directly by Pure Power Boot Camp regarding complaint ID [redacted], however my complaint has NOT been resolved because:
After filing my complaint with Revdex.com, I forwarded it to the owner to inform her that I had taken further action.  She then called me and left a voicemail calling me "ridiculous" and saying it is "embarrassing" that I had filed the complaint.  She offered no resolution to my complaint.

Review: The business is in breach of contract. They promise to refund clients due to medical issues. The business ignores all attempts to obtain a refund. Fraud is intolerable and they should be sanctioned for illegal and unethical business practices. I want the return of my money. I have documentation which justifies my request.Desired Settlement: Refund of $1,300

My name is [redacted]. I am the owner/founder of Pure Power Boot Camp. In response to [redacted] complaint, I would like to address that this is an abuse of what the Revdex.com is all about. It is baffling and disgraceful that [redacted] is trying to use this venue to extort money after he made a commitment and signed a contract with clear instructions and details and then lie about the entire thing. First, let me say [redacted] has been a client of mine since July **, 2012. [redacted] then signed on with a second package with me since he loved it so much the first time on January **, 2013. I offered [redacted] a sale price since he was a recurring client. He signed up for 48 sessions and planned on going for 3 times a week which would be for 4 months ending in May 2013. [redacted] once again signed a detailed contract with all of our company policies stated in it. [redacted] then did not show up to class for the next 3 and a half weeks and disregarded all phone calls and emails that my company and myself had left him. He returned to us on February *, 2013. He apologized to us emphatically for being unresponsive and promised that he would be on track and back on schedule as planned. On a side note, even though my policy states clearly in the contract that if you do not call or do not show; you lose your session. Out of a courtesy, I gave him back all of the sessions he lost during his no communication 3 week period. Once again, another 4 weeks and 3 days went by until he showed up on March **, 2013 with no communication from him again, and numerous phone calls and emails from my staff were left unanswered. 6 weeks went by of radio silence from him again and he decided to then show up on April **, 2013 and swears up and down the line and he apologizes for being such a flake and that it will never happen again. He then gives us set dates for the next 3 weeks of whe n he would show up to class. For the 3rd and final time, I gave him back all of the sessions that he missed again. [redacted] then came in for a week and a half as planned and then started canceling every other scheduled class for the next two weeks every day and rebooked to cancel again. I once again reached out to him personally and left him a few messages. On June [redacted], he responds to one final email and tells me that he is coming back that following weekend. As usual, [redacted] did not show and did not call. I received an email back from him on July *, 2013 after once again my staff and I reached out to him. This is when [redacted] stated that his hands are hurting him and he does not know when he can do boot camp again and wanted to know at that point if he can get a refund. Meanwhile it is 3 months after his expiration on his contract is supposed to be done. I credited back all of his sessions within all the 3 months of no calling and no showing after promisi ng he would come. I reached out personally to [redacted] on July [redacted] and did not hear back from him until July [redacted] when he wrote to me asking if we can have a conversation the next day. Not surprisingly, [redacted] was unavailable that day. Needless to say, I was pretty much done chasing him and going out of my way to accommodate him and his broken promises and unanswered calls and emails. I never once to this day received a letter from a physician stating why [redacted] would not be able to resume activity at Pure Power Boot Camp. Our contract clearly states: “THIS CONTRACT MAY ONLY BE CANCELLED DUE TO SEVERE ILLNESS OR DISABILITY THAT EXTENDED OVER ONE YEAR. [redacted] do not warrant a refund. The buyer needs to provide a letter from the physician (not the doctor's nurse or receptionist) with a full diagnosis and explanation of why the injury or illness will extend over one year." On September **, 2013, [redacted] reached out to me via email and told me he is following up on where his refund is. I am completely astounded by this and not sure how he is capable of even writing this to me after not following any part of the procedure that is necessary. I went out of my way to accommodate him in the last several months as he completely disrespected my business, dismissed all of my company’s policies, broke his promises repeatedly and took advantage of my good will. He then reaches out to the Revdex.com on October **, 2013 and completely fabricates a story trying to tarnish my business reputation. It is unfathomable that [redacted] believes that his conduct is acceptable. It is also unfathomable to me that [redacted] believes that a contract is not enforceable and that rules do not apply to him. I would love to see [redacted]’s “proof” that he claims that he has (but has never sent it to my office) and it is comical to me that he is stating that I am in breach of contract. It is [redacted] that should be sanctioned here for trying to abuse the Revdex.com’s process and lie to try to extort money because he could not fulfill an obligation that he signed onto and agreed to on numerous occasions.

In response to complaint ID#[redacted]. I was so

shocked when I was sent this complaint and was even more bizarre was after I

responded with specific details and specific dates of the truth of what

transpired, [redacted] responds back with the most evasive comment just

stating "the business has not met their obligation and continues to deflect from

the matter at hand." I went into complete detail on how [redacted] took

advantage of my generosity after signing a contract for the second time with my

company and how he disregarded every single rule as well as every single one of

his own promises he made to me. I extended his contract four times and credited

his account for all the sessions he promised to be at then never called or

showed. Seven months after signing his contract and months after starting and

stopping his program again and again he writes that he wants a refund and EVEN

THEN NEVER FOLLOWS PROTOCOL which is written on his contract about obtaining a

physicians letter and stating how his injury will not allow him to do exercise

for over a year. This is exactly what contract says: “THIS CONTRACT MAY ONLY BE

CANCELLED DUE TO SEVERE ILLNESS OR DISABILITY THAT EXTENDED OVER ONE YEAR.

[redacted] do not warrant a refund. The buyer needs to provide a letter from the physician

(not the doctor’s nurse or receptionist) with a full diagnosis and explanation

of why the injury or illness will extend over one year.” I sent over the contract to mediator [redacted] for her perusal. It is a disgrace that business owners have to

defend themselves and their reputation against such people like [redacted]

who believe that rules and procedures do not apply to them and they try to [redacted]. I have as well

as my entire staff gone out of our way to try to accommodate [redacted] to no

avail. Please read my initial response as well as the contract I provided and see that [redacted] is just trying to extort money.

The business continues to deflect from the matter at hand. I need to provide a doctor's note to the merchant. The merchant has not provided a legal mailing address for the business. Please ask the merchant for the legal mailing address. The merchant also needs to research the definitions of "extort" and also "customer service". Please ask the merchant for the legal mailing address.

Review: I purchased two packages for boot camp classes at Pure Power Boot Camp. The first package was for 10 classes for $300 ($30 per class) on 5/**/14 expiring on 6/*/15. The second package was for 5 classes for $125 ($25 per class) on 8/5/14, expiring on 8/*/15. Of those 15 classes, I used 2 and was planning on using the remaining 13 this winter. On Wednesday 11/**, [redacted] emailed all customers informing them that the studio would be closing on Friday 12/**. I emailed [redacted] on Friday 11/**, called [redacted] on Monday 12/*, and emailed her again on Tuesday 12/*. All 3 attempts to reach her were ignored. During this time, she continued to send emails to customers, so she was clearly blatantly ignoring my attempts to reach her. I was reaching out to get a refund on my classes since I live in Manhattan and do not own a car, so I am unable to use those classes at her other studio in [redacted]. Traveling to the [redacted] studio would require me to take an $18 round trip ride on the LIRR and arrange a carpool from the LIRR station in order to get from my apartment in Manhattan to the [redacted] studio, which is an unreasonable hardship.Desired Settlement: I would like [redacted] to refund $365 for the 13 classes that I paid for and will be unable to use.
