Case number [redacted] I have contract #*** with [redacted] for a full basement remodelIt is a 2,sq ft basementPermit number [redacted] We have gone above and beyond the exhibit of our contractOn our last meeting [redacted] and his wife accused us of using their money "illegally" and I was given an addendum from them stating that unless it was signed that they will continue to deny access to their home for the completion of the project, this was an anticipatory breachThe addendum contained several things that were not part of the original exhibit signed by both parties and basically would make them liable for only paying us $ [redacted] out of $ [redacted] that was the actual amount described in the contract and change orderWe couldn't continue on to finish the work knowing that we were not going to get paid in fullThe last items from the exhibit that were not delivered and/or installed were: Installation of TV mounts (we were able to install one), dishwasher, bar island with countertop sink and faucet, shower handles, door knobs, the baseboard for one room (gym)They have accused us of damaging their walls among many other things and as you can see in the pictures attached on here there are no damages on themThey are also accusing us of misusing their funds and if you can also see in the pictures we are already given them more than their moneys worthOur contract specifies that they would be liable for any additional cost and they also don't want to compensate us at allThey asked for body sprays and a thermostatic valve with a digital controller (Not part of the exhibit)Our legal team is working on this accusation, we are a trustworthy business, all of my clients have been satisfied with the way I conduct myself in the jobs, after hearing that all they wanted to pay was around $ [redacted] I couldn't continue getting my company in debtThe next step we are taking is we are going to have an amicable negotiation, our lawyers are reviewing all the documentation we have and we are looking into getting a contractor appraisal.Thank you

I have reviewed the offer and/or response made
by the business in reference to complaint ID ***, and have determined that
this proposed action would not resolve my complaint. For your reference,
details of the offer I reviewed appear below
In response to Dorcas Hoagland dba Quality
Builders of Spotsylvania. WE (The ***') have gone over and above this
contract. We have allowed a job scheduled to complete in thirty days, to
continue for months! Dorcas H*** of Quality Builders of
Spotsylvania and Campos Home Renovation (her subcontractor) have repeatedly
dragged us along in this project, lied repeatedly about completion dates,
material deliveries and overall completion of this project. It is our
belief she had no funds because (as stated by her on numerous occasions) *** *** ** *** *** *** (the initial project foreman), took a
portion or all the $*** we have already paid towards the project and she was
unable to re-coop any of it to dateCampos Home Renovations and Quality
Builders of Spotsylvania left our home in total dysfunction and much of the
work performed by them requires re-work or follwork. We NEVER asked
for anything that has not detailed in both of the *** contract exhibits (see attachments) or verbally agreed
upon by both parties
Throughout the last months, there has been numerous occasions a work crew hasn’t
shown up to perform workUpon trying to reach MsH*** to find out when
and if they would show up, she either didn’t respond to the communication or
made an excuse for why they weren’t on site and would say they would arrive
later that day, however, no worker would show up at all
In regards to her
documented 'friendly consultation', we initiated each of these meetings, to
discuss work repeatedly performed wrong, undone, and/or damages resulting for
work
As for the
accusations of our “breach of contract” due to entering the workspace without a
contractor present, this is completely absorbIt was known that we would be in
the workspace every day without the contractor, because we had to unlock the
door for them in the mornings, as well as loafter the work crew in the
evenings on a daily basisWe would never give complete and total access to our
home, to anyone that isn’t family (especially not a crew that cut the wires to
our alarm system, telephone, and cable)So although they were given a key to
the lower lock on the door, there’s a dead bolt lock that required us to unlock
itThe cutting and disconnection of these things has cost us plenty of money
to have new systems put in and rewiring doneThis was promptly brought to Ms
H***’s and Antonio H***’s attentionMsH*** came on sight to see
the damages and asked that we pay to have the repairs completed and deduct the
amount from the remaining balance (third and final payment), of the contract

Dorcas wrote: They have accused us of damaging their walls among

here there are no damages on them.
Response: They are directly responsible braking water spigot outside
the shiplap wall, causing them to replace it. Improper repair lead to a
leak behind the wall. We had to pay an outside plumber to repair the leak
as she claimed she had no one to fix it and we could deduct this from the
balance(See pictures of damage
attached #2) This is only one reference among many other things

Response: Body sprays and a temperature controlled water
valve was always part of our agreement, as we requested temperature controlled
waterIt is not our fault the contractor didn't understand all things required
to complete the job. There are several things that Dorcas agreed to do,
that aren't in the exhibit and that she chose to leave out because she told us
the software program she used wouldn’t allow her to itemize the contractI
have the email that states thisAt this time, the shower is incomplete and non-operational
The shower tile is set improperly resulting in gaps between the
stonesThese gaps will need to be grouted from basin to ceilingThe water valve controllers weren’t provided
and/or installedAll tile needs to be sealed (on the walls, benches, and
floors)The recess lights in the shower need replacing with waterproof ones
The thermostatic valve needs installing(see
picture attached #3)
She is correctWe did not fully trust her nor Campos, as they both repeatedly
misled us, attempted to cut corners on the work, and breached their own
contract by substituting our requested materials for cheaper, unapproved (by
us) materials and continuously missing their own self-imposed deadlines (e.gsee attached email)She claimed to have had ALL our cabinets’
custom built, instead of ordering our requested and approved cabinets, because
it was going to take too long for them to arrive (weeks delivery time) and
that they were already shipped to usHowever, she could never provide any
contact information for the manufacturer, no tracking numbers, or any pictures
of the productShe also claimed that the granite counter tops were already
being cut however, she could never provide evidence of this eitherWe never
received the cabinets or counter tops
She has gone as
far as to tell *** she had no contract with us and did not know who
we were. Homeadvisor sent me the transcript between the two of them and
they have since removed her from their site
In regards to her stating that we only wanted to pay her $*** at the end of the
project, we have already paid $***The purchase of our bar cabinets and counter tops we approved and authorized will
cost over $**k aloneAfter that, the cost of installing those items, as well
as having the unfinished work completed and improper work corrected still remains
The next step we are taking is through our legal counsel. We also require she return our key immediately
and it is to be given directly to us in our hands, not left anywhere or mailed

Our contract specifies that they would be liable for any additional cost and they also don't want to compensate us at all. They asked for 6 body sprays and a thermostatic valve with a digital controller (Not part of the exhibit). Our legal team is working on this accusation, we are a trustworthy business, all of my clients have been satisfied with the way I conduct myself in the jobs, after hearing that all they wanted to pay was around $[redacted] I couldn't continue getting my company in debt. The next step we are taking is we are  going to have an amicable negotiation, our lawyers are reviewing all the documentation we have and we are looking into getting a contractor appraisal.Thank you.
