In response to the accusations of *** ***:Ms*** was in fact well informed of every decision and move made regarding her project!First of all instead of feeling sorry for the womans sob story about how every contractor who had done
prior work had cheated her or sexually harassed her; I should've taken those comments as "red flags" and walked awayShe even re-wrote the contract and I missed a few details when I tried reading over it because she was talking constantly.One of the things I did catch was the "no sub-contractors" clauseWhen I pointed it out and informed her there would be sub-contractors there she said, "Oh okay, I'm aware of them now so it's alright." I then said, "Well I'm a word and a hand shake kind of person anyways and there's a lot of variables in this project because you're still undecided on so many things." She then replied, "I am too, a verbal contract is just as binding." I'm not sure who the "competent contractors" are but the one person she had over asking questions while work was in progress was satisfied with every answer I had given him at the time and that addition is structurally soundI had informed her at first meeting, and reminded her again on contract date, that her weather head and power meter would have to be moved and a new updated breaker box installedI recommended re-wiring the existing house at the same timeI told her,"since there's no attic access I can't tell how many but I'm sure there's some wires that'll be in the way and besides they should all be ran to the new box anyway." I then offered to run wires over to the box to save her some money but that a licensed electrician would have to connect them to the breakersShe agreed saying,"I agree there's no reason to have two boxes, or is there? and it's probably better to have new wire since these wires are over years old." I told her," I'd install new if it were my house" The decision was made then to re-wire the entire houseShe questioned the dumpster cost of $in the beginning and was informed that included time to "thoroughly clean" as wellThere were trailer loads of scrap and several truck loads hauled away and time spent handling materials twice because a dumpster was not available due to the timing of the DuQuoin State FairEven tho it cost more in the long run without the dumpster the final bill only included the original $Also she was informed in the very beginning that the estimated material list that I'd brought along from ***s was simply to show her an idea of some of the major expenses associated with such a project, not an exact list, some things I have in stock and smaller items could be bought locallyShe asked to make copies of the list to "show my friend *** some of what's involved because she can't believe it'll cost that much." I agreed, I shouldn't haveBefore the contract was signed or any money exchanged I informed her that, I will not pay anything on the larger material bill from *** *** *** until the entire amount of the final bill is paid in full + any late fees if after days past due because my contractors and I will be paid first, we don't work for free.If someone doesn't pay then ***s can pursue Lien Rights to get their money for materials rather than us starve waiting to collect." She said," oh I understand, nobody should work for free and I always pay right awayI know somebody that had Lien Rights put on their property and it was a mess, I don't want that.""How much are late fees," she said thenI replied, " 5% for each days past due." She then asked," but I have days from final bill before penalty right?" The answer was "yes, but every days after is another 5%" Also, the additional labor cost on the final bill was for all the additional work that was done that wasn't part of the contracted work that Ms*** repeatedly said, "I'll pay for that" or "could you do something else for me? I'll pay you for it."
