified about time changes, or that my trainer was fired.) Since my payments are automated I am being billed $360 for sessions that won't be with trainer [redacted]. After talking with[redacted] he told me that he understood but that they were unable to refund my payment because I'm in a contract. I told him that my contract is null and void since my trainer was terminated. I signed in good faith that [redacted] was going to be my trainer for the 6 month contract.[redacted] told me that I could train with a different trainer for the remainder of my contract. I said that I didn't want that and I wanted to be refunded on my payment that was billed to me after my trainer was terminated.[redacted] wrapped up the conversation with Pure Body not being able to refund my payment and that I could finish up my sessions with a different trainer. I told him that it is bad business and that I am very unhappy as a paying client. Personal Training sessions aren't to be tossed from trainer to trainer. I was told I was going to have [redacted] as my trainer and he is no longer with the studio. I should have never been billed the $360 if I wasn't going to have my trainer.Desired SettlementI am seeking $360 refund.Business Response Member signed a 6 month contract for personal training on 9/19/2014. Our personal training clients have the option to choose their own trainer when starting on their personal training program.Although we make every effort to ensure that each client has the same trainer throughout their entire training term, we make no guarantees that a specific trainer will be available to the client during the entirety of their training term.The company parted ways with the clients trainer on Thursday evening. Client called the facility in the afternoon the following day before someone from the company had the chance to contact the client and notify her of the trainers termination.In the unfortunate event that a trainer is no longer with the company while having an active client roster, our clients are assigned a different trainer that is deemed appropriate/a good fit for the client by the studio. This policy is clearly stated on the back of the personal training contract under "Pure Body Fitness Policies", line number 4.

Purebody fitness was advertising a free 20 minute consultation of their studios. On 9-26-14, I noticed an add posted on their door saying that plus a 100% money back on the spot if anyone was not satisfied with their services. I had been looking a gym for a long time but was disillusioned with all of them bc of their contracts & I did not want to do that. I was looking for one that you could pay per session & that's exactly what the studio consultant , [redacted] told me I could do.I went for the free 20 minute consultation & while I was there was told that before anymore information could be given yhst I needed & had to fill out this form with all my information . I was under the impression & even asked [redacted] that this was not a contract right? & was reassured many times that "No" it was not a contract. I would never agree to anything unless I had given it overnight thought . We did discuss personal training prices afterwards & then he cleverly wrote all this information in the form which I then started to question him but again he continued to say 'don't worry this isn't a contract & nothing would be charged to me upon an agreement . After returning home & starting to realize that I could not do this nor afford the fees that [redacted] had discussed during the consult, I knew that I could not do this now. I also told [redacted] that I was disabled & did not want to join this fitness studio. [redacted] called me the next day & I said that I did not want to join at this time & did not want to be charged. I was reassured again this was fine & would not be & was also told again about there 100% cash back policy. I didn't worry about anything until 3 days later when I received a call from my bank telling me that my funds were insufficient & needed to make a deposit before closing that day. After funding out what it was, I was so upset & could not believe how this could be happening especially after everything I was told by [redacted].I need help because Purebody is now saying that I owe $540 now & then again Nov 6thDesired Settlement$540 now & to not be charged another $540 on nov 6thBusiness Response Customer signed a personal training membership agreement and did not follow the rules and regulations as outlined in the membership agreement. Customer states that our employee informed her the signed document was not a contract, which is incorrect as our employees are instructed to outline the details of each agreement/contract for services to customer prior to signature.Before signing the contract, our employee outlined the billing terms and details for services to customer clearly. As per our 30-day money back guarantee policy, it is outlined on our website at([redacted])and it states the following:1. In order to be eligible for a refund, client must attend the agreed upon number of sessions stated on contract each week and follow the program guidelines.2. If client does not see a noticeable reduction in body-weight and inches lost within the initial 30-days of training, client is eligible to receive a full refund of fees already paid.Since client has not attended any training sessions as of yet and does not meet the conditions of our refund policy, a refund cannot be issued at this time.

I was told that if I Signed up on that day I could receive a deal and once I was cleared by my doctor my membership would then become active. I never had the opportunity to work out at Pure body Fitness. I went in Mid May 2015, shortly after having surgery to inquire about joining. I met with [redacted] who was very nice and he encouraged me to sign up although I was unable to work out due to not being cleared by my doctor. He told me to sign up that day to get the special rate and when I was cleared to let him so he could make me active. Yes, I am the big dumb person that fell for that! I called [redacted] early June 2015 to let him know about my situation and I was still not cleared to workout due to complications from my surgery. I have both phone records and doctor's notes to prove it. I left a message for him and never heard back. I noticed that my card was charged in June so I called to find out why. While we were trying to sort through all my different documentation and my card was charged AGAIN in July. I was still not cleared to workout at this time. At this point I wanted to have a meeting with [redacted] and the management to sort out what happened, but they refused to get [redacted] involved. In July I spoke with the district manager [redacted] and we had lots of email correspondence. He told me in late July that he was going to try to get my money back and reach back to me shortly. In August 2015, I contacted him again and he was still working on it. I sent many emails since then and no response. On 1/25/2016 I decided to just go up there as I heard that [redacted] was going to be at Pure Body Fitness. I met a girl in the lobby with a similar experience who had a meeting with [redacted] at 4:15pm. She told me that I could come back with her to express my concerns. I told her I would happily wait my turn. [redacted] (another manager) tells me that [redacted] refused to meet with me so I joined the girl who I met in the lobby so we could voice our concerns together. [redacted] began to scream and yell at me so for my safety I began recording. At this point he is so mad he calls the police on me. Thank goodness I have everything on camera! I left his office and waited for the police to come. The officer was very nice and told me that [redacted] said I made threats to him. Mind you I recorded our interaction and there was another customer in the room. After that I took a copy of my contract and left.Desired SettlementI would like to business to refund $400 Business Response Members sign agreements electronically so that once the agreement is complete, they are automatically emailed a copy. By NC law, members have 3 days to cancel a signed document if they do not wish to fulfil the commitment. The email address she gave her Fitness Consultant was [redacted]@live.com. She was also given a 14-day trial period, which allowed her to cancel in the 1st 14 days, but she continued instead as a member after her initial 14 days. Her first month was $90 in May with $1 enrollment fee. She did not mention any need to cancel until June when she was getting calls about late payments. She gave numerous medical condition excuses and other excuses, and when we asked for documentation (nothing invasive) she never provided any. She eventually met with our Operations Manager at the time who cancelled her contract immediately instead of giving the 30-day notice of cancellation like members are supposed to do. [redacted] was late in paying June so she incurred a service charge and a late fee. She's asking Revdex.com for a $400 refund, but she only ever paid $304 total. She wants a refund for the months she never used, but because she was still a member at that time and the space was there for her to use, she cannot be reimbursed. Her contract was cancelled, when she really should owe $810. Our sales manager offered [redacted] time to utilize the facility at no cost for 3 months to help mediate but she said if she were to ever see [redacted] she would choke him. So that offer was taken off the table and she was asked to not come back. In January, she was well enough to come in the studio and pick a fight with the district manager and record everyone on video for no reason. Mean while, she broke into his office while he was in a meeting with a member. He asked [redacted] to schedule a meeting with him at the front desk, but she continued being abrasive. At one point she was told she was not going to be dealt with as long as she continued filming, so she hid the camera behind her back and said she stopped while she had actually continued. She was asked to leave and would not, so before things escalated, the police were called to have her removed. She was given a copy of her contract, and the officer walked her out.Consumer Response I was not offered the 14 day trial, I signed up for the 21 day money back guaranteed. I was told that if I paid that day that I could start once I was cleared from my surgery. I was not cleared due to complication and I contacted Jacoby (documentation to prove it and offered to share with management, but they refused to view it).I feel that having cervical is invasive. After my surgery I developed a very serious staph infection and was told by multiple representatives from Pure Body Fitness that I could still work out at Pure Body Fitness with a staph infection which had caused open sores all of my body. I showed the infection to staff and they didn't care. Two doctors provided documentation that I should not work out due to how serious and contagious the infection was. I DID NOT threaten [redacted] I didn't want to go to a gym where staph infection isn't taken serious because I value my health and the health of others, which is why I declined their offer of using the membership any further. Furthermore, having a sales rep lying to my face and tricking me into signing up, a managing staff who could care less about the pain I was going through and an owner [redacted] who refused to return calls, emails or schedule a meeting, I knew this wasn't an environment for me. In January I came into the studio because the owner [redacted] had not contacted me for 5 months after he promised to get back to me was finally in the office I decided to drop in. While waiting in the lobby I met a girl named [redacted] who had a similar experience as me that she was there to discuss. She said she had a meeting with [redacted] and I was welcomed to come in with her, but I told her that I would wait my turn. I sat in the lobby to wait to speak with [redacted] when [redacted] (another former member) went into his office. Once [redacted] was in his office [redacted] who is a district manager came out and told [redacted] would not see me that day and I needed to make an appointment. I asked her how can I go about making an appointment and I was told that I needed to email him. Please keep in mind I have been emailing him since August 2015 and received no response. I was again invited by the [redacted] (another former member) since [redacted] was almost 30 minutes to the appointment they had scheduled to come into the office with her. When [redacted] saw me he went crazy so I was forced to record it so I could protect myself from any lies that may come out. I informed [redacted] that I was ok with him calling the police and waited almost 20 minutes for the officer to show up. [redacted] told the officer that I threatened them and wanted me off the property. The officer provided me a copy of my contract (something else I was asking for over 5 months) and I left. After this occurred I contacted the police station to request a copy of the police report to share with my lawyer. The officer didn't write a report because he didn't feel a need as I was just there to get a copy of my contract and speak to [redacted] about my concerns. The officers completely understood my complaints and felt that I was no threat to anyone there. At this point I doubt I will get my money back but this is a warning for all, beware of this gym. Feel free to send me an email if you would like to see the video of [redacted] going crazy or want to be connected with other members who had terrible experiences. Final Business Response In the detailed description of events submitted on 2/9/16 by Pure Body Studios LLC I believe we have illustrated that we were not at fault in our dealings with [redacted]. We were extremely accommodating. [redacted] signed a membership agreement. Members have 3 days to cancel a signed document if they do not wish to fulfil the commitment. Additionally, she was also given a 14-day trial period, which allowed her to cancel in the first 14 days. She failed to pay her first installment of membership dues on time and only mentioned her desire to cancel because of a medical issue when we reached out to inquire about her failure to pay. Any member seeking to cancel based on a medical condition must submit a doctor's note. She didn't provide any proof of a medical condition that would prevent her from being able to participate in physical activity but the Operations Manager made an exception and as a courtesy cancelled her contract immediately. When [redacted] came to the fitness studio her demeanor was abrasive, confrontational, and disruptive in our place of business. We believed the best resolution was to cancel her membership agreement and not attempt to collect the fees she still owed to us.

Full Refund On September 14, 2015 I met with [redacted] C with PureBody Fitness to sign up for a 30 Boot Camp for $97 that was supposed to begin on Monday, September 21st, I received an email on Sunday, September 20th stating that due to construction Boot Camp would not begin until Monday, September 28th, on Monday, September 28th I received an email stating that Boot Camp would not begin until Monday, October 5th again until construction was completed. It was advertised on their website and the email promotion I received that class would be Monday, Wednesday and Friday from 5:15pm - 6:00pm. After 2 weeks of class starting late I arrive to the Studio and the Front Desk employee who wasn't very knowledgeable or friendly advised that class didn't start until 5:30pm and proceeds to give me a generic schedule of classes and states she didn't know which classes were Boot Camp Classes. The first class was not at all what was described during my meeting with [redacted] on September 14th. After the first class on September 14th, I immediately call the studio back and requested the refund policy the front desk employee again was not very knowledge advised I speak with [redacted] - I asked to speak with [redacted] and she quickly stated he had just left the studio and to call back on Tuesday. I then called [redacted] cell # and received an answer and requested a refund and the policy. He then at that time would not provide the refund information but proceed wanted to know why and advised he would reschedule my fitness assessment and he would email me after the call to meet and discuss options as well as he wanted me to try one additional class - he then stated if I show up. Later that evening (October 5th) I did not receive an email from [redacted] On Tuesday, October 6th, I contacted [redacted] C via email regarding the refund policy. As of today, I have not received any reply or phone call from [redacted] Body Fitness regarding a refund. Due to false advertising of class descriptions, start times and actual start date and no response from the company I would like an immediate full refund of $97.00 in the form of a check mailed to me. In addition, I am also concerned with the security of my credit card number - after I paid on September 14th - [redacted] called me back after normal business hours stating he could not find the form with my credit card number - only to find during the call he found the form. In addition, the refund policy was not outlined or filled out on the form that was signed during the September 14th meeting with [redacted] Again, I would like a full refund of $97.00 mailed to me in the form of check immediately. And I want to be ensured that Pure Body will not try to bill for any future services.Desired SettlementMailed me a check for $97.00 immediately Business Response /[redacted]/We have been made aware of this situation. Our response time and ensuring that our members have the fastest and the most direct access to Information is always key priority. We apologize for this Inconvenience and miscommunication. When your matter was brought to our attention. We had mailed out your refund check to only be returned as Un -Deliverable. We will try again with the Information on hand. We will mail out this check by Fedex, overnight. Please call [redacted] at XXX-XXX-XXXX to get the tracking number if you would like. Thank You, [redacted]

We signed our daughter up for a classes at the studio in July. We were told we could cancel with a 30 day notice. Just tried to cancel and could not.We were told numerous times that cancelling requires a 30 day notice. No problem.We were NOT told that we entered a 1 year contract. If that was the case, we would NOT have signed up at Pure Body Studios.I called today (September 30th, 2014) to cancel my daughter's membership (she is 14) and was told about the 30 day notice and to call an 800 number for [redacted] since they handle the cancellations.I called the 800 number and was told it was a 12 month contract. They could not send me a copy of the contract. They claim they need 10 days to get a copy from Pure Body to review it.Called Pure Body Studios back and [redacted], a supposed manager who has only been there a month, was very rude in stating that she personally did not sign up our daughter and therefore the 30 day cancel was never discussed.This company operates without a clue.My wife was told about this 30 day cancel policy when our daughter took a 7 day free trial. After that time, I signed her up and was told again that it was a 30 day cancel policy.We want the membership cancelled. We are okay with the 30 day notice/cost.Desired SettlementCancel our daughter's membership.A charge was taken today (September 30th) for the next 30 days. This is the LAST charge that we owe to Pure Body.Notify National Fitness to nullify the contract. Complaint. I had a year-long contract with them beginning in April of 2013. When April 2014, this year, came around, I spoke with the front desk employees to ask what I needed to do since my membership was almost up. They told me I didn't need to do anything, my membership would turn into a month to month basis and if I wanted to cancel at any time, I could give 30 days notice. I just found out I will be moving in 3 weeks and called them to give my notice of cancellation. They sent me to the company that does their billing - [redacted]. This company said that Pure Body sent them a signed 12 MONTH contract and I am locked in for another year and there isn't anything I can do about it. The representative sent me a copy of this contract because I had no knowledge of signing anything. Pure Body forged my signature without my knowledge in order to lock me into another year. In fact, the signature doesn't even look like an attempt at all - doesn't look like my real signature and definitely not my handwriting. I am trying to get as far away from this gym as possible and want them to stop billing meDesired SettlementI want them to stop billing meBusiness Response Evening, Facility made a mistake. We have a member by the same first and last name. Her agreement was up for renewal, we renewed the wrong agreement in this case by mistake. We contacted this [redacted] and explained the mistake. She was understanding and our staff apologized. We corrected and cancelled her account. This Member was notified of this and agreed to drop the Revdex.com case. My friend and I purchased a $30 [redacted] on September 30, 2012 for one month of unlimited hot-yoga and other fitness classes at Pure Body Fitness Studios. We didn't use the [redacted] until late January. For one month we took fitness classes at Pure Body Fitness Studio, and at the end of February we were approached by an employee named [redacted] (who is no longer employed there), to sign up for a 6-month or year long membership. At this time, my friend and I knew we would be moving out of state in a little over two months and could not commit to anything long term. We told [redacted] of this, who then offered us a special two month deal. This deal was that we would pay for the month of March at a student discount of $39.99 and we could get the second month, April, for free. Because this offer was for only two months we decided to take advantage of it. We did not sign any form of contract to legalize the two month membership or commit us to anything more then that. So for two months we enjoyed the services of the studio and went to our last fitness class there on April 24, 2013. We did not go to the studio or partake in any more fitness classes after that date. While checking my bank account on December 16, 2013 I realized the studio had charged me $39.99 for six months starting in May. They also charged me an extra $29.99 amount in November. I addressed this issue to my friend, who after checking her bank account, stated they had done the same to her. We approached the studio and asked for a full refund of the payments they charged us in May thru November and a cancellation of any further payments. An employee named [redacted] told us they would cancel the withdrawal of any more payments, but would only refund us for two months plus the extra $29.99 ($109.97 out of the full $309.92). My friend and I did not sign any contract permitting them to continue charging us a monthly fee nor did we utilize the gym or any of its resources after April, which is why I would like a full refund of $309.92Product_Or_Service: Fitness ClassesDesired SettlementI want a refund of all the fees taken from my bank account by Pure Body Fitness Studios between the months of May and November at a total amount of $309.92. Business Response Customer signed a membership agreement and did not follow the rules and regulations as outlined in the membership agreement. Customer was basing her facts off of a conversation with an employee. Since we don't do business on verbal agreements, the company stands behind its policy. Pure Body has spoken to this customer and understands her frustration. We can not know what was outlined in the customers conversation with our employee.But we can see that what the customer is saying has basis. According to our workout check in records this customer did not use the facility as she mentioned in her complained. This would suggest that indeed she moved.Due to the customer not having any record of working out with us in the time frame as outlined by the customer. Pure Body has taken all of the circumstances surrounding this case and has decided to refund the customer in full. Customer has been refunded and notified. Final Consumer Response I did not sign a membership agreement. The agreement being referred to was signed by their own employee with the letters "SOF." I can only assume SOF stands for signature on file. My signature that they have on file is one on a "Trial Pass and Drop-In Acknowledgement" form. This form addresses the "Member's Health, Waiver and Release of Liability, and Trial Period." This form has no reference to a membership contract and was signed a month before I was approached by the same employer to sign up for a membership with the studio. It is clear the signature on the "Trial Pass and Drop-In Acknowledgement" form is not a valid signature to be used on the membership agreement, thus further confirming I did not agree to the terms on the form.I was contacted by an employer on December 26th, 2013 and then by another employer on December 27th, 2013, both of which informed me I would be receiving a full refund of $309.92. My friend and I each have yet to receive this full refund. Final Business Response Refund has been issued and is expected to be received by customer by 01/21/2014Thank you, [redacted]
