To whom it may concernletter is in response to complaint filed by [redacted], My name is [redacted] owner of Quality Masonry. This has been an ongoing situation for a long [redacted]e now and I would very much like to resolve this by any means that is agreeable by both parties. Abrief background...

is as follows, when I first inspecting [redacted]s driveway it was completely cracked and deteriorated due the extreme water runoff from her home. [redacted] told me this has been a major problemfor many years and if I could, could I please solve the problem and Install a new driveway. I told her at that [redacted]e this would be a very difficult job to do as water is our worst enemy here. She insisted that I doso. I reluctantly accepted the challenge which now I regret. We agreed on $8400 total cost, see contract for details. To relieve some of the water runoff I suggested to install two drains and told her proper raingutters should be installed right away. She agreed with this. We began removing the driveway. When the driveway was removed, I saw that the base was very adequate for the job. Consisting of sand andgravel mix.I showed her the base and we talked about it and we again agreed instead of a replacing the base which would have cost approximately 5 to 6 yards of gravel at $10 a yard. It was 4 to 5 in. deep and spread, graded and power compacted this would cost a total of $250 including labor. In place of a new base, we agreed to replace an old slab in front of her shed so I did that instead. It should also be noted that I did in fact bring in and spread approximately 2 yards of gravel to top off the base. When doing her es[redacted]ate she also had great concerns about the water running into her neighbor's yard. So we decided on installing a complete underground drain tile system on East side of her driveway. From the garage to the street approximately 65 feet long. We topped it off with black dirt seed and straw. The cost for this was to be $1800 which was included as part of our contract. When pouring the driveway sections it rained almost every other day saturating the ground daily and delayed our progress. Like we needed more water problems but we moved forward.When pouring the section with the drains one did in fact heave up slightly I am 100% responsible for this and that it has left a very unsightly area. Miss [redacted] did have other complaints about some minor flaws in the driveway. So we went over these issue and she once again agreed to overlook some of these if I would scrape and paint her foundation and porch. Which we completed. I now only wish I would have got all this in writing but I trusted her.Please do note that concrete is not a perfect science. Living in the harsh climate that we live in from harsh winters to frost heave in the spring. Problems can and do arise one would just have to walk down any street, sidewalk or driveway to witness this.I have tried to contact Miss Boetther on numerous occasions. I have sent 4 letters and 3 phone calls leaving a message and my phone number # 715-803-3849 each [redacted]e to try to resolve this. Not once has Miss [redacted] returned my phone calls to set up an appointment to go over these issues and try to resolve this.I just recently inspected her driveway. There were no visible cracks or major heaving. There are areas that could be improved and drains replaced. I again am more than willing to work this out. But now Miss [redacted] is demanding a whole new driveway. I truly feel at this point there is and will never be anyway to make this right in her point of view. I have been in business for over 20 years and pride myself on my work but now due to major accident I am now permanently disabled and had to close my company down for good.Sincerely,[redacted]

Review: Contract stipulated a new base was to be installed when implementing a complete driveway replacement. That did not happen. Contractor [redacted] DBA Quality Masonry was more than happy to accept payment anyway. The resulting driveway is a disaster. Without a supportive base we now have a roller coaster drive with heaving as much as 4" with no hope of returning to normal, expansion joints opened to 1", contract also guarantees no cracking for at least two years but cracks already surfaced by 6 months. These are but a few of our issues.

I sent a complaint to DATCP in the first week of Oct 2014, who sent [redacted] two letters, one regarding violations of Code ATPC 110.02(6)(E), (7)(B), (11) & 110.4(3) & THE SECOND A WARNING having to do with requesting final payment b/4 job completion. To date almost 10 months after start date job has still not been completed & [redacted] has made no effort to rectify anything or even come around to take a look. I have invited other contractors to inspect the job & give me an idea of what can be done. Both have assured me repair is not possible. Another replacement is the only solution.

I did withhold $400.00 as DATCP says job must be completed first. Since [redacted] does not agree with them he has apparently decided to do nothing. I have communicated with him by letter in July, Aug, Sept of 2014 & Mar & Apr of 2015 but no positive response has been received. Also have been unable to reach him by phone, no longer sure of what the # actually is even though I have made an effort. No one answers to say please leave a message & we'll call you back. Frustrating!

I spoke today with [redacted] in the Appleton Revdex.com office about the ph #'s, she took down what I currently have. In addition I have agreed to forward to her a copy of the proposal itself as imprinted thereon is the Revdex.com symbol of accreditation. She agreed it would be information of interest since Quality Masonry is not an accredited business.

This man & his business is bad news for the community. Per observations with my own eyes while he was working here he pays his workers in cash. I could actually write a book but you get the idea.Desired Settlement: Since the job is no longer repairable it would be best if [redacted] returns the full price of$8000.00 & I will make arrangements for another contractor to do the work. Installing the new base requires tearing out the entire drive to get it laid. Would it make any sense to allow [redacted] to redo it? I don't think either of us would be comfortable with that arrangement. When I denied the $400.00 payment [redacted] lost his temper completely & blew up. Since then he has been unwilling to meet with me saying he does not want any confrontations. Only he has control over his temper. It makes for a possibly dangerous circumstance.

I sent out another letter today setting a May 15th deadline for action on his part. If we cannot agree on settlement terms by then I will file a lawsuit.
