Review: In March 2014 we purchased parts to rebuild an engine in a Dodge 2500, for a customer. A piston that was purchased from Quality Diesel failed causing catastrophic damage to the rebuilt engine including cracking the engine block and damaging the turbo and related engine components. Interstate [redacted], the parts manufacture, has acknowledged and accepted full responsibility for its parts failure and damage that was caused. [redacted], owner of Quality Diesel, has told both myself, and my wife, [redacted], that he has received payment from Interstate [redacted], but refuses to send us the money unless we are willing to settle for a small amount. He refuses to provide any paperwork from [redacted] showing what they covered on the warranty or how much compensation he received on our behalf. He also refuses to provided us with his Liability insurance information. [redacted] is also claiming that [redacted] is refusing to warranty the turbo because we did not know it has been damaged by the piston failure until after we completed rebuilding the engine the second time. We attempted to contacted [redacted] more than 5 times prior to him receiving payment from [redacted] and left messages regarding the failure of the turbo. As has been the case the whole time dealing with this issue, [redacted] refuses to return phone calls for weeks at a time. In early August, my wife was finally able to talk directly to [redacted] about the turbo. She told him we still had the failed turbo and we would be willing to send it to him, but he needed to take financial responsibility for the core and put it on his account with the company that supplied the turbo. Because [redacted] is very untrustworthy and already owes us a large amount of money, I didn't trust him to return the $600 core to us, which would of caused us to loose another $600. [redacted] then stated he did not need the turbo, just send the paperwork and he will turn the claim into [redacted] and get us compensated. Now he is refusing any compensation for the turbo which our cost for the part is $1395, not including the labor.Desired Settlement: We expect a refund of $7393.77 for parts and labor due to the parts failure. Our customer is demanding to be compensated an additional $4000 for the decreased value of the block due to it being sleeved instead of replaced with block in like condition as is stated in the warranty, or for Quality to replaced the block with one that is in like condition prior to failure.

Response:

On 06-20-2014 we agreed to pay $36000.00 labor plus all parts on invoice 196 submitted on 06-07-14. Mr. [redacted] was asked to bring us the turbo to check but he checked it himself and said it was fine. The Block was repaired with one cylinder sleeve, and okayed by Mr. [redacted] after talking with his customer.

After the engine was finished by Mr. [redacted], he found the turbo to be bad as we suspected. I told Mr. [redacted] to send me the turbo and I ask McBee to Reopen the Claim. As of today we have not received the turbo. On 07-01-14 Mr. [redacted] modified invoice 196 to a higher amount. The block issue is out of the blue and not by agreement.

Sincerely

Response:

I am rejecting this response because: I am rejecting this response because: Quality Diesel has made no serious or reasonable attempt to settle this manner and have been dragging it out since April. Based on [redacted]'s response of his $36000.00 offer (which we will gladly accept) he is not taking the situation seriously. [redacted] refused to return phone calls or discuss this from late-June until early August. His offer was not made until August 11th. [redacted] never asked to see the turbo. The only discussion we had about the Turbo prior to mid July, when we discover the turbo was also destroyed by the part failure, was he had asked if there was any visible damage to the turbo. There was not, the damage was internal. I attempted to notify [redacted] that the Turbo was bad in July, as soon as I discovered it. I told his employees on several occasions that it needed to be replaced. For more than 2 weeks [redacted] refused to return any phone calls or have any discussion regarding the turbo. On July 24th, I was forced to purchase another turbo so that I could complete the job and get the truck back to my customer. I then faxed over and updated invoice to [redacted] that included the turbo. The invoice was dated July 1st, however it was not updated with the turbo or sent to [redacted] until the end of July/ early August. He still continued to refuse to return phone calls. It was not until August 7th that he even acknowledged the turbo issues, when he spoke with my wife. By that point the core charge was due and [redacted] already owed us thousands of dollars. My wife offered to send him the core, as long as he put it on his account. At this point [redacted] had already proven himself to be a liar and was only playing games. We did not trust that the core would be returned to us causing us to lose another $600 on this job. [redacted] then said he did not need the core, we could return it, he just needed the paperwork. If [redacted] had returned the phone calls in July, prior to [redacted] closing the case, there would have been no need to try and reopen it. As I already stated, I never okayed repairing the block with a sleeve. In fact, I told him the customer said it was not acceptable. My customer even went down to Quality Diesel and personally spoke with [redacted], prior to the block being sleeved, and told him that sleeving the block was not acceptable. However [redacted] went ahead and returned a sleeved block to me. I told [redacted] at the time, that the customer expects compensation for the block not being returned in like condition, as the warranty states. I only installed the sleeved block with [redacted]s understanding that this was not satisfactory to the customer unless he would be compensated. Keep in mind [redacted] had been dragging this out for over two months at this point, leaving the customer without a truck, and we were already out thousands of dollars. It is evident that it is a product failure and the warranty is very specific as to coverage of labor and consequential damage ie block and turbo charger. The manufacture has already accepted and acknowledged full responsibility for the parts failure and sub-sequential damage. According to [redacted], Quality Diesel has received compensation from the parts manufacture on August 6th, 2014.As far as [redacted]'s claim that the block issue is "out of the blue" is a complete lie. The customer spoke to [redacted] in person on two occasions, including once prior to the repair. Both times, our customer had a witness to this exchange. [redacted] also acknowledge to my wife, In August, that he was aware that the customer was not satisfied with the sleeved block.
