October 22, 2015 I had a phone discussion with Mr*** on 10/20/What we are going to do is have my supervisor for the siding division (Cliff) meet with Mr*** and walk around the home and help the homeowner come up with a punch listOnce a punch list is made and agreed upon by both parties I will schedule the crews to handle any item that has to do with contracts between both partiesOnce that is done Mr*** will pay the balance owed to Quality Homes and write a letter to the Revdex.com that he is all setThank you,

October 13, 2015My letter is into response to the complaint filed by *** *** in reference to customer service Issues.I am the person that spoke with Mr*** on approximately 10-1-in reference t the wall issueI am supplying you pictures of before and after of the
job which you may see what Mr*** is speaking about has nothing to do with the contracted work we did in his home.Mr*** home was built in and has had additions added on over the yearsHe as walls that were built and bows in the wallsIt is not in my contract to rebuild walls with a siding jobAs I have explained to Mr*** on numerous occasionsA siding job is a cosmeticfacelift not a structure repairWhen I spoke with Mr*** on 10-1-he told me he had a friend that said it could have been fixed before the siding which I agree but he would have to pay a carpenter to come out and do the workOn 10-1-I told Mr*** I would bring outa carpenter to give him a price and Mr*** replied noSometimes when you put up the insulation it hides a little but again this is not a structural jobWhen I spoke with Mr*** on 10-1-I told him we could go to arbitration and let both parties speak and what theydecide both parties would agree toMr*** said that would be goodI told Mr*** I would be out of town until10-12-and when I returned we would set the arbitration up Now I can see he did not wait based on his word.) As far as the ceiling leak I told him I would be acrew there right away to repair, Mr*** told me he is not concerned about the ceiling only the bow in the wall(which was there when we started.) As far as the time frames all jobs are an estimated time frame as the contract states base on several conditions, whether being the main oneWhat Mr*** failed to inform you is that the add on dollars were for windows we ordered and rushed in for the job in August (two months after the contract signing.) There were walls on the home when we stripped away the aluminum that we had to put on plywood as nothing was there but studsI have been in business years with over 20,homeowners and we work very hard to satisfy customers but when a customer holds $4,for work that was not contracted to do and wants you to fix a wall area that was never in the contract (enclosed l have completed all items that we in the contract and addendums signed by Mr*** and should be paid the balance of the All materials, etc., have been removed from the propertyIf Mr*** has punch item are contracted we will be glad to address but damage to his house? Please have Mr*** send me a punch list(without the wall). On the completion certificate (enclosed) the only things Mr*** was concerned about with his punch was the east side had waves, west side had waves, and accordingly cut cab e to upper bedroomIn the completion Mr*** was happy with everything under item on except for above, dated 9/28/15. I will wait to hear a response and yes I will lien the home as I have the right to do so until payment is madeWe have followed our contract and completed the items that Mr***has paid us to doThe contract is signed by both partiesI stand behind what I say to a homeowner and I can see Mr*** does not by filing this complaint not waiting as we discussed until10-12-2015.Thank you,Ken M***

November 18, 2015I am writing in reference to the complaint filed by [redacted].First item, the contract states 4-6 weeks not 2-6 weeks, weather permitting. I have enclosedweather logs from WHEC TV, Rochester weather department, dating October 15th throughNovember 1 I 11....

Mrs. [redacted] roof is a complete tear off which means no chance of rain in theforecast as we are opening the roof all the way to the drywall stage. In the month of October wehad rain approximately 11 days totaling 2.78in, in November up until the 1 ih we have alreadyhad 7 Days of rain and 3-4 days with 30-40mph winds (can not be on a roof with 30-40mphwinds). Documents are enclosed.Second item, we have taken on 1 deposit to date of$1,595.00. Quality Homes has not made anyother charges to the card. We have done previous work on the other side of the roof in 2012 andshe signed a letter stating she was completely satisfied. Letter also enclosed.She was told last week, Friday November 13th, that her job was coming up right after theHoliday due to weather we have had. She put a complaint in to Revdex.com after hearing that. I havelost 18 plus days due to weather since the contract was signed and we are only a week to weekand a half behind. If Mrs. [redacted] would like her money back I will be glad to refund her$1595.00. I do not want to work for someone that is not understanding to what we go through. Ifshe wants us to do the roof it will be done, weather permitting, the week after the holiday.thank you,

I would like to say first of all Ken never indicated he was going to be out of town until the 12th, this is the first I have even heard of this.  We did have the conversation about the walls and he indicated that he could have his contractor come out to give an estimate, I just purchased 35K in services and would feel if there was an issue it would have been addressed when the house was stripped not after the vinyl is installed.  Cliff from quality homes was about to do a walk trough with me on the punch list, after my discussion with Ken he stopped and I didn't hear from him again until I filed the complaint, that is when he returned to pick up the extra material around the house and pick up the nails.  Now most importantly here, the $4,700 that Ken mentions, he indicated to me that he wanted to process one of the payments, mind you the 30K I financed or the 4K I held as a retainer, typically you would hold 10% in which I did, I could have held the 30K since it was related to the work but that was not the agreement.  The bottom line here, I just want to resolve this, this has been an absolute nightmare.  Ken wasn't even aware of the damage to my house until the day I spoke with him, the damage happened well over a month prior.  And he never offered to have the damage repaired as stated, it should have been addressed when the damage took place.  I didn't even mention that the siders cut my cable TV cable to our house that is still not repaired, if Ken would like to sit down and speak on this I think it would be beneficial for all.  I have every right to hold a retainer until all work is complete, I can come up with a punch list or he could have Cliff return to walk the house like we were going to a few weeks back.  Again as I stated I am wanting to resolve this, but this should not hold up the damages being repaired in a timely manner.

First and
foremost the three day rescission has nothing to do with a deposit on a
job.  I receive numerous deposits
everyday for jobs.  No home owner should
be writing a check for insufficient fund. 
All the talk of moving money around back and forth is hear say. The
check enclosed was returned for insufficient funds which resulted in my bank
charging my account $30.00.  Ms. [redacted] did not care that I got charged for no reason. 
If someone does cancel a job after the deposit is made a refund check
would be sent to the home owner or they can pick the check up after the check
clears my account.  To say I cashed the
check is not true.  The check was
deposited on Thursday April 9th. 
For Ms. [redacted] to say I would rather steal $37.00 is a ridiculous statement.  If the funds were in the account, which by
law are suppose to be, there would be no charges made to either party.  It has nothing to do with if I can afford the
$37.00 or not.  Why should I be paying
$30.00 due to her writing checks without the fund available?  
I have been
in business for 25 years and have never kept a deposit on a cancelled job.  She made the decision without even speaking
to someone about what options could be done and now she is out $37.00 and
Quality Homes of Rochester is out $30.00 for no reason.  As you see in her letter, like I said
earlier, no mention from Ms. [redacted] that I got charged $30.00 for a check
written by her.  There is no bad intent by
Quality Homes at all.  If the check did
not get returned for insufficient funds, Ms. [redacted] would have had a check for
$5,000.00 on the day the check cleared. This has been our policy for 25 years.
I take my
loss for no reason of $30.00 she can take her loss.

The funds were in the bank when the check was written.  I spoke to [redacted]'[redacted] (salesperson) to cancel the order, and he told me my check would be in the mail.  That's when I moved the money back into my savings.  Since
I was told that I had a 3 day window to change my mind, I thought why would they deposit my check at all.  Why not just mail my original check back to me which I would void.  Instead, Mr. [redacted] tried to force another meeting
with me on the following Saturday to have someone else from his company look at the job to see if they could come down in price.  Little did I know at the time that my check was already being deposited. I would rather prevent Mr. [redacted] from
depositing my $5000 and have to wait for who knows how long to get that back - instead I didn't do anything to have him lose money, just went according to his contract.  No where does it say that he will deposit the funds during the 3 day period,
regardless if you're having them do the work or not  Maybe he should stop taking deposits for jobs until he knows for sure that he's actually hired..
If I had known that he was going to deposit my check, I would have kept the money in the bank and prevented my acct from being charged $37.00.  Still, I don't feel it's right to have someone use your funds when they don't know for sure that they are getting the job.

I am writing
this response to the letter received from the Revdex.com dated 1/5/2015 ID [redacted]
 
As far as
the start of the job, the [redacted] were kept in contact with throughout the
delays.  When the job was to be started on
Monday December 1st we contacted the homeowner that morning and
explained that the customer before them had added on some fascia and soffit to
their job and that we would be starting their job the next day (Tuesday
December 2nd). I, the owner, personally called Mrs. [redacted] and apologized
that she did not get a call on Friday to give her more notice.  I spoke with Mrs. [redacted] again about her kick
plate as our office was closed during the Christmas break.  On the day we reopened, Mrs. [redacted] kick
plate was installed and the home owner signed off on a completion certificate
on December 21st, 2014.  The
completion certificate is attached and states do not sign until all work has
been completed to your satisfaction and to the terms of your contract.
My office
was open the week of New Years on Monday the 29th and Tuesday the 30th
and closed until January 5th, 2015. 
I asked my supervisor, [redacted], even though the home owner signed a
completion to their satisfaction to stop by and make sure everything looked
good.  [redacted] spoke with the home owner on
December 29th and told Mrs. [redacted] there were some areas he felt
needed caulking and when the siding crew finished the job they were on they
would be right over to address the issues. These issues are not issues the home
owner found but areas Quality Homes of Rochester felt needed to be
improved.  My siding crew would have been
there yesterday January 5th, 2015, the day the office reopened, but
we had 30-40 mph winds and bad wind chills. 
The crew is scheduled to be there today January 6, 2015.
I do not
understand the complaint since there were discussions with Mrs. [redacted] about
when the final issues would be taken care of and a completion was signed to her
satisfaction.

I will answer his complaint as written then add a few comments that Mr. [redacted] did not mention in his complaint. First item, nowhere in the contract is written that 10 sheets of OSB or plywood would be installed. The contract states if wood is needed we would install OSB sheets, which we found one sheet that needed to be replaced and proceeded to replace the one sheet of OSB. Nowhere in the contract does the wording “$50.00 per sheet for plywood” Is written that was signed by Mr. [redacted]. The second item I would like to address is that “the roof is guaranteed for 15 years including labor and material per contract.” Again in this contract signed by Mr. [redacted] on 9/16/2011, that statement does not appear. There is a 15-year manufacturer’s warranty on the material, the labor warranty in the contract, which is required by NYS law is stated in item 3 of the enclosed contract, is for one year from the completion date. This job is 5 years old. Even though Mr. [redacted]’s warranty is over, we sent our job supervisor to his home and sealed a vent at no charge to the homeowner. The homeowner only had a partial roof done with us in 2011, he had existing problems in the other areas of the roof not in our contract as he had them covered with tarps (pictures attached). Mr. [redacted] even asked Cliff, job supervisor, to give him a price on fixing the other areas of the roof. Cliff did work up a number for the project but due to the receiving of this complaint we will not be giving a price out. In Mr. [redacted]s letter, page 2, he stated “because the work was done poorly he had to tear apart and repaint several times” but why was there no phone call to my company until 8/22/16, five years after the partial roof was installed per contract?  Quality Homes cannot go seal vents of every homeowner every 4-5 years, that is part of maintenance of the homeowner as caulk and seal crack over time. Mr. [redacted]s job was also never paid for according to contract(enclosed). He paid the $1,000.00 deposit on 9/19/2011 per contract, after that the contract was written to receive $1025.00 upon start and $1400.00 upon completion. We started the job approximately 10/1/2011, we didn’t receive a payment until 11/1/2012 and it was of $500.00 which broke contract, then we didn’t receive another payment until 3/1/13(ledger enclosed). The payment on 3/1/13 was a bounced check. I have letters enclosed from [redacted]s mother since she had to pay the remainder for her son, which was not fully paid for until 3/15/2013, a year and a half later. Even after all this and it being after warranty we still went out and sealed his vents at no charge on 8/25/16, which Mr. [redacted] signed himself(enclosed). I have been in business 28 years and have had over 20,000 homeowners and I care about them all, most companies wouldn’t make the 45-minute drive with no charge for the repair.
