I am enclosing a copy of the "CarFax" which states this vehicle has a clean history. We would be happy to trade with Ms. [redacted]. We would also be willing to pay her the market value for her trade since "CarFax" maintains that there is no history of damage.

This letter is in response to a complaint we received 10/8/15. This transaction originated 5/26/15 and we did not receive a title to her trade until September. This lapse in time unfortunately slowed the entire process down. We are currently in the process of cancelling the...

products that she signed for 5/26/15. The process of cancelling products takes time and is being handled as expeditiously as possible. The cancellations will  be removed from her loan as soon as the lienholder posts them to her account.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.  The dealership and I had reached an agreement through phone communication. They have taken the car back, and will be paying the full balance on the loan. They also agreed to pay me the amount of $2000 which I have received. The car will not reflect negatively on my credit report.Details of the agreement with both signatures on it, will be faxed to the Revdex.com of Upstate SC on Monday using the provided fax number in my email.

Mr.[redacted] did come into our dealership April 14th 2014 and purchase a 2004 Mazda RX8. He was informed prior to sale of this vehicle that it was being sold "AS IS "! We have multiple documents with his signature stating that he...

knew this before taking delivery. We did everything above board in and during this transaction. We did however offer solutions to help him out while at the same time let him know that this was indeed his vehicle and no longer ours. We as always are willing to trade him into a different car.

We have done our due diligence in order to protect the consumer to the best of our ability and disclose any underling issues with said purchase by utilizing the consumer reporting agency "CarFax" .We  do not use Auto check as most dealers do not. Auto Check is usually used by Auto Acutions and is based on opinion rather than documented fact. If you will notice that the top of the Auto check Report forwarded by the consumer it states that the vehicle  has no history of an accident under Accident Check. Then it refers you to the section under Vehicle Use and Event Check for further information. It also states in that section no accident has been reported. Then under  Detailed Vehicle History on 6/27/2013 it shows "Auction Announced as Unibody Damage" This was placed on the Auto Check Report from what appears to be opinion by an Auto Auction, why I can not say, for which we would have no knowledge.
From what we have learned from the Auto Check service is any auction inspector can call frame or unibody damage if there are any markings on the frame that could have been caused by as little as a tie down during transportation, which can cause rub marks but no damage.
We will  gladly give the consumer Fair Market value for her trade in if she wishes to trade. We will Take into consideration she purchased the automobile from us and try to make it financially feasible.
The consumer may not have received a call back from the manager, she spoke with, [redacted], due to the fact he has left employment with Dick Smith Automotive.
The consumer did attempt to previously trade out of this vehicle with our company but we could not reach an agreement on monthly payments based on current offerings from different financial institutions.

Thank you for contacting us
regarding concerns over your recent visit to our dealership. Every comment we receive
is very important to us in order to maintain a high level of customer
satisfaction.
After reviewing notes outlining
the details of your visit, we understand you have concerns about inquires
listed on your credit file. You stated that your credit was pulled at least 10
times. However after investigation it appears your request for financing was
submitted to 6 lenders. This was only done after your conversation with the
Business manager, stating that you wanted ongoing attempts to purchase a new Hyundai
Genesis and trade your 2016 Hyundai Veloster. We strive hard to assist every
guest to find a suitable vehicle with affordable financing options.
You signed the application giving us permission to obtain a credit
report and submit to lenders on your behalf. We have no ability to remove any
inquiry, and your written signature authorized us to assist you by submitting
to lenders for the sole purpose of an auto loan. Additionally above your
signature it states “this application may be submitted to the following
financial institutions” which you left blank.

As my title was a separate issue from finance I do not accept this response.  I was waiting for an out of state title to be issued.  The dealership was well aware of this fact.  I did not agree to the extra service contract or the key replacement.  I signed paperwork to have this removed from my loan long before my title was re-issued.  The date of issue from the State of North Carolina was 8/7/2015.  My first contact to have these extra charges removed was in June.  I do not think I should have to pay for something I originally declined.  I also do not think I should be paying interest on something I originally declined.
