I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
[Provide details of why you are not satisfied with this resolution.]Quality Metal has simply sent to thr Revdex.com a copy of their response to the ** **'s office, which they submitted several months agoTheir illegal actions resulted in fines levied by the state of WV, which they do not disputeQuality Metal makes no effort to remedy this situation, only to deny their responsibility. The state of WV deems their involvement in the work on my property that of a general contractorDamage occurred on my property as a result of that workI simply want it repairedThis company has ignored their responsibility, and their refusal to even provide a fresh response to the Revdex.com shows the contempt they hold for my property, the Revdex.com, and Quality Metal's customer base in general.This business has photos of the damage, and obviously has all paperwork related to the ** *** ** *** investigation, which includes proof of their subcontractor presenting for a building permit with another contractor's licenseQuality Metal and the subcontractor have been punished by the state for their actions, and documentation of all issues herein can be providedI simply want my walls repaired that were damaged during their work.

The price of the material in which Mr. [redacted] purchased from Quality Metal Roof was $2328.83. Mr. [redacted] asked if it were possible to pay for the entire amount of $6,000.00 with a credit card, and was told Quality Metal accepts payments for material only, as printed on the bottom of each invoice....

Mr. [redacted] stated that he wanted to use a 12 month interest free credit card; I told him again that our policy was only to collect money for material, balance due was to be paid to the installer. Mr. [redacted] asked me to talk to the owner and see if he would accept the full amount with two (2) separate credit cards, so I did what he asked, and 1 contacted Mr. [redacted] back and told him that I received permission to do that. Mr. [redacted] made the remark that he could write a check with his cards but the interest would start immediately and not 12 months from now, and would prefer not to do that. Mr. [redacted] requested us to go ahead and run the cards for the full $6000.00, stating he had 2 different cards and wanted 2 different amounts ran on each card which he specified: [redacted] $1500.00 ran at 9:46:45 am on 12/2/13 [redacted] $4500.00 ran at 9:46:04 am on 12/2/13 We ran the cards while Mr. [redacted] was on the line and told him they had been approved, and he thanked me, and everything was good. The part of the complaint of $3000.00 prior to start of job for materials and $3000.00 after completion of job is a contract between the contractor/** [redacted] and the homeowner/[redacted]. Mr. [redacted] was not signing a contract with Quality Metal Roof Mfg. & Sales, and Mr. [redacted] was aware of that. Mr. [redacted] called me ([redacted]) complaining that his wife had to move clothes out of a closet and wanted us to reimburse them for the inconvenience. I asked what amount he was expecting since she never had wet clothes in the closet, and Mr. [redacted] said there was no damage just inconvenience to his wife and she deserved a refund. I asked again how much he was talking about his response was "2", and I asked $20 or $200 he laughed and said no, no I'm going to get at least $2000.00! I told him that was almost the full amount of the material he purchased from Quality Metal Roof, and he needed to address that to his installer. Response to complaint #13 Mr. [redacted] has a contract in his possession from his contractor (** [redacted]). I spoke with [redacted] and he said he never signed and returned the contract. Response to complaint #14 Mr. [redacted] did receive a copy of the Contract between him and his Contractor according to [redacted] (B & H Home Imp.) That is where they came to the agreement of $3000.00 prior to start of job for materials and $3000.00 after completion of job. There was no contract between Quality Metal Roofing and [redacted]. Response to complaint #16 I spoke with [redacted] (** [redacted].) and he stated that he provides a 1 year warranty on the homeowner's installation. If Mr. [redacted] has a claim of damages, he should have contacted [redacted] and have them do an inspection and if it was something caused by the installation of his roof, it would have been fixed. Quality Metal Roofing provides a limited 40 year warranty through the paint manufacture only, which was provided Mr. [redacted]. Response to complaint #17 Mr. [redacted] contacted us (Quality Metal Roof Mfg.) only after getting a quote from a company named [redacted]. Mr. [redacted] said that he had a relative who had bought from us and recommended us to him. Mr. [redacted] wanted 2 quotes for damages he said were caused by his satellite dish company, so he could turn them in. I faxed Mr. [redacted] estimates from two different installers as he requested. These estimates were not from subcontractors of Quality Metal Roof Mfg. & Sales. [redacted], the compliance officer, told us we were never the general contractor until 12/2/13 at 9:46am, when we accepted payment from Mr. [redacted] for [redacted], at which time it tied Quality Metal to the installer. I did inform Mr. [redacted] that his roof installation should only be a 2 day job with a full crew, and weather permitting. (See Exhibit A) Mr. [redacted] asked me if we had a license. Assuming he was speaking of a business license, my answer was yes. I never stated that ** [redacted]'s was a subcontractor of Quality Metal Roof Mfg. & Sales. The paperwork on file that Mr. [redacted] spoke of is previous orders placed by ** [redacted] to Quality Metal Roof Mfg. & Sales. When Mr. [redacted] called on 12/28/13 complaining that his wife had to remove cloths from her closet he never mentioned large amounts of water. My question is why would he even contact Quality Metal Roof? We only provided the materials used. Why did he not sign the contract given to him by [redacted]? Mr. [redacted] did contact the WV Dept. of Labor according to [redacted], Mr. [redacted] knew that he had made the payment to us and legally tied us to the contractor. [redacted] found it was deception of full payment and no fine was issued to Quality Metal, and that Quality Metal complied with Mr. [redacted]'s request and currently has a contractor's license #[redacted]. There was never any fraud going on. We never had files on installers, contractors, or wholesalers. We only keep records on what we have sold. Response to complaint #18 Quality Metal Roof Mfg. & Sales is requesting a copy of the quote given by [redacted] to repair damages. This will show what was previously damaged before the leak in the closet occurred. The City of [redacted] gave the permit. Does the city have an inspector that goes and inspects the finished job? Mr. [redacted] should allow ** [redacted] access to the damage area in question. The Chart shows rainfall in December. The [redacted] area received over 8" of rain during that period (with the exception of 3 or 4 days). When Mr. [redacted] stated that [redacted] stopped work on the 4th and began again on the 7th and then again on the 20th it had rained almost every day. If he had a leak, he should have told [redacted] on 12/20, after 16 days of rain. Mr. [redacted] asked for a discount because it was taking so long to complete the job. Mr. [redacted] complained of paying interest on his credit cards. I told him I was sorry but I was not authorized to provide discounts and he would need to ask his installer about that. Mr. [redacted] also requested reimbursement for tickets and a hotel room for a [redacted] game that he claims was Quality Metal's fault that he could not attend. Mr. [redacted] stated he received a statement in the mail for the full amount of the charges ran on his credit card and said it was unauthorized, which is untrue. If Mr. [redacted] would have called and asked that only materials be charged to his credit card, we would have refunded his card and would not have been responsible through the Department of Labor officer [redacted]. Mr. [redacted] gave me the two credit card numbers and amounts to be charged on each credit card. I strongly feel that Mr. [redacted] is being untruthful with his accusations and is trying to hold Quality Metal Roof Mfg. & Sales responsible.
