I have a house located at *** in Buffalo, New York. My agent's name is Tyler B of Cushman-Wakefield and Pyramide Brokerage. I signed a contract with him on July 7, 2019 to sell my house. I am locked into a year contract, unusually long for a real estate agent. He originally asked for 7 % but we settled on 6%. I did not realize at the time that I am only on loopnet; I am not on MLS, there is no lock box; hence no other agents can bring potential buyers to see the property. The agent says they are strictly a commercial; they do not advertise on MLS. But my property is a mixed use building with an apartment on top of a commercial space. I am told that I am missing 85% of the market by not being on MLS.

Since we signed the contract, I have only been told of 5 potential buyers. The only written offer presented to me was fraudulent from Hong Kong. My agent has been unresponsive to some of my emails with important information (lower the price to everyone; also, he said he has a friend who can get me on MLS but never got back to me; better photos, open house, ... His boss has failed to address my concerns after sending two emails explaining the situation.

I am 70 years old and a severely disabled Vietnam veteran. I have asked to cancel the contact, but I am told I will still have to pay the agent 6% plus expenses-it is in the contract. I think the contract is unethical and that there has been a gross failure of due diligence on my agent's part. And I do not believe the property has even consistently been on Loopnet, which means my agent is doing nothing (and it explains why there have been so few potential buyers to see the property). He said I'm asking too much but when I sent him an email to lower the price (reluctantly as so few people have seen it) he did not respond. I have saved all the emails. He sent me a screen shot of being on Loopnet but this was after I raised the question, two real estate agent friends and a developer could not find it.
